BOISE, Idaho - When police officer Darryll Dowell is on patrol in the southwestern Idaho city of Nampa, he'll pull up at a stoplight and usually start casing the vehicle. Nowadays, his eyes will also focus on the driver's arms, as he tries to search for a plump, bouncy vein. "I was looking at people's arms and hands, thinking, 'I could draw from that,'" Dowell said. It's all part of training he and a select cadre of officers in Idaho and Texas have received in recent months to draw blood from those suspected of drunken or drugged driving. The federal program's aim is to determine if blood draws by cops can be an effective tool against drunk drivers and aid in their prosecution. If the results seem promising after a year or two, the National Highway Traffic Safety Administration will encourage police nationwide to undergo similar training. For years, defense attorneys in Idaho advised clients to always refuse breath tests, Ada County Deputy Prosecutor Christine Starr said. When the state toughened the penalties for refusing the tests a few years ago, the problem lessened, but it's still the main reason that drunk driving cases go to trial in the Boise region, Starr said. Idaho had a 20 percent breath test refusal rate in 2005, compared with 22 percent nationally, according to an NHTSA study. Starr hopes the new system will cut down on the number of drunken driving trials. Officers can't hold down a suspect and force them to breath into a tube, she noted, but they can forcefully take blood — a practice that's been upheld by Idaho's Supreme Court and the U.S. Supreme Court. The nation's highest court ruled in 1966 that police could have blood tests forcibly done on a drunk driving suspect without a warrant, as long as the draw was based on a reasonable suspicion that a suspect was intoxicated, that it was done after an arrest and carried out in a medically approved manner.

Why waste time using a taser or venipuncture.? Just make it legal for the cops shoot the suspected beer drinker, and bottle a blood sample.

You agree with the taking of blood by an officer on the spot? BTW, what would prevent a DNA sample database being surreptitiously created? Suspect a person driving drunk (or use that as an excuse), now their DNA is in a national database. There is not a thing you could do to prevent that if this become the norm across the USA.

When I started ptactice in 1987, we did urine drug testing in our office and made money off it. My partners could see nothing wrong with it, but I felt we were opening a dangerous door. In theory, police need a warrent to search our homes and cars, but this gave employers the right to search our bodies with impunity. We stopped urine drug testing due to my research into our legal liabilities. Nobody seemed to realize that naturally police,government, and employers would want ever increasing body invasion rights. Venipuncture opens new problems: 1) The puncturee must cooperate and hold still as it's too easy to miss or damage a vein. So does the cop arrest those who wiggle or pull away. Some people just can't seem to ever be able to hold still. 2) How does the cop handle those who pass out? Arrest them..let them fall and watch them get a head injury.. some people seize after fainting, so do they go to the hospital after? 3) Venipuncture is a medical proceedure with potential complications such as nerve or arterial damage. Cops tend to get rough. I think they should have malpractice insurance.
I'm glad I don't have ropey veins so at least I'm not his preferred target. Just what we need...... a fumble fingered cop trying to draw blood. I don't think he mentioned using a tourniquet, a feeling I'm sure most drunks also won't stay still for. But I'm sure some enterprising outfit will come up with a portable machine similiar to those Accuchecks that can analyze just a drop of blood from a finger prick for ETOH.

BTW, what would prevent a DNA sample database being surreptitiously created? Suspect a person driving drunk (or use that as an excuse), now their DNA is in a national database. There is not a thing you could do to prevent that if this become the norm across the USA. Since there are already various databases that store information about everything but DNA, what is so frightening about a DNA database? People need to accept that this is the information age and unless you drop out of the system entirely you cannot escape being in somebody's database. The biggest problem with databases has been identity theft not government oppression.
