The Supreme Court won't hear another challenge to California's decade-old law permitting marijuana use for medical purposes.

The high court on Monday refused to hear appeals from San Diego and San Bernardino counties, which say the justices have never directly ruled on whether California's law trumps the federal controlled substances laws.

Supporters say marijuana helps chronically ill patients relieve pain. Critics say the drug has no medical benefit and all use should be illegal.

San Diego supervisors had sued to overturn the state law after it was approved by voters in 1996, but lower courts have ruled against them.

San Diego and San Bernardino counties argued that issuing identification cards to eligible users, as required by the 1996 state law, would violate federal law, which does not recognize the state measure.

A state appeals court ruled that ID card laws "do not pose a significant impediment" to the federal Controlled Substances Act because that law is designed to "combat recreational drug use, not to regulate a state's medical practices."

The cases are County of San Bernardino v. California, 08-897 and County of San Diego v. San Diego NORML, 08-887.

WASHINGTON (Dow Jones)--Former Hollinger International Inc. executive Conrad Black, serving a 6 1/2 year financial fraud sentence, on Monday won a chance at the Supreme Court to overturn his conviction.

The high court accepted Black's appeal without comment and will hear oral arguments in the case next fall. Black asked the Supreme Court to throw out his 2007 conviction for fraudulently skimming millions of dollars from the company.

Black is a former Hollinger chairman. Two other former company executives joined in the Supreme Court appeal, arguing that jury instructions during their trial were seriously flawed.

Black is serving his sentence at a federal jail in Florida. He was convicted on three counts of mail fraud and one count of obstruction of justice, though he was acquitted on nine other counts.

The media mogul built Hollinger into what once was the world's third-largest newspaper company. At one time it operated more than 300 newspapers, including the Daily Telegraph in London, the Jerusalem Post in Israel, the Chicago Sun-Times and Canada's National Post.

The company is now much smaller and operates under the name Sun-Times Media Group Inc.

The case is Black v. U.S., 08-876. A decision is expected by July, 2010.

Medical marijuana is a danger to society, unlike Conrad Black who is going to receive a Supreme Court review.

Just shows the law of unintended consequences.

The original anti-marijuana laws were aimed at Mexican immigrants, but while the gov't has given up that fight, the drug laws have turned into a Frankenstein's monster.
