Mother facing prosecution 'for asking for ethnic hospital staff to be removed from birthing room'

By Andrew Levy
Last updated at 4:57 PM on 28th October 2009

A mother is facing prosecution under race discrimination laws after objecting to hospital staff from a specific ethnic minority group being present at the birth of her child.

The woman was in the delivery room at the maternity unit and about to undergo a caesarian section when she made her demand.

It was not clear whether she was referring to black employees, those of Asian origin, or any other race at Milton Keynes Hospital in Buckinghamshire.

But an insider said: 'The mother objected to one type of ethnic minority members of staff being there.'

The woman, who was accompanied by her partner when she arrived earlier this month and was not from the Milton Keynes area, later gave birth to a healthy child and has since been discharged.

The hospital yesterday claimed the woman's demands were dismissed and the delivery was overseen by a team that was 'not all-white'

But the Equality and Human Rights Commission revealed it had written to the hospital after receiving a complaint from a member of staff about the way the situation was handled.

According to some reports, a consultant agreed to the mother-to-be's demands. If a senior member of staff asked an employee to leave the delivery room then they and the hospital could face civil action at an employment tribunal under the 1976 Race Relations Act on the grounds of discrimination.

The mother could also face action under the Act in a county court.

Unlimited compensation could be awarded in both cases.

Navrita Atwal, of Milton Keynes Equality Council, said: 'If the allegations are true then what the hospital did was unlawful.

'The best course of action would have been to tell the mother: "We will provide you with the best care with whatever staff are available".

'You hear about this sort if thing in America but not in England. The staff involved would have been devastated.'

The Equality and Human Rights Commission, whose responsibilities include ensuring public bodies enforce race laws, refused to comment on the case yesterday as it might prejudice an investigation.

A spokesman said: 'We are aware of the complaint. We're deciding what action we might take, if it's appropriate.'

In January 2008, a survey of staff at Milton Keynes Hospital found 58.1 per cent were white, 6.2 per cent Asian, and 5.1 per cent black.

Just under one per cent classed themselves as mixed race, 3.3 per cent as 'other ethnic group' and 26.1 per cent declined to state their ethnic background.

The general population of Milton Keynes consists of 90.1 per cent white people, 3.6 per cent Asian, and 2.4 per cent black.

The rest include 1.8 per cent mixed race and 0.8 per cent Chinese.

Its own policy document, Managing Diversity and Equal Opportunities in Employment, says excluding people from jobs because of their race constitutes direct discrimination.

A hospital spokesman said: 'The trust is carrying out a full investigation into this allegation and the judgments made based on immediate clinical needs and to ensure the safety of the mother and baby.

'We take the interests and wellbeing of our staff very seriously and any act of racial discrimination will not be tolerated.

'Discrimination and prejudice whether from patients, visitors or staff is unacceptable. Robust policies are in place to promote and protect equality and diversity for all.'

A Department of Health spokesman said: 'All staff and patients should be treated with respect at all times and not be subjected to discrimination or harassment on any grounds.

'We expect all parts of the NHS to adhere to this principle.

Mother facing prosecution 'for asking for ethnic hospital staff to be removed from birthing room'

Though the mother's request might be over the top, the reaction to it is way beyond that, it's off the scale in nanny government gone wrong.

British healthier than Americans in middle age: study

Posted on: Tuesday, 2 May 2006, 11:58 CDT

CHICAGO (Reuters) - Considerably more middle-aged Americans suffer from chronic illnesses than their British counterparts, probably because more Americans are obese, researchers said on Tuesday.

"You don't expect the health of middle-aged people in these two countries to be too different, but we found that the Americans are a lot less healthy than the English," said James Smith, a RAND economist and one of the study's authors.

An analysis of health surveys showed the prevalence of diabetes and cancer were nearly twice as high among white American 55- to 64-year-olds than British in that age group.

Heart disease was 50 percent more common in the United States than in Britain, and rates of stroke, high blood pressure and lung disease were more common among middle-aged Americans as well.

African-Americans and Hispanic-Americans were excluded from the study because those populations would have skewed the U.S. illness rates even higher, the report said.

The minorities were excluded from the study so they can compare apples to apples - American Anglos to British Anglos of the same age and income levels.

It seems all the FOX news Republican screaming about the British healthcare system not withstanding - the socialized British system (which is not even the best - France and Germany have that distinction) out performs the American private system and do it cheaper per person.

Yep, a Government run healthcare system is certainly going to ensure that fatasses put the cheesecake down.

But a socialist British healthcare system still outperforms the American one and the privatized American healthcare system seems unable to help Americans get over from fat assness.

At best all things considered equal - taking out Anglo America's fat ass lardness from the equation the American's private health care system would produce equal results in health care outcomes to the socialist Anglo Brits but for more money.

So you have no legs to stand on - diabetic amputee legless reasons not withstanding.

If the health problems come as a result of obesity then no amount of shuffling the deck chairs is going to resolve the issue.

You should be bright enough to figure that one out.

No, I mean we are turning into a 1984 society, with government controlling every aspect of our lives.

As far as healthcare, eliminate the fraud and it'll become much cheaper. Easier said than done, but with a guaranteed and endless supply of taxpayer money, corruption will increase exponentially and will drive taxes to impossible rates.

Besides, since when has child birth/labor been among womens' more rational moments in life throughout the course of history.

Idiocy!

That should be her defense, in a fair and impartial court, she should prevail.

In a rigged system however, her odds might not be so good.

It IS pure idiocy on the part of the staffers to raise hell over it, THEY should be sued for harrassment.

f the health problems come as a result of obesity then no amount of shuffling the deck chairs is going to resolve the issue.

You refuse to acknowledge that British Socialized medicine still over all produced better health results.

You have also to state that they did not produce a less healthy population than Americans.

This is empirical evidence. I am done with ideology.

You have the anti-Socialized medicine crowd on FOX and right wing talk radio use England as the evil example of what not to do. OK - fair enough - England is the worst of the bunch in Europe (notice FOX heads don't bring up Germany or France do they?) well looking at the study shows that even under performing England is doing better by their patients than the American system.

So they think because Americans are obese this makes Americans less healthy then the Brits but so what since even under their Socialist system they still are pretty healthy so it is not this nightmare scenario the FOX talking heads and Rush Limboughs go on about.

At the end of the day it is about manipulation of the truth and I can't understand after 8 years of FOX news the right wing I left still allows itself to be manipulated.

Republicans and Conservatives need to face up to the fact that their ideology as they have stated it is a failure and a fraud. The Free market does not produce long lasting prosperity. Deregulation does not produce good results and most damming of all tax cuts do not stimulate an economy.

My thoughts exactly. And what if the woman was a chronic racist such that her paranoia would have impacted here ability to deliver? In that case, forcing here to give birth in the presence of the objected-to person could conceivably be a health liability for her and the baby.

If she's wrong in her demand, the moment she gives birth is not the time to force her into some PC sensitivity class.

Maybe the PC crowd should consider racism as a disease, just as alcoholism now is.

It is a different culture. The Brits don't worship Twinkies and Ding Dongs.

Here in America, we elect them to the Congress and the White House.

Get a clue. You're still comparing apples and oranges. One can make an "empirical comparison" that Pol Pot improved the overall health of Cambodia too.

That's your argument. Pol Pot wins.

What do you think healthcare has to do with obesity? Obesity is the result of high fructose corn syrup in virtually everything Americans consume, including but not limited to all forms of soda, most juice drinks, salad dressing, pickels and pickle relish, barbeque sauce, etc.

Brits probably consume more tea than soda, and possibly consume less condiments and foods containing HFCS than the typical American.

Has nothing to do with healthcare and everything to do with diet.

One of the reasons cited for not accepting socialized or nationalized healthcare is that the British system which is socialized is a disaster. My thesis is that the British system may be crap but the American system we have now is as crappy if not slightly more crappy.

So what is all the fuss over? That we trade a crappy system for a slightly less crappy one? Many approach this conversation as if the American healthcare system is the world model and that is not the case. America has pretty much become a a second tier nation in many regards. It is not news most Americans of a certain generation want to hear or like to hear or accept when hearing.

We can gut the military - those free loading socialists in uniform can be done away with.

Closing down every base overseas could more than pay for healthcare which should be seen more as a utility say like fire fighting is. Fire fighting used to be privatized. Fire Zouves would stand outside your burning home and negotiate a price with you to put out the fire while it burned. Sometimes two fire teams would compete for your business as your home burned - and by compete I mean beat each other over the head with axe handles and the ones left standing were paid by you to put out the fire.

You go "yes massa" to me but you advocate for a failed model.

You make a great show of being anti Republican party but follow all the BS Republican noise machine propaganda designed to keep you in the GOP plantation.

I was hoping when I came back I after the debacles we have had and see some introspection. I want to know when the American right be they Libertarian or Conservative Republican will admit many of the tenets of its ideology failed just like the left wing ideology of communism and the Great Society programs of LBJ failed?

As a pal of mine wrote when I asked that same question: Did the Great Society fail? Miserably. Did most of the tenets of the GOP (small government, less government, free and equal trade) fail? Miserably.

The vacuum left by these gaping failures will have to be filled by something. Trouble is, a democratic form of government promised by ALL OF THE ABOVE is quickly disappearing as even a remote option.

If small govt Libertarian economics is supposed to produce the greatest gains why do we have as an end result a system where fewer than 2% of the population (or is it 3 or 4%?) own most of the nation's wealth? That is the system we are advocating for as 'conservatives'? Is that good for Representative govt, freedom and democracy?

If low taxes and limited to no regulations is what will keep the free market from ever collapsing or if it collapses from starting back up again why did that not happen in the last debacle on super privatized Wall Street?

How is it that a model of health care built around a private company making money by not paying out insurance claims as much as possible be a system Conservatives advocate for? Think about that for a second... the only way a health insurance company makes money is to make sure it declines to pay as many claims as possible and to keep more of your money as possible. Performance bonuses are paid out to insurance execs on how much money they got to keep from clients not on how healthy their client base is.

This is the system the so called 'conservatives' are battling to maintain and I find that baffling.

Then why are you advocating for Great Society programs if they are failures? What you propose is just more Medicare. Its broke. Have a nice day.

The GOP wants more Government. I want as little Government as I can possibly shove those bums into. If possible, I would dearly love to be able to hide the entire Governmental apparatus inside an empty beer can.
