KENSINGTON, Md. - Public parks are usually the places where children go to have fun. But the town of Kensington just passed a new rule that bans kids over five years old from playgrounds during the daytime.

"It's like a sad children's story," said Joe McPherson, headmaster of the Brookewood School.

But it's no fable. The girls at Kensington's Brookewood School are banned from using a public park right across the street for recess

"I don't think it's really fair because we're part of the community too and we want to play in the park," said Jill Collins, a fifth-grade student.

The town council unanimously passed a resolution this week saying only caretakers with children five years old and younger can be in Reinhardt Park from 9 a.m. until 4 p.m. Monday through Friday.

Since that resolution passed, Brookewood students have gone elsewhere for recess. "We like to use the park because it's big and we like to run around and play games," said Basia Syski, a fifth-grade student.

The town manager says students using the park for recess created maintenance issues and damage. The town council asked the school to pay $4,000 a year to help with upkeep but never heard back.

"Do a clean through trash pickup, lay mulch around the swings -- we could do that," said McPherson. "But pay $4,000? We just don't have it. We just don't have it in our budget."

Brookewood's headmaster tells ABC 7 News it's a public park for all too use but Kensington's mayor disagrees. By phone he said the park is for taxpaying citizens -- not abuse by a private non-profit school.

Tracy Wagner brings her toddler to the park -- a park she describes as rarely used.

"Really is it that big of a deal to put some more mulch down? I don't know. That's my personal opinion. It's for the kids. The kids are using it," she said.

The girls at Brookewood say they brought life to the park, a park they now watch sit empty. "I think it's silly that we can't use it," said Syski. Subscribe to *libertarians*

They are on shaky ground here blaming the school for being a vehicle by which children are brought together like they planned these offspring of taxpayers to do bad things to the city. Hey, it's either a public park or not, they have no gray area to work in as they pretend they do with this law.

Including your own? Why is your information something you would not want others to give out, but it is OK to give out information with zero constraints to whether it is ethical or not?

Perhaps being dunned at home would hurt the effort to resolve this issue. So I fail to see the value of giving this guy's home phone number out.

Well, that should become obvious over time in the context of normal posting on this forum.

Suffice it to say I like Barack Obama as a human being, and I have hopes that his Administration will be successful.

I know it will hurt the chance of this being so if the Israeli problem is not addressed instead of being ignored or facilitated, so take that as an example why my personal feelings of the President and his administration is not a black or white issue.

And black or white is how I sense your deflective question here on that topic is how you want things to be kept. In fact things in life seldom are.

I come from a very liberal, yellow dog Democrat, and Catholic background. And this of course colors my thinking. That I think is actually what it is you are asking when you query me concerning Obama. Actually, free speech works because one is responsible for it. Which means that Constitutionally they can't shut you up, but they are within Constitutional purview to make you pay for your words, or even go after the vehicle you use to express yourself with.

Fair use as a principle is very First Amendment and must be protected. If authorities determine that an entity is using fair use to spread private information meant to harm or discomfort them in the context of their personal lives, they are not shielded by the First Amendment from going after that entity used to communicate with.

Their is nothing to be gained by giving the powers that be an excuse to attack free use generally or this 4UM specifically, so I do not agree with this tactic.

And I have experience taking this stand too as an Earth First!er who has opposed and battled the Earth Liberation Movement because of what their tactics do to hurt environmental advocacy. It is alright to go after someone politically, but burning their lives down is as wrong as torching a USFS Ranger Station just because one hates clear cutting the forest.

Which over the years has saved me from renting to some truly undesirable people.

I heard that someone is having an affair. It was on someones secret myspace account say. I take that info and spread it all over the net. To the spouse, friends neighbors. I am pissed I want to make them uncomortable and I want to harm their reputation.

I think that my per search fee is better for me than a recurring monthly charge.

I tell prospective tenants that I want them to live in the unit until they die, and that I want them to live to 200 years of age. Turn-overs and make-readies really hurt the bottom line.
