A U.S. district court judge expressed “outrage” over the Justice Department’s admission that it does not have enough evidence to continue the detention of a teenager as an “enemy combatant” in Guantanamo Bay. Judge Ellen Segal Huvelle said in a ruling Friday that the case against Mohammed Jawad is “gutted” because Jawad allegedly confessed under torture by Afghan officials that he had thrown a grenade at U.S. troops, according to a report by McClatchy Newspapers. Jawad was just 12 at the time, according to his lawyers, though the Pentagon says he was 16 or 17. “Without his statements, I don’t understand your case,” the judge said, according to reporter Marisa Taylor. “Sir, the facts can only get smaller, not bigger. . . . Face it, this case is in trouble. . . . Seven years and this case is riddled with holes.” “She then urged the lawyers to ‘let him out. Send him back to Afghanistan,’” the article continued. Justice Department lawyers asked to delay Jawad’s release so the case may be reviewed, and Attorney General Eric Holder reportedly called for the case to be “expedited.” The administration also said it would seek to transfer Jawad into the U.S. for a criminal trial in federal court. “In light of the multiple eyewitness accounts that were not previously available for inclusion in the record — including videotaped interviews — as well as third-party statements,” the government has decided to prosecute the case, the documents said. But the documents reviewed by AFP said Jawad would not be immediately transferred to the United States. Tanzanian national Ahmed Khalfan Ghailani, who was transferred to the United States on June 9, became the first Guantanamo Bay detainee to be sent to a US court for a civilian trial. His case is proceeding in a New York court.

Someone remind me again just who is the rogue nation? God forgive us. And deliver us from these insane, illegal bastards.
Seven years in Guantanamo without even being charged, let alone tried, let alone allowed to have any counsel. This is the REAL legacy of the loathsome George W. Bush administration. I humbly suggest that everyone should keep a short list of the most egregious crimes committed by that despicable administration handy in their pocket, so that whenever some misguided pro- Republican shill starts talking about how wonderful the GOP is, and how dedicated they are to "freedom" and "defending our nation", then you can just reach into your pocket, pull out the list of the horrific crimes against our nation, our Constitution, and humanity that were committed by the George W. Bush administration, and begin reading it to the poor, misguided imbecile. Be sure to communicate just exactly how you feel about the unrelenting criminality and the wholesale destruction of American values and America's image that was done during the horrifyingly bleak years of George W. Bush's term. Be sure to explain exactly how you feel about the unrelenting campaign of lies and the systemic corruption and the utter rapaciousness of that administration and their corporate cronies. Then cap it off by explaining just how you feel about the damage done not only to our Constitution, our nation, our entire concept of "rule of law", and then last but not least, the utter evisceration of our economy. Then politely inform them that you would sooner eat a worm than ever vote for any Republican for any office of any kind ever again. And no, I don't think the Democrats are any better. But the Republican party is on the ropes now, and if we really bear down hard and really focus on the destruction of that party, there's a decent chance that it could actually crumble and go the way of the Whigs. Then, who knows, perhaps a new party could step into the vacuum created by the demise of the loathsome G.O.P. Maybe even a party that actually is able to read and understand the Constitution. God knows that's something far beyond the ability of any of the members of the current Tweedledee and Tweedledum parties.
