A juror in the George Zimmerman trial who had recently moved to Florida from Chicago said today that Zimmerman "got away with murder" for killing Trayvon Martin and feels she owes an apology to Martin's parents.

"You can't put the man in jail even though in our hearts we felt he was guilty," the woman, identified only as Juror B29 during the trial, told ABC's "Good Morning America. "We had to grab our hearts and put it aside and look at the evidence."

She said the evidence, under Florida law, did not prove murder.

The court has sealed the jurors' identities. While she allowed her face to be shown during the interview, she used only a first name of Maddy.

The woman is a nursing assistant and mother of eight children. She was living in Chicago when Martin was killed and was selected as a juror five months after moving to Seminole County, Fla. She is 36 and Puerto Rican, the only minority among the five women on the jury. Zimmerman, 29, is Hispanic and Martin, 17, was black.

But Maddy insisted that the case was never about race, at least to her. "George Zimmerman got away with murder, but you can't get away from God. And at the end of the day, he's going to have a lot of questions and answers he has to deal with," Maddy told the show.

When the jury began deliberations, Maddy said she favored convicting Zimmerman of second-degree murder, which could have put him in prison for the rest of his life. The jury was also allowed to consider manslaughter, a lesser charge.

"I was the juror that was going to give them the hung jury. I fought to the end," she said.

But on the second day of deliberations, Maddy said she realized there wasn't enough proof to convict Zimmerman of murder or manslaughter under Florida law. Zimmerman admitted he shot and killed Martin on Feb. 26, 2012, but maintained he fired in self-defense.

"That's where I felt confused, where if a person kills someone, then you get charged for it," Maddy said. "But as the law was read to me, if you have no proof that he killed him intentionally, you can't say he's guilty."

The juror said she has had trouble adjusting to life after the verdict, and has wrestled with whether she made the right decision. "I felt like I let a lot of people down, and I'm thinking to myself, 'Did I go the right way? Did I go the wrong way?'" she said.

"As much as we were trying to find this man guilty. . .they give you a booklet that basically tells you the truth. And the truth is that there was nothing that we could do about it," she said. "I feel the verdict was already told."

She said she believes she owes Trayvon Martin's parents an apology because she feels "like I let them down."

"It's hard for me to sleep, it's hard for me to eat because I feel I was forcefully included in Trayvon Martin's death. And as I carry him on my back, I'm hurting as much Trayvon's Martin's mother because there's no way that any mother should feel that pain," she said.

Maddy is the second juror to speak in a televised interview, and the first to show her face.

Juror B37, whose face and body were hidden, appeared last week on Anderson Cooper's CNN show, and said she believes Zimmerman's "heart was in the right place" when he became suspicious of Martin and that the teenager probably threw the first punch.

Since then, four other jurors distanced themselves from B37's remarks and released a statement saying B37's opinions were "not in any way representative" of their own.

I have to take issue with your definition of circumstantial evidence both in this post and a later post. Here is the wikipedia definition of circumstantial evidence:

Circumstantial evidence is evidence that relies on an inference to connect it to a conclusion of fact— like a fingerprint at the scene of a crime. By contrast, direct evidence supports the truth of an assertion directly—i.e., without need for any additional evidence or inference.

On its own, it is the nature of circumstantial evidence for more than one explanation to still be possible. Inference from one piece of circumstantial evidence may not guarantee accuracy. Circumstantial evidence usually accumulates into a collection, so that the pieces then become corroborating evidence. Together, they may more strongly support one particular inference over another. An explanation involving circumstantial evidence becomes more valid as proof of a fact when the alternative explanations have been ruled out.

Circumstantial evidence allows a trier of fact to deduce a fact exists.[1] In criminal law, the inference is made by the trier of facts in order to support the truth of assertion (of guilt or absence of guilt). Testimony can be direct evidence or it can be circumstantial. If the witness claims they saw the crime take place, this is considered direct evidence. For instance, a witness saying that the defendant stabbed the victim is direct evidence. By contrast, a witness who says that she saw the defendant enter a house, that she heard screaming, and that she saw the defendant leave with a bloody knife gives circumstantial evidence. It is the necessity for inference, and not the obviousness of a conclusion, that determines whether or not evidence is circumstantial.

Forensic evidence supplied by an expert witness is usually circumstantial evidence. A forensic scientist who testifies that ballistics proves the defendant’s firearm killed the victim provides circumstantial evidence from which the defendant’s guilt can be inferred. (Note that an inference of guilt could be incorrect if the person who actually fired the weapon was somebody else.) On the other hand, the additional circumstantial evidence of the defendant's fingerprint on the trigger would dovetail with this piece to provide corroborating evidence. Circumstantial evidence is especially important in civil and criminal cases where direct evidence is lacking.

Zimmerman's injuries are circumstantial evidence, not direct evidence, because more than one explanation is possible. Physical evidence can be circumstantial and in this case is. The witness testimony is direct evidence, but it is very weak direct evidence because the witnesses did not have a clear view and chose to stay indoors talking to the cops on the phone rather than stepping outside and clearly observing what was going on.

Zimmerman's cuts to the back of his head do not prove that he was having his skull beaten into the concrete. They could be interpretted to support the claim that Zimmerman was on the bottom during some part of the fight but even that is an inference based on circumstantial evidence. There is no medical evidence of Zimmerman having a broken nose. The picture of Zimmerman with a bloody nose is circumstantial physical evidence. Zimmerman could have gotten a bloody nose any number of ways and a bloody nose does not prove a broken nose or a sucker punch or even a punch at all.

Show me hard objective evidence that Trayvon was doing anything suspicious prior to Zimmerman pursuing him. Zimmerman was not a neutral person trying to investigate the situation. He is extremely belligerent and hostile on the 911 tape.

Zimmerman's job as neighborhood watch captain was to patrol the neighborhood watching for suspicious activity. He noticed Martin peeking in windows of several houses, called police, and kept an eye on him till police arrived.

Martin, instead of proceeding to his father's house, decided to circle back around and jump Zimmerman.

Could you elaborate on your allegation that Zimmerman was somehow "extremely beligerent and hostile" while on the phone with the 911 operator?

What we do know is that Zimmerman was a neighborhood watchman. He watched the neighborhood. He called the police to report his suspicion.

He calmly answered the questions posed by the police respectfully. What are you calling belligerent? What is hostile? I didn't hear it. Again, you are subjectively interpreting the data.

George Zimmerman filed a civil suit today just before 5PM EST at the Seminole County, Florida, Courthouse. The suit alleges the parents of Trayvon Martin, failed to control their minor-age son on the evening of February 26, 2012, when Martin repeatedly assaulted Zimmerman, placing him in imminent fear for his life and resulting in the death of Martin.

The civil action specifies that Zimmerman acted in self defense resulting in the case being ruled a justifiable homicide by a jury trial that ended on Saturday with a verdict of not guilty.

Desperate state prosecutors charged the victim with 2nd degree murder though they had no evidence of a crime and hoping to stay off more violence and having Florida put to the torch at the criminal hands of rioters months before the start of the state’s tourist season. The complaint further specifies Zimmerman shares “zero-liability” in the death of Martin as he acted without malice and solely in self-defense. The amount of damages Zimmerman is seeking are unspecified.

It was interesting reading through the comments on the thread that you linked to.

The argument seems to come down to four primary categories:

Those who assume Trayvon is innocent because he was black.

Those who assume Zimmerman is guilty because he is NOT black.

There is a small leavening of White Racists, but most of the real racism evident is Blacks assuming Zimmerman had to be guilty because he is NOT black.

Then there is the group which is looking at the actual evidence and asking, "What does the evidence show?"

In other words for those who are on the "Poooooooooooooor St. Trayvon" side of the argument it is ALL about race, and the assumption that because Zimmerman IS NOT black that he has to be guilty of stalking "Poooooooooooor St. Trayvon" regardless of what the evidence seems to show. As well is the factor of media bias where the images presented in the major media (over and over and over again) are all several years old showing Trayvon as a 13 or 14 year old kid. That imagery stuck. The major lamestream media has focused on those photos as opposed to more recent ones showing "Poooooooooooor St. Trayvon" with his "Grillwork", his comments on smoking dope, his highly sexualized violent streak, and his search for the ingredients to make "lean". Lean is an important element here as it, per users comments online, tends to induce psychoses and violent behavior. Of course acknowledging that is inconvenient to the "Pooooooooooooooor St. Trayvon" Crowd so they attempt to ignore it or evade it by calling people rayciss for daring to notice those facts.

The other side is looking at the evidence, which includes "Poooooooooooooor St. Trayvon's known, and proven, drug use, his own online comments that he likes fighting, that he was trained as a Martial Artist, had a history of criminality such as being kicked out of school for picking fights, and having stolen property found in his locker at school. As well we have the eyewitness testimony placing "Pooooooooooooooooooor St. Trayvon" on top applying a serious beat down of George Zimmerman combined with the physical evidence of the beat down.

The "Poooooooooooooor St. Trayvon" crowd keeps trying to divert from the facts, invent facts and suppositions that are either not relevant or not in evidence (such as assuming and arguing contrary to the evidence that "Pooooooooor St. Trayvon who appeared to be casing the neighborhood actually was just walking nonchalantly down the street and assuming without any evidence to support the contention that Zimmerman initiated contact with "Poooooooooooor St. Trayvon, and appear to have reached a conclusion based on their own prejudices and suppositions rather than on the available facts).

It is unfortunate that the young MAN (he was a 5' 11" Football Player not a little defenseless child) made some poor judgements and, by the evidence, apparently made an unprovoked attack on an armed man. I would also point out to the "Poooooooooooooor St. Trayvon" crowd that "Billy the Kid" was 16 when he killed his first man. Billy, by the way, was white.

I did check and you are substantially correct. Per the autopsy (pdf here: media.cmgdigital.com/shar...rayvon.martin.autopsy.pdf ) he was 71 inches (5' 11", 158 pounds) and 158 pounds. Still not the size of a "child".

Trayvon Martin claimed in a text message to be a gangsta. We should take him at his word and see if that had any role in his death. Was Trayvon Martin a Gangsta? Trayvon Martin was a gangsta. How do we know? That’s a title he claimed for himself in a text message. Trayvon Martin fit the profile of a gangsta fairly well. A “gangsta” or perhaps “wannabe gangsta” in the case of Trayvon Martin is variously defined by the following factors, characteristics or criteria: Wannabe thug : Trayvon Martin talked about fighting in some of his last text messages and according to the evidence at the Zimmerman trial was acting like a thug on the night of his death, because he attacked George Zimmerman after Zimmerman lost sight of Trayvon Martin.

Age : At age 17, Martin had entered the age and gender cohort, with high testosterone levels, that commits a disproportionate share of the violent, theft and drug crimes in America. Zimmerman had reached age 28, the age at which the human brain on the average reaches maximum development, at the end of that same crime-prevalent cohort. Male Gender : Gangstas are young men. 93% of incarcerated prisoners in America are male. George Zimmerman was male, of course, and had demonstrated some of the same aggressive tendencies that ended up getting them both in trouble. Less Education : Martin had disciplinary problems in high school, was not an enthusiastic student, and was well on his way to being a high school dropout. At the time of his death, Trayvon Martin was serving his third school suspension, because they found a marijuana pipe and a bag with marijuana residue in it. Statistically, an African American male who drops out of high school has a 60% chance of winding up in prison.

Anti-Social : A screwdriver and ladies jewelry were found in Trayvon Martin’s back-pack by school authorities, suggesting he was involved in theft or burglary offenses. One of the most significant factors correlated with a lower crime rate is being married. Zimmerman was married and had a job; Trayvon Martin was unmarried, did not have a job and was suspended from school. Zimmerman was in communication with the police; previous to his death, Trayvon Martin complained about the police.

Gangs : Hangs around gangs. We do not know if Trayvon Martin was in a gang, but he had tattoos. Immediately before his death, Trayvon Martin’s mother kicked him out of her house and made him go live with his father. Neither parent was sure where he was the night of the shooting, nor did they file any missing person reports. They found out the next day.

African-American subculture : Trayvon Martin was an African American aspiring to or reaching the gangsta subculture. Places graffiti on buildings : This is one reason why Trayvon Martin was suspended from school on one occasion.
Uses and/or sells drugs : His text messages praised marijuana smoking and THC metabolites were found in his body during the autopsy.
Two of the items he purchased at the grocery store the night of his death were considered ingredients for Purple Drank, a dangerous concoction made with cough syrup, Arizona Tea and Skittles (or other candy). He was interested in codeine. Trace elements of other drugs were also found in the toxicological analysis.
A photo of a small potted marijuana plant was found on Trayvon Martin’s cell phone. Trayvon Martin may or may not have been smoking marijuana in his posted photographs. As stated above, one of his school suspensions was for having a marijuana pipe and a bag with marijuana residue in it.

Macho & “Bad” Image : Trayvon Martin referred to women by the “b” word and otherwise demonstrated a gangsta image. His Facebook and other internet photos showed someone shooting birds at the camera, not smiling, with his shirt off, smoking, and otherwise posing in the macho-man bad-ass role. Trayvon Martin appears to have acted in response to the status challenge of Zimmerman, a typical scenario for shootings and deaths involving young men.

Violent : Trayvon Martin’s cell phone texts revealed a history of fighting and a propensity for violence. The prosecution objected to the text messages and they were excluded. Martin admitted in a text message that he’s a “gangsta.” Martin’s older half-brother wanted Trayvon Martin to teach him, the older half-brother, how to fight. All the physical evidence shows that Martin was the aggressor, as does the account of George Zimmerman. Martin did not retreat to his father’s residence as he could have, but instead went back to look for trouble. Zimmerman of course should have stayed in his car. George Zimmerman’s nose and head showed signs of being struck by an enraged, physically developed Trayvon Martin.

Zimmerman was diagnosed with a closed fracture of his nose, two black eyes, lacerations to the back of his head, a minor back injury, and bruising in his upper lip and cheek. (Emphasis mine) Other than the bullet hole, Martin’s corpse only had a small abrasion on his left ring finger below the knuckle, the exact place where an injury would be on a fighting fist. By all accounts, there was fighting before the gunshot that killed Trayvon Martin. An escalating series of events characterizes most fist-fights and assaults and many homicides.

Absence of Religion : This absence runs like a thread through gangsta rap, gangsta culture and gangsta behavior. This is something the ministers who praise his character ought to consider.

Owns or admires weapons : Trayvon Martin articulated an interest in obtaining a gun. A picture of a gun was found on Trayvon Martin’s cell phone. According to Zimmerman, Trayvon Martin said he would use Zimmerman’s gun on Zimmerman. In one text message, when Trayvon Martin said he was a gangsta, his friend advised him not to take a bullet in his chest – and of course that’s exactly what ended up happening to Trayvon Martin.

Trayvon Martin did not have every characteristic of a gangsta, but he was well on his way at the time of his death. These gangsta leanings help explain his death, as do the actions of George Zimmerman. The escalating series of events on the night of this death, involving two aggressive young men, was unfortunately more typical of shooting deaths than Trayvon Martin’s cause celebre status suggests. The Zimmerman Trial generates debate about the social ills of our country. One thing is clear: The death of Trayvon Martin was about much more than mere skin color. The protestations of racism conceal deeper social problems we see clearly in the gangsta culture.

So, I would think the evidence is pretty clear IF people are willing to put aside their preconceptions, and prejudices, and simply look at the facts objectively and let them speak for themselves instead of emoting and assuming that "Pooooooooooooooor St. Trayvon" had to be innocent because the horrible "Rayciss" George Zimmerman (Who was Hispanic, black, and Jewish) just had to be as it is the "only" thing that 'splains how "Poooooooooooooor St. Trayvon" met his untimely end.

In still one more of her prosecution-friendly rulings in the second degree murder trial Florida v. George Zimmerman, Judge Debra Nelson ruled on Wednesday that the jury will not see the many texts and photos on Trayvon Martin’s phones dealing with guns and fighting.

The ruling followed a lengthy, televised presentation by phone expert Richard Connor Tuesday night on the contents of Martin’s phone. Although the jury was not present, the media were and have no excuse for not reporting what Connor revealed.

As the texts made clear, the Martin family attorneys knew what they were doing when they moved to seal Martin’s school records even before the story went public.

This exchange between Martin and a female friend on Nov. 21, 2011, three months before his death, spoke to where his life was heading.

After he told her he was “tired and sore” from a fight, she asked him why he fought. “Bae” is shorthand for “babe.”

MARTIN: Cause man dat nigga snitched on me

FRIEND: Bae y you always fightinqq man, you got suspended?

MARTIN: Naw we thumped afta skool in a duckd off spot

FRIEND: Ohh, Well Damee

MARTIN: I lost da 1st round :( but won da 2nd nd 3rd . . . .

FRIEND: Ohhh So It Wass 3 Rounds? Damn well at least yu wonn lol but yuu needa stop fighting bae Forreal

MARTIN: Nay im not done with fool….. he gone hav 2 see me again

FRIEND: Nooo… Stop, yuu waint gonn bee satisified till yuh suspended again, huh?

MARTIN: Naw but he aint breed nuff 4 me, only his nose

The fight followed the mixed martial arts (MMA) format. A day later, he would tell a friend that his opponent “got mo hits cause in da 1st round he had me on da ground nd I couldn’t do ntn.”

As his girlfriend complained, Martin was “always” fighting. He was also something of a sadist. His opponent, after all, did not bleed enough. Why might this be relevant?

Jonathan Good, the closest of the eyewitnesses to the shooting, testified last week that a there was a “black man in a black hoodie on top of either a white guy … or an Hispanic guy in a red sweater on the ground yelling out help,” and that black man on top was “throwing down blows on the guy MMA [mixed martial arts] style.”

On Nov. 22, the day after the MMA-style fight, Martin told a friend that his mother “just kicked me out” and that he had to move in with his father.

When the friend asked why, Martin answered, “Da police caught me outta skool.” Said the friend, “U a hoodlum.” “Naw,” said Martin. “I’m a gangsta.”

On Dec. 21, 2011, Martin told a friend, “dam I just got in trouble 4 sum sh** I aint even do.” His mother, Sybrina Fulton, was dismayed. “Pack up your clothes now,” she texted him.

On Dec. 22, Martin confided to a girlfriend, “I got in trouble.” She asked, “What did you do now.” As was typical, Martin took no responsibility. “I aint do ntn . . . . call me.”

On the day before Christmas, his mother texted Martin, “I’m concerned about u but I’m praying for u and I want U to pray for yourself EVERYDAY, ok.” She was texting the son she used to know.

On Jan. 6, 2012, Martin got into trouble at school again. When asked why, he told a friend, “Caus I was watcn a fight nd a teacher say I hit em.”

Said the friend, “Idk how u be getting in trouble an sh**.” By this time, Martin’s mother had thrown him out of the house for “fightn,” and he had moved in with his aunt and uncle.

The multiple texts about “weed” and the photos of marijuana plants confirmed Martin’s interests in drugs. On Feb. 21, five days before the shooting, “Weedhead” – as a friend called Martin – took the bus for Orlando to stay with his father’s girlfriend, Brandy Green.

Martin was free to travel because his school had suspended him again, this time for possession of marijuana and a pipe. The bust did little to sober him up.

“I hid m weed,” he confided to a girlfriend, afraid that he might have been searched before the trip. He texted later that day, “I got weed nd I get money Friday.”

The text and photos pointed to an even more dangerous new hobby, namely guns. Indeed, one of the photos of Trayvon Martin’s showed a hand, likely Martin’s own, on a pistol.

Guns excited him. “U got heat??” he enthused upon learning that a friend had access to a gun. On the bus trip to Orlando, Martin was negotiating to buy a handgun with a friend. “U wanna share a .380?” he asked.

Upon leaving Miami, Martin seemed to be growing angrier. On Feb. 21, he texted a girlfriend who was pouting about another girl, presumably in Sanford.

Wrote Martin, “f***z u cuz I neva text ha 2 day I made dat sh** up so u leav me df alone bout it.” Two days later, on Feb. 23, a friend tried to warn Martin off some behavior that troubled even the friend. “I ain’t ya parent,” he texted him, “but gsh** thro it away.”

Martin was not in the mood to be lectured to. “Y u gotta knock my hustle??” he shot back.

One of the more indicative messages revealed by Connor came from Martin’s younger half-brother, Demetrius Martin. Last seen in the media crying as he remembered his brother during a “March for Peace,” this message had Demetrius asking Martin when he was “going to teach me to fight.”

If Zimmerman is convicted, insiders think Nelson’s ruling so inappropriate that it will get the conviction overturned and perhaps even get the case dismissed.

Thanks for the ping, this damn bozo filter relieves of suffering through idiocy I used to endure.

I think I've said before that I did not follow the (show) trial but that does not mean that I didn't examine the available facts of the case. How many of these "conflicted" jurors would be in that state if they had been presented with the exculpatory evidence suppressed by the prosecution and the judge, or if the verdict had been different it seems this trial was bound to be overturned.

I did watch the video of the lovely Miss Dee Dee, and I've got to tell ya I do admire Poooooooooooooooooor Trayvon's taste in wimmen.

I also must admit to having the sympathy of a parent of a child for Poooooooooooooooooor Trayvon's parents until today when I learned of them concealing facts in the case. (although I did know the prosecutor had)

The "prosecution's" witnesses sealed the not guilty verdict. This was no accident. The prosecutor's were pissed off and wanted Zimmerman to walk because he hadn't committed a crime in the 1st place. The prosecution threw the case because they wanted to send the political race baiters a message. That message was "fucketh you" !
