Political Punch Interview with the President: Jail Time for Those without Health Care Insurance? November 09, 2009 6:30 PM

During an exclusive interview with ABC News’ Jake Tapper today, President Obama said that penalties are appropriate for people who try to “free ride” the health care system but stopped short of endorsing the threat of jail time for those who refuse to pay a fine for not having insurance.

“What I think is appropriate is that in the same way that everybody has to get auto insurance and if you don't, you're subject to some penalty, that in this situation, if you have the ability to buy insurance, it's affordable and you choose not to do so, forcing you and me and everybody else to subsidize you, you know, there's a thousand dollar hidden tax that families all across America are -- are burdened by because of the fact that people don't have health insurance, you know, there's nothing wrong with a penalty.”

Under the House bill those who can afford to buy insurance and don’t’ pay a fine. If the refuse to pay that fine there’s a threat – as with a lot of tax fines – of jail time. The Senate removed that provision in the Senate Finance Committee.

Mr. Obama said penalties have to be high enough for people to not game the system, but it’s also important to not be “so punitive” that people who are having a hard time find themselves suddenly worse off, thus why hardship exemptions have been built in the legislation.

“I think the general broad principle is simply that people who are paying for their health insurance aren't subsidizing folks who simply choose not to until they get sick and then suddenly they expect free health insurance. That's -- that's basic concept of responsibility that I think most Americans abide by,” Mr. Obama said, “penalties are appropriate for people who try to free ride the system and force others to pay for their health insurance.”

The President said that he didn’t think the question over the appropriateness of possible jail time is the “biggest question” the House and Senate are facing right now.

I can recall working for this government long ago, when they steadfastly refused to participate in a group health insurance. For years we had nothing.

Now they are taking over the entire industry.

It is sheer insanity that they think they can mandate that all citizens must buy a product. This is a way for them to steal the surplus.

They should have had anti-trust and gouging laws against the insurance companies years ago. Within the last ten or so years the insurance companies have gone haywire.

I had my husband take me off the insurance. Paying $300.00 a month for me alone with a yearly deductible that is never met leaves us paying for any and all doctor bills also. I think we start a savings account and if necessary I will opt for medical tourism if needed.

Not just any savings account - you and your husband might want to consider establishing an HSA - I have one now and it's the BEST thing I ever did - and I have it in conjunction with a high deductible top of the line PPO catastrophic insurance plan that has prescription component. I pay for all the routine medical expenses under the deductible with PRE-TAX DOLLARS in the HSA. Also, fyi an HSA can be a deduction for fed income tax purposes.

However I should tell you that these HSA/FSA accounts might be in the cross-hairs of Obumski's "reform" plan - precisely because these plans save taxpayers $ and because they give individuals considerable flexibility choice to determine what they want out of an insurance plan. More info can be found at the IRS website "Publication 969, Health Savings Accounts and Other Tax-Favored Health Plans."

Here's an article that will give you an idea of how helpful these accounts can be for reducing insurance premium costs and protecting one's assets from loss due to a big ticket expensive health issue that might come up. I'm one of those who belive that health insurance should be purchased to cover the costs of expensive medical procedures, not for nickel and dime routine thingies.

That is why HSA's are in the crosshairs. Big Pharma is afraid that you will do something "rash" with your HSA - like spend it on natural, low side effect, Naturopathic, Homeopathic, Chiropractic, and other healthy alternatives. There goes the money from their as high as 500,000% mark-up. Where would their dividends and bonuses come from if they actually had real competition? Not only that - from alternatives that actually work and don't require 3 other drugs to counteract the adverse side-effects of those of their products prescribed. Why the nerrrrrrrrrrrrrvvvvve of some people - to think that they can cut out the Pharmaceutical Mafia.

Yes, you are correct - HSA plans cover alternative medicine [ osteopath, chiropractor,podiatrist etc] expenses because they are considered "qualified medical expenses" by the IRS.

HSA plans in tandem with high deductible PPO insurance plans give taxpayers-health consumers the best of all worlds, imo. In fact you'll hear this combination sometimes referred to as Consumer Driven Healthcare because an individual/family self-insures for the small routine medical expenses but gets top of the line PPO coverage and asset protection for the big ticket health calamities that may come up.

Also don't forget the HSA plans represent excellent tax savings for employers - small businesses and big businesses alike - and keeping American businesses viable in America is a very good thing.

Because it's a win-win for individuals/families/employers in terms of free choice and tax savings, I think that's why the Dems hate it so much and want to degrade its existence. The Dems want FedGov to reclaim all those yummy tax savings for plundering.

Nicely put - anything I would add would simply detract from your succinct summation. My only quibble would be that the Demoncrats are in thrall to Big Pharma as much or more so than the Republicruds. More important to them even than the money is control. And that is ultimately what this Hellthcare plan is about is control. Direct control of the Medical System gives them direct control of the most intimate aspects of people's lives. It's enough to warm the heart of a totalitarian control freak. And by cutting out alternative care Big Pharma can see its coffers swell all the more because of all the dollars flowing in for their overpriced nostrums from a Hellthcare System that ensures their small coterie of well connected companies are the only suppliers to the system.

OI,actually, HSA's came into being after legislation was signed by George Bush on December 8, 2003. The law went into effect on January 1, 2004.

I'm not suggesting that BigPharma doesn't grease the palms of the GOP - they most absolutely do - but we need to give credit where credit is due for HSA's seeing the light of day and we need to name the party that's currently trying to put the kabosh on HSA's - it is indeed the Demoncrats.

Big Pharma is but one component of this issue and imo it's a smaller one comparatively speaking, although you are correct in stating that Big Pharma will benefit greatly under Obamacare - industry predictions for Big Pharma windfall profits under Obamacare support your position - there will 46 Million uninsured brought on board and gatekeeper socialized medicine practitioners tend to write more scripts to put off/delay sick patients from being referred to specialists and also gatekeeper medicine definitely promotes the "need" for patients getting vaccinations up the wazoo.

For me, the biggest components of HSA's + high deductible PPO insurance plans that are antithetical red flags to the Dems' philosophical mindset are as follows:

* INCOME TAX SAVINGS for individuals and businesses [ like a stake in the heart to Dems]

* FREE CHOICE of individuals on what health expenses they want to pay for and what they expect insurance to cover [ individuals having choice and being responsible and independent as opposed to Big Government's ONE-SIZE FITS ALL/ WE KNOW WHAT'S BEST FOR YOU/ MEDICAL EXPENSE MANDATES whether individuals want or need these medical services]

* SELF-INSURING [ individual's sense of responsibility, individuals taking charge of their health needs..yikes! scary propositions to the Greater Gooders] for routine medical expenses and getting top of the line PPO plans to cover serious illness - evil thingies to self-respecting socialists [ Dems are big on promoting "preventative health maintenance" which are HMO's avec GP gatekeepers ] Otoh, HSA's combined with high deductible PPO plans giving individuals unfettered access to alternative medical practitioners and medical specialists are big no's to "rationed medicine" goose steppers - indeed, HSA's are incompatible with gatekeeper medicine that the Dems want to ram down our collective throats

* CONTROL [ as you noted] of individuals through IRS snitches and through a centralized database of the collective's individual medical and prescription records are right up Dem socialists' alley - the Stupid Party hasn't shown any interest in Gubment high jacking doctor patient confidentiality and especially so if it means teaming up with the IRS, a dept with whom the GOPers historically have been at loggerheads
