Yeah, how could it be an "assault" to try to remove yourself from their meat hooks if all you are doing is pulling away, not hitting them? Makes no sense.

He never threatened the cop. Good thing he had it recorded.

Disgusting that the supervisor accused him of threatening and assault.

It's not assault to pull away. Resisting arrest maybe, but he didn't do anything wrong in the first place.

Other than be slightly uncooperative.

Difficult way to learn how to act and not act with someone with this kind of power.

Protecting America from all the terrorist in Canada. haha

Like terrorists or drug smugglers are going to drive through a border checkpoint. Vast stretches of border are wide open where any drug smuggler or terrorist can go and come as they please. These guards are just as useless to the security of America as TSA agents are for the airlines.

We would never have had a 9-11 had our borders been properly secured.

There are no terrorists. It's a lie.

3 terrorists a day?

Complete and utter bullshit.

Just like the supervisor lied about him threatening the guard and assaulting him.

All lies.

Actually what those officers should have done was not charge the man with assault but instead resisting arrest.

And this is what really angers me! It makes absolutely no sense for the U.S. Canadian officers to be taking this responsibility by themselves. We need this on the Southern border too!

Yeah, and maybe we can have this at malls and schools too. Yeah, lets have it everywhere. What a joke you are. The terrorist boggeymen are scaring the crap out of you at night because the talking heads told you they hate us for our freedoms and you like a little child believe them.

From what I listened to on that audio clip were the following facts:

Officers pulled man and his female companion over.

Officers claim they have "no grounds" for pulling him over.

Officers claim they were "assaulted" by the man and his female companion when the man resisted arrest and was in a verbal exchange with officer. It is never a wise move to argue with any law enforcement officer (whether they are state or local police or border enforcement). In arguing and resisting arrest you escalate incidents.

------------------

Should the officers be sued in their individual and official capacities, they will have the burden to prove the man "assaulted" them. I will leave that for the attorneys and court to decide what is considered "assault". The audio is prima facie evidence! Never argue with law enforcement even if they are in the wrong. What that guy should have done is kept his mouth shut and then take that officers name and badge number and filed a formal complaint.

Those officers may have acted too rough. However, the man and his companion didn't help to mitigate the situation. I don't know about the man's companion as I heard on the audio that she physically "assaulted" one of those officers. Not good!

You have nothing to fear from terrorists: they're a figment of the imagination of those in power. The real enemy is those who would manufacture nonexistent terrorists in order to further their own ends.

Sums it up quite well, thank you.

The officers claimed that pulling away from a hold was assault. That was a lie, but that's par for the course for police. Any one held as a suspect by the police should, for his own good, assume that everything the police say to him is a lie, as police are trained to lie to suspects. What we hear on this clip is further proof that police/law enforcement/customs agents will readily lie to anyone they encounter.

So the 3 terrorists per day line should also be assumed to be a lie, and in all likelihood is.

If anything, yes it's resisting arrest, not assault.

As for what started it, was the male's response of "does it matter?" upon being asked what particular stores in whatever mall he was to visit. That's hardly asking for trouble, and certainly is a surprisingly detailed question. The agent could have simply responded with "yes" and insisted on an answer but instead chose to escalate the situation. And it's not like identifying the particular store in the mall already stated is going to stop any terrorists either.

This audio is a good example of what is wrong with the mentality of federal agents. They have no common sense whatsoever. They are simply mindless bots that are fed attitude steroids that give them a false sense of superiority.

It boils down to who's asking the questions, the officer or the traveler. IMO the traveler had a flippant attitude and border guards are not known for their sense of humor

When crossing borders you answer the questions asked, no more no less. Perhaps this would have never happened if the traveler had answerer "I haven't decided yet, instead of "does it matter".

Exactly!! Those officers are trained to lie. But just because they are trained to lie doesn't mean or justify the man for resisting arrest. Let them have their justice in court should that even arise. Let the court throw the book at them for their questionable conduct...and not the man and his wife.

To avoid problems, this is exactly true. Which is why terrorists won't do what this guy did. By immediately detaining them upon the "does it matter" question, instead of first answering "yes", the guard tied up resources that would have been better used to find real terrorists. Instead, it's apparent that the only point of the detainment was to whip ordinary people into line so they'd answer questions the way terrorists would answer them.

IOW, by detaining this couple, these guys proved they were useless to US security.

BTW, it seems from the recording that the detained Canadian was the one doing the recording, though that's just a guess on my part. That could be significant, actually, if he was planning on the altercation.

I know there is no such thing as "justice" in any court of law. I am well aware of how badly corrupt our court system is.

However, because of what this man did in not cooperating with these assholes, he will probably be placed on some "do not fly" list because of his conduct with the border police. And such a "do not fly" list does exist! And once your name is added to that list...its hard to get it off.

That was my first thought, His voices is clear and close while the cops were distant and sometimes hard to hear.

Was he thoroughly searched, patted down, scanned with a wand? If he was hiding a recorder they probably would have found it

Who edited the tape? It was a seamless transition between the conversations in the car and inside.

Should this go to court, the court will be looking at the standard review of reasonableness of the officers.

Were they acting within the scope of their duties?

In your and my p.o.v. I would disagree because the officers stated so themselves that they do not need "grounds" to question someone. There must be the test met of reasonableness for such officers action to take place otherwise their actions becomes tumultuous, capricious and arbitrary conduct which makes their actions not within the scope of their duties.

The court will review the stated actions of the man and his wife as a result of the officers at issue. Was the man complying or was he resisting arrest further escalating the matter? The court will rule that he resisted arrest which is a felony. Not good for him.

The court will then review the charges of "assault". This may mean the verbal communications the man exchanged with the officer may be considered "assault".

When in doubt, it is never wise to argue with idiots. Especially when they're cloaked in uniform. It is safer to comply with them then to resist arrest and wind up on some list. Let the court see how idiotic these officers really are. When you take the law into your own hands, you wind up paying for it later.

And I would love to know how this got recorded so easily.
