St. Petersburg, FL (LifeNews.com) -- Terri Schiavo's name could be back in court, but this time for a different reason. Her former husband says he is considering a lawsuit against her family because they started a foundation in her name to assist other disabled who may be deprived of their legal rights and medical care.

The foundation was once named Terri's Fight and existed before Terri's death, which saw Michael Schiavo starve and dehydrate her to death over 13 days after winning a court order to take her life.

The Schindler family -- Terri's mother and father and brother and sister -- headed up the foundation to defray legal expenses and costs to provide Terri the rehabilitative treatment and medical care Michael deprived her when he gave up on her recovery.

Following Terri's painful euthanasia death, the Schindler family change the name to the Terri Schindler Schiavo Foundation and it has raised a modest amount of money -- less than six figures -- to provide help and support for disabled people like her.

But, Michael, who said he never wanted anyone to profit from the use of Terri's name, claims the helpful nonprofit organization is doing just that.

Michael says a court document gives him rights to the name Terri Schiavo and he says it means no one can use her name without her permission. His attorney has written to the Terri Schindler Schiavo Foundation telling it that its use of the name violates that court order.

Schiavo's attacks are ironic given that he attempted to profit politically from Terri's death, by starting a political action committee that supported candidates until it closed down after the FEC repeatedly fined it for late reports and violating reporting guidelines.

David Gibbs, a pro-life attorney who helped the Schindler family during their legal battle to protect Terri's right to live, told WTSP that the Schindler's are doing a good job running the nonprofit and helping hundreds of people.

Gibbs also says the foundation has the right to use Terri's name since she is a public figure and they are related to her.

Wesley J. Smith, an attorney and bioethicist based in California, says what Michael Schiavo “believes” is "irrelevant and beside the point."

"Had the reporters wanted to find out the kind of help the foundation offers others, producers could have called me or a myriad of others active in this field, who are quite aware of the selfless giving and effort each surviving member of Terri’s family offers to others," he said. "Indeed, I have personal knowledge of case after case in which the Schindlers worked selflessly–and without financial compensation of any kind–to assist family members save their cognitively disabled loved ones from suffering the same dehydration fate as Terri."

Smith says neither Terri's brother Bobby Schindler nor her sister Suzanne Vitadamo are making any money off of Terri's name.

"And as for profiteering–Bobby Schindler’s salary is $37,500 annually, and all speaking fees he receives go to the foundation," he explained. "His sister Suzanne makes less and is 14 months in arrears in receiving her compensation."

"It is also worth noting, that after receiving complaints, the IRS investigated the foundation and gave it a clean bill of health in 2008," Smith continued. "The hatred of this family is pathological and obsessive."

Smith says the Schindler family is a wonderful one which has been unfairly attacked.

"Father Bob gave everything he had to save his daughter’s life, and seeing her die slowly by intentional dehydration when the family was prepared to love and care for her the rest of her life, destroyed his health and eventually took his life," he said. "I stand wholeheartedly and unreservedly with the Schindler family and against the continual calumny mounted against them."

Sure they can. The problem is that this was a state sponsored murder supported by the elite to show off their power. They were testing the waters to see what people would do when they publicly kill someone. Killing the judge and her ex-husband will not stop them. The elite are planning on controlled population reduction to better control their slaves. Only when the head is cut off will this beast die.

And they saw that people would do nothing. If that had been my sister and my ex brother in law--Schiavo had already had two children with another woman before he involved himself in a conspiracy to finish Terri off--I would have hunted him to the ends of the earth and shot him the same as I would a rabid dog. And I would feel sorry for the dog but not for him.

Yes that is what happened, people did nothing basically. Her ex-husband had a very huge motive for not wanting Terri to ever get better, he is the one that put her in the condition she was in IMO. He tried to kill her before and failed. So he surely didn't want her to ever recover and tell the truth. Just because nothing was done to save Terri besides protests and calls and emails to representatives doesn't mean that nothing will ever be done about this murder and the future murders planned for all Christians by the elite. I think something will be done. The sleeping giant is about to awake. Arizona's stance on illegal immigration is an indication the giant has about had enough IMO.

I hope you're right, Ricky. How much is enough? They engaged in a conspiracy to murder Terri Schindler and never gave it a second thought. The government sent its armed goons to kill Randy Weaver after they engaged in entrapment to get him to break one of their idiotic "laws" about certain length shotguns and rifles. And they murdered his wife and son and very nearly his friend who was living there. And there was Waco where a bunch of innocent people, including little children, were barbecued. The case of Gordon Kahl and his son Yori. And of course their continual warring against people who have not harmed Americans. I love America but I hate the government.

The "judges" for a start, along with Michael Schiavo--he should not have had anything to say about it. He put her in the shape she was in and then went off and had two children by some whore he took up with while Terri was still alive. And the area where that happened is a hotbed of Scientology so I suspect they had some involvement in it. As to why they conspired to murder her, I don't know. I don't know why a "judge" would rule that not only could a feeding tube be removed, which was bad enough, but to order that no one could even give her some water or even a chip of ice on her tongue. Seems to me that some people just enjoy inflicting pain and death on others. And too, it could have been part of a larger conspiracy to see how much people would put up with. So far it has been a lot.

It was clear to me when he was conspiring with that ahole of a "judge" to finish Terri off. Wouldn't even turn over her care to her family as they requested. He could have gone on with his life, such as it was, and they would have taken care of her. But I guess he was afraid that some miracle might happen and she might come around and say what put her in the condition she was in.

I was there in Pinellas County when this went down. I was ready to sell the farm and buy it back during the process. I was very VERY close to shutting it all down during that sorry affair.
