I like Naomi, but from what my experience is the feds can thrown anyone in the can for three days for no reason whatsoever before the legal system can be made to have any effect.

If you are declared to be an enemy combatant, you have no lawyer except the one they give you. You can be held indefinitely even if you are found not guilty at trial. Thus is under the Military Commissions Act of 2006 which as Naomi said Obama did not repeal.
