Two Texas Troopers who are being sued in a federal civil rights lawsuit have filed a brief claiming 'harassment' and are seeking a protective order against the plaintiff, in order to avoid disclosing information in the discovery phase of the trial. The suit stems from a 2010 incident in which the troopers illegally demanded ID from the plaintiff under threat of arrest, with no probable cause. What's interesting is that when the incident actually occurred on the dark roadside in the middle of nowhere, Troopers menaced "I'm the one with the badge and the gun." But once called on their behavior in a court of law and in the public sphere, the troopers aren't as brave and bold anymore, instead absurdly claiming victimhood. Information sought from the troopers includes any prior complaints and lawsuits against the officers, as well as any training given by the ADL, government terrorism fusion centers, and related groups.[Article continues here.

When you file your Notice of Motion to Compel Defendants to Produce Documents, you might want to include in this Motion, in addition to those requests, all audio recordings from the date you were questioned by those troopers. If they recorded what they did that night to you, those recordings may be accessible and subpoenaed! Include that request in your lists of questions. Those recordings are very relevant to your Verified Complaint. What you want to prove to the court is that you are acting in good faith and just cause, in seeking a proper legal remedy, to demonstrate to the court, that the named Defendants, were not acting in good faith and that the recordings speaks volumes. It is one thing for them to be screening a trucker for possible drug cargo shipments, but it is also another when this is done to harass and intimidate an American citizen.

Name the title of your document Notice of Motion to Compel Defendants to Produce Requested Documents and Sanctions for Failure to Comply.

Just because Defendants filed a Protective Order does not mean you should remain quiet and give up. You have a Constitutional Right known as Due Process per the Fourth, Sixth and Fourteenth Amendments to the Constitution in consonance with the Texas Constitution. They are blocking your attempts to get this far. The fact that you have succeeded this far to Discovery has got them running scared. They do not like having to share information with non-members of the bar ANY information. You just keep at them!

In the event, they still insist on refusing to abide by your requests to produce documents, here is a sample form I found from the L.A. Federal District Court http://www.courts.ca.gov/documents/subp002.pdf . This subpoena would require their personal appearance as well as the production of all documents you requested. Since you are filing this matter E-Filings, you may want to inquire with the Federal Court clerk if this is the correct form. They may have a different one for E-Filers. Since your case originated from Texas but you are filing online and reside in CA, your case is of two matters: it is of a Federal Question (based on constitutional issues), and the other is Diversity of Citizenship Jurisdiction. Check with the clerk first!

I try as best I can. Artisan has done most of the writings. I am just guiding him through the entire process and input. If he elects to take this to the U.S. Supreme Court, well I'm not afraid of them either!
