Ok this has been going on for years. Someone in the city put my name in a database saying I am a militia member. Well I am not and never have been. This has caused me some problems. They also have it in their database that my wife is militia. Well I have seen the govt flyers that say militia is terrorists. So basically they are saying I am a terrorist. I am looking to sue the city for this defamation and slander. It has also caused the police to harrass me and not file charges in cases that I wished to persue. The prosecutor in a case I am involved in has even told my attorney that I am a militia member. I am serious about this. So if there are any attorneys out there. Please contact me privately and we can talk about this. Looking for suggestions.

The funny thing about the company you keep, is that other people judge you by it.

I find it funny that you of all people would be considered part of any militia, because once the truth came out about you, I assure you that nobody would want to be associated with you.

If the government, and other local constabularies have you down as a militia member, well then obviously this is an error that could easily be investigated by requesting a copy of your FBI file through the freedom of information act.

Your local police do not deal with militia types, the ATF and FBI do.

Only a moron wouldn't know this.

I have found myself on more than a few lists to which I thought to myself, they have got to get better agents.

I am not part of any group, nor would I want to be. Groups are dangerous to the individual, as you say you're finding out. Joining anything, even something as innocuous as an internet political forum is grounds to have you labeled, and categorized.

I like to be complex just for this reason. I want an agent to read what I write, and be completely confused. I want them to spend time racking their brains trying to figure out whether or not I'm sane, or nuts, or dangerous.

I would suggest that you not only find yourself a good lawyer, contact the ACLU. I'm positive they will help you out, without fail. They get involved when people are wrongly accused of all kinds of things. Even on the behalf of pro-zionist Militia Members.

A K A Stone, you can obtain access to such record of the database by making an official public records request in accordance with your state laws. Such request under your state Public Records Act statutes.

Put your request in writing and reference that statute and mail it by certified mail to the person who is custodian of public records. Tell them you demand within 30 days that they have within the reasonable amount of timeline to comply with your requests per that statute to supply you the actual record asserting such allegations. If they fail to comply, then you have grounds to sue them in their personal capacities (not official capacities) in state court per violations of that public records act along with invasion of privacy, as well as slander, defamation and false light, because their are using their badges of law (color of authority) to violate your persons in your right to be free from harassment and from invasion of privacy and unreasonable searches per the Fourth Amendment to the constitution.

I am well familar with 42 USC Section 1983,1984, 1985 and 1986 claims. For brevity you never invoke respondent superior when you are making a 42 USC claim unless suing public servants in their official capacities to claim permanent injunctive relief. The Respondent Superior clause is nothing more than a strategy attempt for the opposing counsel to motion to dismiss (or motion to demurrer) of a legitimate complaint based on their defense that their clients were just doing their jobs under cloak of authority. You do not invoke respondent superior when suing public servants in their individual capacities. Never. They not only need to be held personally accountable but need to get their own attorneys instead of using state funded lawyers at taxpayer expense to obvuscate a legitimate lawsuit and thwart the law.

There is such a database. It is referred to as secret files or documents that government servants create and then store in filed compartments and disseminate to third parties ( law enforcement, employers, etc.,) concerning an individual, for reasons such as retaliation or blackmail. Such practice does exist as a means to make that individual a non-person. It is a soviet style tactic that was used on citizens who protested against their government.
