BRAINSTORM: Driving Without A License Defense Help Post Date: 2009-03-01 17:25:19 by Old Friend

Ok here is the deal. I got busted back in November I guess for driving without a license. I'm due back in court Tuesday. This is my eleventh time by my count. I want to beat this and I have in the past. In the past I have used driving as a right defense. I may use that defense at a later point but not now. My focus right now is that they violated my right to a speedy trial. You see one of the clerks told me to sign this paper signing away my right to a speedy trial. They also said if I didn't I wouldn't be able to get a public defender. Not that I want a public defender. I have already filed a motion to have the case dismissed on speedy trial grounds. The judge at my pre trial ...

2 COPS PROBED IN RAPE By BRAD HAMILTON and REUVEN BLAU Last updated: 3:20 am March 1, 2009 Posted: 3:00 am March 1, 2009 An NYPD patrolman has been accused of raping an intoxicated female executive after the cop and his partner responded to a 911 call from her cabdriver, who said she needed help getting up to her apartment. The officers raced to the aid of the woman, who had vomited and was disoriented during the ride home to her East Village apartment on Dec. 7. They got her safely in the door and later returned to check on her condition, two law-enforcement sources familiar with the investigation said. But when they came back a second time, the older of the two cops allegedly ...

For CCSU student John Wahlberg, a class presentation on campus violence turned into a confrontation with the campus police due to a complaint by the professor. On October 3, 2008, Wahlberg and two other classmates prepared to give an oral presentation for a Communication 140 class that was required to discuss a relevant issue in the media. Wahlberg and his group chose to discuss school violence due to recent events such as the Virginia Tech shootings that occurred in 2007. Shortly after his professor, Paula Anderson, filed a complaint with the CCSU Police against her student. During the presentation Wahlberg made the point that if students were permitted to conceal carry guns ...

Rule by fear or rule by law? Lewis Seiler,Dan HamburgMonday, February 4, 2008 "The power of the Executive to cast a man into prison without formulating any charge known to the law, and particularly to deny him the judgment of his peers, is in the highest degree odious and is the foundation of all totalitarian government whether Nazi or Communist." - Winston Churchill, Nov. 21, 1943 Since 9/11, and seemingly without the notice of most Americans, the federal government has assumed the authority to institute martial law, arrest a wide swath of dissidents (citizen and noncitizen alike), and detain people without legal or constitutional recourse in ...

A video showing a King County Sheriff's deputy pummeling a 15-year-old girl in a holding cell was released Friday over the strenuous objections of the officer's attorney. The case goes beyond police misconduct, County Prosecutor Dan Satterberg said in a prepared statement. "It's about criminal misconduct. And that's why he needs to be prosecuted," he said. The video of the Nov. 29 incident was disclosed Friday, one day after Deputy Paul Schene, 31, pleaded not guilty to misdemeanor assault in King County District Court. Schene, an eight-year veteran, works out of Precinct 4, which covers SeaTac, Burien and high crime areas in White Center and Skyway. He is ...

(02-27) 08:22 PST Omaha, Neb. (AP) -- The Nebraska Supreme Court has upheld the firing of a State Patrol trooper with ties to the Ku Klux Klan. Justice John Gerrard wrote in the opinion released Friday that Robert Henderson voluntarily associated with an organization that uses violence and terror to oppose the state's founding principles of equality and tolerance. Henderson, a trooper for 18 years, was dismissed in 2006 after the patrol discovered he had joined a racist group. An arbitrator said Henderson was wrongly fired, but a judge overturned that decision. Henderson's attorney, Vincent Valentino, argued to the high court that arbitrators, not judges, have the final say.

As my grandfather was fond of saying: "its time to fish or cut bait." As predicted here, the Obama administration intends to put a new Assault Weapons Ban (AWB) on the fast track. Those of us who believe in the Constitution of the United States and our inherent right to protect ourselves, our families, and our property, will soon be forced to choose between our beliefs and support for a corrupt, liberty destroying government. In short, in their eyes, we will become criminals. Attorney General and race-baiter Eric Holder erroneously believes a new AWB would stop the flow of guns into the hands of drug smugglers in Mexico. If he cant, with all the power of the state, ...
Pelosi Throws Cold Water On Weapons Ban Post Date: 2009-02-26 15:54:25 by Brian S

House Speaker Nancy Pelosi tossed cold water on the prospect of reinstating the assault weapons ban, highlighting Democrats reluctance to take on gun issues. Attorney General Eric Holder raised the prospect Wednesday that the administration would push to bring back the ban. But Pelosi (D-Calif.) indicated on Thursday that he never talked to her. The Speaker gave a flat no when asked if she had talked to administration officials about the ban. On that score, I think we need to enforce the laws we have right now, Pelosi said at her weekly news conference. I think it's clear the Bush administration didnt do that. Outside of the dig at the ...

DENVER A good Samaritan who helped push three people out of the path of a pickup truck before being struck and injured has gotten a strange reward for his good deed: A jaywalking ticket. Family members said 58-year-old bus driver Jim Moffett and another man were helping two elderly women cross a busy Denver street in a snowstorm when he was hit Friday night. Moffett suffered bleeding in the brain, broken bones, a dislocated shoulder and a possible ruptured spleen. He was in serious but stable condition Wednesday. The Colorado State Patrol issued the citation. Trooper Ryan Sullivan said that despite Moffett's intentions, jaywalking contributed to the accident. Moffett had ...

At first, it was a painting of game fish on an exterior wall of a Florida bait and tackle shop that drew adverse attention from sign code enforcement officials of the city of Clearwater, who said it violates a ban on a business displaying a depiction of the product it sells. But, when by the city ordered the Complete Angler to paint over it, the shop instead covered it with a banner providing the text of the First Amendment of the U.S. Constitutionand was cited over the banner, too, reports the St. Petersburg Times. Already facing $700 in fines, owner Herb Quintero says he's been told the ante will soon be upped to $500 a day. Now the American Civil Liberties Union has joined ...

Does Alabama Have "A Republican Form Of Government"? Can Western Civilization Be Preserved? By Hugh McInnish The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion... Constitution of the United States, Article IV, Section 4. What kind of government does my state, Alabama, have? This is a question that has darted into my head unbidden at odd moments when I was momentarily crisis-free and had nothing urgently demanding my attention. In particular I have wondered if I and my fellow Alabamians truly live in a "Republic"as guaranteed by the Constitution. The answer never came, ...

The Government's War on Recession Post Date: 2009-02-26 06:51:59 by Ada

The great failing of the Obama administration is that it is packed with people who show no apparent knowledge of the essential truths of liberal theory. That theory, which is the core of the American political contribution and the driving force of modernity itself, is that freedom is the foundation of and the reason for social and economic flourishing. All evidence suggests they know nothing of this. Obamites, in contrast, hold the opposite view, the one advanced by the Pharaohs and Emperors of old all the way through the Talibans and Hugo Chavezes of our own time. It is the view that nothing is beyond the competence of the state and its great leader. Particularly in economic affairs, ...

By BRETT BARROUQUERE 59 minutes ago LOUISVILLE, Ky. (AP) Former western Kentucky landowners and their families are not entitled to compensation for property taken by the U.S. government to build a military camp at the start of World War II, a federal court said in 2-1 ruling Wednesday, ending a 15-year legal battle in the case. Landowners and their families claim the government promised to sell back farmland taken for Camp Breckinridge near Henderson, Ky., after the war in the 1940s, but later sold it and mineral rights without paying them. The federal government asked the court to deny the claim, saying the time to seek compensation had long passed. The U.S. Court of ...

WASHINGTON (JTA) -- The economic stimulus bill enacted by President Obama will provide $1 billion to Jewish nursing homes and social service agencies, according to the United Jewish Communities. The funds come from the $87 billion that the legislation allots for state Medicaid programs as a result of an increase in the Federal Medical Assistance Percentage, or FMAP. An increase in FMAP was a top priority for UJC, the Jewish Council for Public Affairs, the Religious Action Center of Reform Judaism and other Jewish groups that lobbied for passage of the $787 billion bill signed Tuesday by Obama. The federation system receives about 1.4 percent of total Medicaid funds, so it will get more ...

By Associated Press 11:34 AM EST, February 24, 2009 WASHINGTON (AP) The Supreme Court on Tuesday upheld the conviction of a West Virginia man for violating a federal law barring people convicted in domestic violence cases from possessing firearms. In a 7-2 vote, the court ruled that a federal appeals court in Richmond, Va., wrongly threw out the conviction of Randy Edward Hayes. Justice Ruth Bader Ginsburg wrote the majority opinion. Chief Justice John Roberts and Justice Antonin Scalia dissented. The federal government, gun control groups and women's rights advocates worried that a ruling for Hayes would have weakened the federal law enacted in 1996 that applied the 40 ...
