NEW YORK — A 72-year-old Texas woman who was Tasered during a traffic stop when she dared an officer to shock her says if stopped again she would say nothing. Kathryn Winkfein said in an interview today on NBC's "Today" show that she lost her temper and if she had to do it over, "I would just not say anything, not react." Winkfein was stopped May 11 for going 60 mph in a 45-mph zone near Austin. A patrol car camera captured what happened when Winkfein got out of her vehicle and argued with the officer. The incident is being reviewed by prosecutors. An internal investigation found no violations by the officer. Winkfein this month accepted a $40,000 settlement offer from Travis County. County Judge Sam Biscoe said defending a lawsuit would have cost much more.

Because when you do nothing wrong, naturally you have to make huge cash payouts to people whom you have not wronged.

(Yet) Winkfein this month accepted a $40,000 settlement offer from Travis County. $40k paid for "no violation"? Hey - taser ME for a sh*tty reason and it'll cost Travis County a lot more than a measley $40k.
I'll bet you any amount of money the Cop in question wishes he'd handled it differently. He and his entire department probably feel they're under a microscope. Because this cop lost it, the dept is at risk because now they'll be over-cautious about using a taser in legit situations. IMO.
Well I have to say I saw the tube and she passes the dopey test. And now she just admitted it. I still have no idea how we did the job without all these toys :)
I'm pretty sure sam has first hand knowledge on defense costs from criminal charges brought against him and other travis county officials for color of law violations of rights and shielding government officials from prosecution. check out rule of law radio for more information on the subject.
real tough nuts taking down a 72 year old woman. the good thing is john e. law will be quietly transferred to some out of the way city police department (which under Texas law have no authority outside of city property) and he'll shed his billy bad@ss suit or he'll be found in an alley slumped over the steering wheel and a severe case of rigor mortis.
Lol - no doubt she's stunningly dopey...but that's the problem. Too many of these same dummies are all too willing to challenge a cop...just because. And occasionally cops are all too willing to oblige - especially with the new toys. Having the discipline NOT to get baited unnecessarily is a skill onto itself - I know I don't have to tell you. Well let's face it - back in the day you had NO cameras, and people were less apt to challenge cops over stupid sh*t because they knew they weren't gonna win. Gotta be extremely tough to be a LEO these days with all the precision protocol and paperwork and dodging "profiling" BS.
