The officers claimed that pulling away from a hold was assault. That was a lie, but that's par for the course for police. Any one held as a suspect by the police should, for his own good, assume that everything the police say to him is a lie, as police are trained to lie to suspects. What we hear on this clip is further proof that police/law enforcement/customs agents will readily lie to anyone they encounter.

Exactly!! Those officers are trained to lie. But just because they are trained to lie doesn't mean or justify the man for resisting arrest. Let them have their justice in court should that even arise. Let the court throw the book at them for their questionable conduct...and not the man and his wife.

When crossing borders you answer the questions asked, no more no less. Perhaps this would have never happened if the traveler had answerer "I haven't decided yet, instead of "does it matter".

To avoid problems, this is exactly true. Which is why terrorists won't do what this guy did. By immediately detaining them upon the "does it matter" question, instead of first answering "yes", the guard tied up resources that would have been better used to find real terrorists. Instead, it's apparent that the only point of the detainment was to whip ordinary people into line so they'd answer questions the way terrorists would answer them.

IOW, by detaining this couple, these guys proved they were useless to US security.

BTW, it seems from the recording that the detained Canadian was the one doing the recording, though that's just a guess on my part. That could be significant, actually, if he was planning on the altercation.

However, because of what this man did in not cooperating with these assholes, he will probably be placed on some "do not fly" list because of his conduct with the border police. And such a "do not fly" list does exist! And once your name is added to that list...its hard to get it off.

That was my first thought, His voices is clear and close while the cops were distant and sometimes hard to hear.

Was he thoroughly searched, patted down, scanned with a wand? If he was hiding a recorder they probably would have found it

Who edited the tape? It was a seamless transition between the conversations in the car and inside.

The whole thing could easily be a setup or just plain bogus.

Should this go to court, the court will be looking at the standard review of reasonableness of the officers.

Were they acting within the scope of their duties?

In your and my p.o.v. I would disagree because the officers stated so themselves that they do not need "grounds" to question someone. There must be the test met of reasonableness for such officers action to take place otherwise their actions becomes tumultuous, capricious and arbitrary conduct which makes their actions not within the scope of their duties.

The court will review the stated actions of the man and his wife as a result of the officers at issue. Was the man complying or was he resisting arrest further escalating the matter? The court will rule that he resisted arrest which is a felony. Not good for him.

The court will then review the charges of "assault". This may mean the verbal communications the man exchanged with the officer may be considered "assault".

When in doubt, it is never wise to argue with idiots. Especially when they're cloaked in uniform. It is safer to comply with them then to resist arrest and wind up on some list. Let the court see how idiotic these officers really are. When you take the law into your own hands, you wind up paying for it later.

And I would love to know how this got recorded so easily.

This all assumes that there won't first be a plea deal made with the guy, regardless of his potential innocence, letting him off "easy" in exchange for pleading guilty. So he can take that deal or go for what the court might find, in which case he gets whatever is behind curtain B. And of course that entails a much stiffer punishment, if he's found guilty, in addition to extra lawyer fees even if he's found not guilty.

If he's "smart" he'll do the plea deal knowing that he likely won't get a fair trial anyway.

I'm pretty sure they can be used for recording.

Guards didnt check the memory

Just threw him in the cell without emptying his pockets first maybe and then didn't erase the memory.

That's my theory.

Unless it was faked, but he sounded quite authentic. His emotion anyway.

What these asshole border agents did will likely result in Canadian border agents giving American visitors the same treatment, with or without cause.

Sort of a tit for tat type situation I think. Canadians don't like being bullied, and their government usually sticks up for them in these types of situations I believe.

And as people here have rightfully noted, all of this trouble over a couple of Canadians who wanted to spend some of their money in a US mall, whereas truly malicious vermin are being allowed to overwelm the southern border states at will. It's insane, totally, absolutely, and outrageously insane.
