TRENTON, N.J. — Three teenagers who say they were tossed from a New Jersey ballpark for sitting through the song "God Bless America" are suing the minor league Newark Bears.

The boys say their constitutional rights were violated when they were asked to leave Newark's Bears and Eagles Riverfront Stadium in June by Bear's president co-owner Thomas Cetnar.

Cetnar confirms the boys were asked to leave but declined to elaborate.

The boys — Millburn High seniors Bryce Gadye (gah-DEE') and Nilkumar (NIHL-koo-mahr) Patel, both 17, and junior Shaan (shahn) Mohammad Khan, 16 — sued in federal court Friday seeking unspecified damages.

They say when they told Cetnar they had the right to remain seated, he cursed and had two security officers remove them from their seats behind home plate. Subscribe to *Jack-Booted Thugs*

They should get a refund of ticket costs, and any expenses they sunk into going to the game, and a modest, but not extreme punitive damages. Maybe 20 thousand dollars or so. Enough so this ballclub doesn't pull this shit again.

It isn't even about the right to sit during a stupid psuedopatriotic song. Its about following through on a contract. These men bought tickets, with no condition that they had to stand for a song. The ballclub cannot change the rules once they get there.

I'll agree with you. There is nothing in the Constitution that requires people to pledge allegiance, or take any particular oath absent giving testimony or assuming office, nor is there anything in there that requires us to sing a song.

Hell, you may be a foreign national at a ball game. Should you be asked to sing an anthem or national song? Would you consent to the requirement to sing the Kenyan or Russian anthem while abroad? I don't think so. I even think that this is a stretch for American citizens at home. Singing or pledging along is a customary requirement and not a statutory one.

As to the issue of private property, I'll let you mugs decide. Suppose you come into my restaurant, but I won't serve you until you say the Pledge of Allegiance. Am I within my rights?

If you own the property, yes, you can refuse service at will and at your discretion.

On the other hand, if it was a habitual thing, you'd either be forced out of business as people refused to patronize your restaurant, or you'd get a lot of people show up who like to recite socialist pledges for no apparent reason other than the demands of others. Either way, seems ok, as long as you get the call as the property owner and they get the call to flip you the bird and walk out as customers.
