MILLERSBURG, Ohio - A judge has ruled that a state dairy law prohibiting the sale of raw milk does not violate an Amish dairy farmer's religious beliefs and has ordered him not to sell unlabeled milk from his farm.

Arlie Stutzman, who owns a herd of 27 cows near Mount Hope, appeared in court June 30 to protest a law that he says violates his religious beliefs because it prohibits him from sharing milk he produces with others.

Holmes County Common Pleas Judge Thomas D. White wrote that Stutzman may give his unpasteurized milk away to people in need, but may not accept donations for it.

"Calling the compensation for milk a 'donation' is clearly a subterfuge to skirt the requirements of the law," White wrote in his decision issued Friday.

Stutzman lost his dairy license after an undercover agent from the Ohio Department of Agriculture gave him $2 for a gallon of milk last September. He was cited for selling milk in an unlabeled container. He got a new license in April.

Sales of raw milk are illegal in Ohio and 24 other states.

"We're pleased with the decision and it makes a lot of sense," said Melanie Wilt, spokeswoman for the agriculture department. "The judge understands Ohio's dairy laws are there to protect consumers."

Organizations such as the U.S. Food and Drug Administration say raw milk contains health risks because it has not been heated to kill bacteria, such as E. coli.

Groups such as the Weston A. Price Foundation, which advocate restoring nutrient-dense foods to people's diets, advocate the consumption of raw milk, saying pasteurization diminishes vitamin content and kills beneficial bacteria.

A phone message left for Stutzman was not immediately returned Wednesday. His attorney, Gary Cox, said he didn't know whether they would appeal the ruling.

"We disagree with it, but obviously Arlie has to comply with it," Cox said.

Stutzman's Amish faith places an emphasis on the community. To preserve their lifestyle, the Amish avoid the use of electricity and automobile ownership. They typically don't get involved in politics.

White wrote that state dairy law does not violate Stutzman's First Amendment rights because he "produced no evidence that his religion compels him to make money from feeding the hungry." He also rejected Stutzman's argument that he had been entrapped.

White's ruling that Stutzman may give away his milk seems to conflict with state law, which prohibits the distribution of raw milk, regardless of whether it's sold.

Cox said he would ask the judge for a clarification.

I'm for raw milk and drank it when I had the ranch. HOWEVER, with this Amish gentleman not using electricity, I wouldn't be buying from him. I believe milk needs to be refrigerated ASAP.......and milk is fairly warm when it comes out of the cow.

I used glass jars and had a separate refrigerator to handly the 6 to 8 gallons a day Bess gave us.

Bullshit!

The only reason milk is pastuerized is to give lazy farmers a break. A clean dairy parlor and clean cows is paramount to clean raw milk.

I've seen Mennonite dairy barns that were so clean you could eat off the floor. And I've seen other farmers with dairy barns so filthy I would never drink the milk from their cows.

Now with what is called ultra-pastuerization, a process that shoots a stream of steam thru the milk or cream, it literally removes all of the nutritional value from the product. It is really turned into a poisonous substance.

They better appeal. And the Amish should fire that shyster. The Amish cannot be regulated for selling his milk privately, only for what he sells to the commercial dairy.

The raw milk laws only apply to the commercial dairy operations that market the end product.

BTW, someone needs to catch that agent who entrapped the Amish and give him a good beating with a ball bat.

That damned license is what got him in this mess to start with. When you get a license for ANYTHING, you are entering into a contract with the party issuing the license and agree to be bound to ALL provisions of the issuer.

In this case he gave up his God given RIGHT to own dairy cows, and barter with the goods produced from the fruits of his labor; and instead accepted the "privelege" of having a dairy farm and abiding by all the rules and regulations set forth by the Department of Agriculture..

The legal definition of a license is "Permission granted to do something which would otherwise be illegal, a tort, or a trespass". Being Amish, it surprises me that he would ever even CONSIDER that there could be anything illegal about the God given right to produce food that he would need to "obtain permission - AKA get a license" to enjoy his right!

That is why I don't have any licenses. I have a God given right to travel, there is nothing illegal about travelling, so why have a driver's license? Because I want to subject myself to the Transportation Code? Without a DL I haven't agreed to the terms of that Code - and they can't enforce it on me. Ditto for marriage, hunting, or any of the myriad of other "illegal" things that most of us get a "license" to do.. And because of this I have fared much better in court than most........

If it hadn't been for that license, I don't think they could have prosecuted him very easily.

If you guys want to use it to expound on the virtues of living license free, I can get you set up with author privileges and it can serve as a clearinghouse for information on license free living.

I'll find a nicer template and get it all set up and ready to roll tomorrow. It's a WordPress blog. It's pretty easy to use, and can be made to look real spiffy. :)

Till you get pulled over by the cops, who are( unfourtunely necessary). The criminals cost the system $$$$$, so they are usually not too impelled to do much about that, but a citzen with a JOB and some $$$$, He's a meal ticket.

You have to sue them to stop it. Once you sue them 2 or 3 times they will leave you alone. It will cost them a whole lot more than it costs you. And freedom isn't free, so you have to ante up or fall in line with all the other slaves. Don't want to go to jail? Then get your license and shut up!

See Henry v Shasta County for an recent example. Henry is a doctor and only lost because the shyster screwed up on the time for filings. He really won the case. This one is bigger than the older McLaughlin v Riverside case.

They have no authority over your private property, unless you give the property to them by registration. The license works much the same way.

I can devote some time to it, but it is tough right now with no income over here and lots of chores.

This is bigger than you might think. There is a BIG group in California and it is spreading. There is also a group out of Delaware with participants all over the country. The California group is based on Common Law and the other is based on commercial aspects and getting yourself disconnected from the system.

It all boils down to the same thing for the most part and they are covering much of the same material. It is an issue of public vs private.

I have to go out and weed the corn patch before it gets hot. Talk later.

The Amish cannot be regulated for selling his milk privately, only for what he sells to the commercial dairy.

The Federal Reserve Note specifically states that it is legal tender for all debts public and "PRIVATE" ... the licenses, permits and other implicit regulations may be imposed based upon the location of the farm and who REALLY OWNS IT too.

Many of the former counties, were once named for example Harris County. Today that County may be named in its corporate status as the County of Harris. If this farmer lives in the corporate county (resides or resident) he may fall under the corporate jurisdiction of the COUNTY.

The thugs have implemented an all encompassing jurisdictional fraud that is sometimes nearly invisible, and most of us have joined it through the County Clerk's Office and by recording deeds in THE COUNTY OF XXX.

The virtues REALLY start when you formally expatriate. This is done by getting out of the Social(ist) Security system. For more info on this check out this site: http://www.buildfreedom.com/tl/tl17b.shtml But suffice it to say that you couldn't pay federal income taxes if you WANTED to without that damned SS#! That number is what makes you an American Citizen as oppposed to a state sovereign. It is what makes you a slave to government instead of a free individual. Here is something interesting from Scripture - in Luke 22:25 we see "And he said unto them, The kings of the Gentiles exercise lordship over them; and they that exercise authority upon them are called benefactors." Mind you, this is the words of the Messiah. Now if you look at the SS system, the government is called the benefactor, and YOU are the beneficiary! Scripture goes on to say in verse 26 "But ye shall not be so"...... Something to think about!!

Noone222 can inform you much better than I can about how this whole scheme has been implemented in such a clever way that there are MANY bases to cover to totally remove yourself from the system.

You should listen to some of his programs, and for the purposes of this thread a good one to start with is Retirement at Risk. One thing is for sure - if you DO decide to get out of the system, you will have to learn enough about law to be able to handle yourself in court. That is where Gordon's school would be so valuable. You may also be able to find someone that is COMPETENT at dealing with law for guidance, BUT you'll still have to do it yourself for the most part.

There are many deceptions in the system, and it's not hard to learn the whats and hows of it. For example if you look at your driver's license you'll notice that your name is in all caps. What that is the CORPORATION named xxxxxxxx, NOT the PERSON named xxxxxxxx.. And when you go to court, and they call your name, you are answering on behalf of the CORPORATION!!!! See what I mean by they are sneaky? Like I said, there is quite a bit of stuff to cover.

I'm sure it would. But the BEST thing would be Gordon's school. He HAS gotten entirely out of the system, and can guide people to do it in a totally legal way. In fact, he strongly advocates NEVER breaking the law. He'll tell you that it doesn't do any good at all to be sitting behind bars. Now that's not to say he hasn't been behind bars. In one of his programs he was telling about spending something like 2 weeks in jail over contempt of court.. But he refused to bail out, never changed his position that earned him the contempt in the first place, and eventually won out. (It was actually a pretty funny story - the contempt was over taking the oath to tell the truth in court! When he was asked if he swore to tell the truth, the whole truth... He answered NO! I believe that story is in his series Scriptural View on Christianity - August 2005, a MUST hear for TRUTH seekers!) He bases it on Scripture in that the Messiah told us to never swear to anything. This left him in a position to sue under a title 42 section 1983 for wrongful imprisonment, which he won and made them pay a rather hefty sum IN GOLD!!!! HAHAHAHAHA

He truly is one sharp cookie. He has been in something like 68 court cases going all the way to the Supreme Court, and has close to a 90% win record. His wife has been in 17 cases herself, and has won them all! And he claims that his students have a 90% win record in court, and it would be higher than that but the ones that lose their case go against his advice and hire an attorney to represent them..... Give him a listen, I think you'll be glad you did. I heard Alex Jones a couple of months ago say that he was a big fan of Gordon, and thought Gordon was dead on the money..
