Montana Becomes Third State to Legalize Doctor-Assisted Suicide By Joel Rosenblatt

Jan. 1 (Bloomberg) -- Physician-assisted suicide is legal in Montana, and doctors who help terminally ill patients die are shielded from prosecution, the state Supreme Court ruled.

Montana is the third state, after Oregon and Washington, to allow physicians to help such patients end their lives, and yesterday’s decision is the first from a U.S. state high court to protect the choice, said Steve Hopcraft, a spokesman for Compassion and Choices, a group that advocates the practice.

A lower court in Montana ruled in 2008 that the state’s constitutional privacy and human dignity rights allow a terminally ill patient to “die with dignity.” The court ruled patients may use a doctor’s prescription, and that the physician is protected from prosecution under Montana’s homicide laws. Montana appealed that ruling to the state’s high court.

“We find nothing in Montana Supreme Court precedent or Montana statutes indicating that physician aid in dying is against public policy,” the high court said in its opinion.

Montana law “explicitly shields physicians from liability for acting in accordance with a patient’s end-of life wishes, even if the physician must actively pull the plug on a patient’s ventilator or withhold treatment that will keep him alive,” according to the ruling.

The case was filed by Robert Baxter, a retired truck driver from Billings who was terminally ill with leukemia, according to court filings. Baxter sought a lethal dose of medication prescribed by his doctors, who also joined Baxter in the case challenging whether they could be prosecuted under Montana law for helping mentally competent, terminally ill patients to die.

Baxter died before yesterday’s decision, according to a statement from Denver-based Compassion and Choices.

‘Additional Options’

With yesterday’s ruling, “terminally ill Montanans can work with their doctor and have additional options at the end of life,” Hopcraft said in an interview.

A representative for Nightingale Alliance, a Wisconsin- based group that opposes assisted suicide, didn’t immediately return an e-mail message seeking comment.

Judy Beck, a spokeswoman for Montana Attorney General Steve Bullock, didn’t immediately return a call seeking comment.

The case is Baxter v. Montana, 09-0051, Supreme Court of Montana (Helena).

More liberal bullshit. I bet you support this right.

It would be par for the course for you.

You don't like marriage so you try to change the meaning to include same sex weirdos. You failed miserably at that by the way.

Now if you support this you are trying to change the meaning of suicide. Suicide by definition is one person. It can't be suicide if a "doctor" (acutally a murderer if they do this) is involved.

If you support this nonsense you are not only an enemy of the constitution, kids but an enemy of the english language.

That is if you support this murder.

You are proving yourself to be more and more liberal.

You support abortion too I bet.....Most liberals do.

How many people have you watched die?

How many of those people died of Terminal Cancer?

How many people out of all of those, died with any dignity?

How many pets do you own? How many did you take to the vet to be euthanized?

My mother died of cancer. She was given 6 months. 6 months to the day she was gone.

The thing is, she was on a morphine drip, and it got to the point where the morphine wasn't doing enough so they took the safety off the machine, and when I was gone, the relatives put her out of her misery.

You have this incredibly sickening and vile belief that humans should be kept alive while suffering horrific pain, and agony. You must be broken inside in a way that can't be fixed.

Some people actually think that nanny state must dictate every decision, including life and death.

Ignore that charming phrase about the persuit of life, liberty and happiness. When all three are gone you should be forced to continue to live by artificial means. An adult of sound mind? Oh no, certainly not to be trusted with such a choice as to die with dignity.

Prolonging the life and suffering of a human being, does only ONE thing.

It strips them of their wealth. Wealth that would be passed on to their children.

That is ALL it does. If there's a God, he certainly doesn't want us to suffer needlessly.

It's never to early to stop a tyrant, nor is it ever to late to stand against Tyranny.

I agree completely Tommy and I'm sorry about your mother. My grandfathers both wasted away in the hospital, despite wanting to die at home with loved ones.

What happened to free-will and self determination? It's just not profitable.

PS: I miss your old tag line. : ) I really liked that one.

Tommy Pain is part of the world. I don't care if someone is taken off machines.

I've watched about 4 people die. Grandpaprens.

My grandfather died of terminal cancer.

They all died with dignity. If they were murdered by a "doctor" that would be very undignified.

I have never euthanized a pet. That is cruel.

I'm sorry that your mother died. Did she die with dignity? Or was she killed?

Oh so the relatives killed her huh. They should be prosecuted.

No I am not vile. I just know that God will take them when the time is come. You may not believe in God but guess what. That is your problem not mine.

Remember it is a slippery slope. Once you have doctor assisted suicide it will eventually become a duty to die. Kind of like Obamacare.

I take it your a supporter of Obamacare.

You don't know me at all, and you certainly are one of the biggest liars I've ever seen.

People are euthanized every day. You know it. Big Pharma knows it. Big Insurance knows it too.

I don't support anything that says I have to BUY something just because I draw breath. Which is exactly what you advocate. Paying your last dime, so you can draw your last breath.

You're all about the theft of wealth, and the theft of choice. You have no idea when it's going to be your time. When it is, I certainly hope you die screaming. That way you might understand suffering as some of us do. Maybe your pathetic selfish god you believe in will comfort you in whatever hell you wander to in the hereafter.

Pipe down on the ego, aka. Frankly, I don't have to answer any questions presented by you. It is simply a courtesy if I opt to do so. Abortion wouldn't be my choice.

You are the liberal nanny stater that thinks the federal goobermint needs to dictate to people every aspect of life from cradle to grave. Hell, you don't think that adults of sound mind should be trusted to dictate the terms of their own death.

People can live free or die in three states now. You don't have to live in those states, aka. You can opt to live in states with a level of nanny control to your liking.

To your first point.....lol. I am for freedom. I am against doctor assisted suicide because it will lead to a calice disregard for life and not a right to die but a duty to die. If someone wants to kill themselves they should do it themselves. You deliberately ignored my point that I am NOT in favor of having to keep people on life support. That is a big difference then assisted suicide. Which isn't suicide at all. Sui meana 1 stupid.

Ok you say I don't know you at all and that I am a liar. I only know you from your posts. Now tell me how I am a liar.

Ok people are euthenized every day and people know. So what the fuck is your point?

You outright lie again when I say you should be required to buy something. Show me where I said that you artist you.

Catch a clue, aka asswipe. This thread isn't discussing abortion. Trot along and find a thread that is discussing this issue to bloviate.

Let's stick to the topic at hand, on the issue of assisted suicide you are a nanny stater who thinks that only the goobermint SHOULD and MUST determine when a person has a right to die and also dictate the terms of that death. Typical libturd thinking that the nanny state must do for you what you refuse to do for yourself.

Typical libturd to bitch about others ignoring their all important questions, then bitching about the answer once they get one. Fling your partisan turds in some other direction where posters enjoy such turd tossing.

I'm here for intelligent discourse on issues relating to the thread I'm posting on or about, not discourse with a bloviating partisan hack who thinks he's the center of the universe, bloviating about his opinions that aren't even on topic and actually thinking that others give a rats ass about them.
