Commissioners eye voting rights for non-citizens

July 23, 2009

PORTLAND — Several members of the city's Charter Commission want to grant non-U.S. citizens the right to vote in city elections.

It's unclear whether Portland can do this on its own, though, or whether it would have to convince the Legislature to amend state law, an unlikely prospect.

Still, that hasn't stopped some commissioners from pushing the idea forward.

Commissioner Anna Tevarrow, who campaigned on the issue, said that attaining citizenship is a difficult process that can take years. In the meantime, it's only fair to grant voting rights to legal residents who are paying taxes, receiving city services and have children enrolled in the public schools, she said.

"It seems voting would be a natural step to allow immigrants to participate in civic life," she said.

Commissioner Ben Chipman supports the proposal, noting that any measure that increases voter participation is a good thing.

Commissioner Thomas Valleau said he likes the idea in concept. He said immigrants should have some say in how their children are educated and in the delivery of city services

"Currently, they have taxation without representation," he said.

Other commissioners, though, including Jim Cohen and Richard Ranaghan Jr., say the issue would distract the commission from its primary job, which is examining the structure of city government.

Commissioner Nathan Smith said he's open to learning more about the issue but is skeptical. He said the city should put its effort into creating a system that encourages immigrants to become citizens.

"I just think that one of the hallmarks of citizenship is the franchise, the right to vote," he said. "It's an important achievement and privilege. In many ways, it's an incentive for citizenship."

At its July 30 meeting, the commission will begin deciding which topics it will focus on as it develops a proposal to submit to voters in November 2010. The issue of expanding voting rights to non-citizens is in the mix.

Nationally, there are a few communities that give non-U.S. citizens the right to vote in municipal elections, including six municipalities in Maryland. In Chicago, non-citizens can vote in school board elections.

In New York City, non-citizens voted in elections for community school boards until 2003, when a restructuring of the school system eliminated the boards.

In Massachusetts, the municipalities of Amherst, Cambridge and Newton all passed local ordinances allowing non-citizens to vote. However, the ordinances cannot go into effect unless the Massachusetts Legislature amends state law.

That might be the case in Maine as well. Whether a municipality can grant non-citizens voting rights is a complex legal issue that has never been conclusively settled, according to Julie Flynn, a deputy secretary of state who oversees the Bureau of Corporations, Elections, and Commissions.

During the last legislative session, Sen. Justin Alfond, D-Portland, submitted a bill intended to open the door to voting by non-citizens in municipal elections. Republicans were united against the bill, and many Democrats opposed it as well. The Senate rejected it in a 33-2 vote.

In an interview Wednesday, Alfond said he's unsure whether Portland can allow non-citizens to vote simply by amending the city charter. But he said it's a proper issue for the Charter Commission to pursue.

"It's very appropriate for the city to of Portland and the commission to be looking at how we engage new Americans," he said. "New Mainers are integral to the city's success, and it's incredibly important for the discussion to be happening."

Ranaghan said it doesn't seem right to have two different voting eligibility standards, one for local elections and another for state and federal elections.

At a brainstorming session at a recent commission meeting, the voting issue was just one of many that was discussed.

"We...will thrash that idea with the rest," he said, "and see if we can reach the point where we will get consensus."

More foreign insertion of their culture into our political system.

And people wonder why we no longer are a Constitutional Republic.

Yeah, give the illegal aliens a chance to vote for Tweedledumb and/or his ideological twin, Tweedledumber. The "right to vote" has not been a particularly good thing for actual citizens as witnessed by almost every election in the last century, at least the (s)election for president.

Of course I am not serious about giving illegal aliens the right to vote or any right other than the right to be deported as soon as they are caught here illegally. And with a stern warning that the next time they are caught here without having gone through proper channels, as we have to do when entering a foreign country, there will be consequences and repercussions.

Liberty is not a means to a higher political end. It is itself the highest political end.

It's intentional and both wings of the National party are guilty. It's easy enough to know the WHY it's being done, but WHO benefits?

Geo. Carlin ... RIP

Resolve to serve no more, and you are at once freed. I do not ask that you place hands upon the tyrant to topple him over, but simply that you support him no longer; then you will behold him, like a great Colossus whose pedestal has been pulled away, fall of his own weight and break in pieces.

They want to steal from us taxpayers. How about we grab the thieves put a noose around their neck and hang them. Anna Tevarrow needs shit wiped on her face. Cat shit.

Carlin will be missed.

I'll roll out his famous "Why you shouldn't vote" in late October.

Classic stuff.

Hanging works.

I was just kidding. But they need to be rounded up and removed by force. It would be nice if we could just let them come across the border as tourists for a couple of days then go back home. But they come and stay and breed, then they want to tell us what to do and demand benefits from our people.
