Boy Earlier Expelled After Leaving Gun In Truck Near School

WILLOWS, Calif. -- The Glenn County Board of Education has overturned the expulsion of a student who had a shotgun inside a pickup truck that was parked near the Willows High School campus.

In its ruling, the county board found that the Willows School Board overstepped its bounds in dealing with Gary Tudesko, 17.

The expulsion will be removed from his record, the county board said Friday.

Tudesko had been out duck hunting and left the gun inside the pickup.

The National Rifle Association has come to the defense of Tudesko.

Expulsion of Willows High student with shotguns near campus overturned

A Willows High School student who was expelled for having firearms in his pickup that was parked near the school will be reinstated and have the disciplinary action expunged from his record.

That ruling was made this morning by the Glenn County Board of Education acting on an appeal filed by Gary Tudesko. The hearing was open to the public at the request of Tudesko's parents.

Board President Judy Holzapfel, reading from a written version of the board's decision, said that in expelling Tudesko, the Willows Unified School District exceeded its jurisdiction based on acts "that did not occur on school grounds or at a school activity off of school grounds."

The Oct. 26 incident occurred a few days after the start of waterfowl hunting season in an area where duck hunting is a major pastime. Tudesko said he was returning from a morning hunt and did not have time to take the shotguns home without being late for school.

He said he parked on a public street thinking that satisfied the rule against bringing guns on campus. A dog trained to locate weapons later alerted authorities to the shotguns.

Tudesko, a high school junior, was expelled Nov. 19 by the governing board of the Willows Unified School District.

After the expulsion, Tudesko's parents appealed to the county education board. The National Rifle Association and the California Rifle and Pistol Association provided support and legal assistance.

Willows High School Principal Mort Geivett said he was disappointed.

"This decision is not in the best interest of kids in the county," he said.

Willows Unified superintendent Steve Olmos said it is up to the school board whether to pursue further legal action. He said the school will seek support from outside groups such as teachers unions.

Tudesko's lawyer, Chuck Michel, said the state education code is a "confused mess."

"The Legislature needs to clarify the boundary where the education code ends and the penal code begins," he said.

He also said the decision sets no legal precedent and should be the end of the issue.

"The case need go no further," Michel said. "It can end at the Glenn County Board of Education."

Trustees refused to comment on their decision, citing the confidential nature of disciplinary proceedings.

Tudesko said he was "excited and eager to return to school as soon as possible."

"I'm just excited," he said. "I need to grow up and take advantage of school."

In response to the school district's contention that Tudesko's disciplinary record, including two dozen prior incidents, should have had bearing on the board's decision, the teen said:

"I think that's really the only thing they had on me. They couldn't get me for the guns.
