With seemingly never-ending angst and bickering over Arizona's recent immigration law SB 1070, proponents and supporters of the law have used several arguements in defense of it. ''It's 100% Constitutional, it simply mirrors existing federal law'', they insist. They will go on to assure that no 'racial profiling' is involved, that people won't be stopped based on race, and that people can only be asked for ID after they are stopped for legitimate and legal just cause, such as an alleged traffic violation.

This brings me to my question which addresses the very crux of the issue. Do supporters of this law believe that police were, until passage of SB 1070, legally and legitimately prohibited from demanding ID from those whom they lawfully detain?

If so, that is quite an outrageous and absurd contention. The fact is that police have always been lawfully allowed to request identification after legitimately detaining a suspect.

'But they had to do SOMETHING', they'll reply, 'the feds refuse to halt the hoards of illegals!'

While true, that the feds have purposely allowed massive illegal immigration for decades, please stick with the point at hand and simply address the question I am asking. Do you actually believe that cops across the United States have no authority to ask for ID unless each state legislature passes a 'special law' allowing them to do so? If you belive this, why do you believe it? Who taught you such nonsense? [article continues here

By far the majority of us who live in AZ support this law. We are tired of the rampant violent crime much of which is caused by illegals.

According to the Pew Hispanic Center, which like Stateline.org is funded by The Pew Charitable Trusts, the number of illegal immigrants in Arizona has more than quadrupled since 1996 -- from 115,000 then to about 500,000 now. By comparison, the number of illegal immigrants in the United States roughly doubled, jumping from about 5 million in 1996 to about 11 million today.

The upsurge of illegal immigrants in Arizona -- on top of an economic boom that caused the state’s population to increase more than 12 percent to almost 6 million since 2000 -- is severely straining prisons, schools, hospitals and law enforcement.

Some experts believe the conflict offers a glimpse into the future of American politics. Politicians in at least 11 states are pushing ballot initiative proposals similar to Arizona's ban on state services, and anti-illegal immigration measures increasingly are dividing statehouses from North Carolina to California.

Arizona’s turning point came last November when it became the first state since California in 1994 to adopt a ballot initiative, Proposition 200, that barred social services to illegal immigrants.

The measure, which passed with 55.6 percent of the vote despite opposition from both Democratic and Republican leaders, also makes it a crime for public employees to fail to report undocumented immigrants seeking benefits, and requires proof of citizenship to register to vote.

"(Illegal immigrants) can't come to America and get free stuff. It's just wrong. You've got to take their benefits away,” said Rep. Russell Pearce (R), who led the Prop 200 drive.

Unlike California’s initiative, Arizona's Prop 200 has held up in court. In early August, a federal appeals court rejected a lawsuit aimed at overturning it. Further legal action is expected.

The escalation in alien crime has placed added demands on state and local law enforcement personnel. Effective identification of aliens involved in crime requires familiarity with fraudulent documentation. Proper arrest procedures must be carried out, and complex notification and reporting requirements must be satisfied; otherwise, dangerous aliens can escape prosecution and deportation.

Handling the myriad problems associated with alien crimes is often beyond the capabilities of local police departments.

Some illegal aliens in the United States have been arrested and incarcerated in federal and state prisons and local jails, adding to already overcrowded prisons and jails. On April 7, 2007, the U.S. Justice Department issued a report on criminal aliens that were incarcerated in federal and state prisons and local jails.

In the population study of 55,322 illegal aliens, researchers found that they were arrested at least a total of 459,614 times, averaging about 8 arrests per illegal alien. Nearly all had more than one arrest. Thirty-eight percent (about 21,000) had between two and five arrests, 32 percent (about 18,000) had between six and 10 arrests, and 26 percent (about 15,000) had 11 or more arrests. Most of the arrests occurred after 1990.

They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien. One arrest incident may include multiple offenses, a fact that explains why there are nearly one and half times more offenses than arrests. Almost all of these illegal aliens were arrested for more than one offense. Slightly more than half of the 55,322 illegal aliens had between two and 10 offenses.

Criminal History

More than two-thirds of the defendants charged with an immigration offense were identified as having been previously arrested. Thirty-six percent had been arrested on at least five prior occasions; 22 percent two to four times; and 12 percent one time.

Sixty-one percent of those defendants had been convicted at least once; 18 percent, five or more times; 26 percent two to four times; and 17 percent one time. Of those charged, 49 percent had previously been convicted of a felony: 20 percent of a drug offense; 18 percent a violent offense; and 11 percent other felony offenses. Fifty-six percent of those charged with a reentry offense had previously been convicted of a violent or drug-related felony.

Many of the violent crimes being committed by illegal aliens are sexual crimes Researcher Deborah Schurman-Kauflin Ph.D. of the Violent Crimes Institute, reports on the analysis of 1,500 violent crimes from January 1999 through April 2006 that included serial rapes, serial murders, sexual homicides and child molestation committed by illegal aliens. The data is found in her report, The Dark Side of Illegal Immigration: Nearly One Million Sex Crimes Committed by Illegal Immigrants in the United States, which notes that, based on a figure of 12 million illegal immigrants and the fact that more of this population is male than average, sex offenders among illegal aliens are a higher percentage than sex offenders in the general population.

The study breaks down the 1,500 cases reviewed this way:

* 525, or 35 %, were child molestations * 358, or 24 %, were rapes * 617, or 41 %, were sexual homicides and serial murders

Of the child molestations, 47% of the victims were Hispanic, 36% Caucasian, 8% Asian, 6% African American and 3% other nationalities. In 82% of the cases the victims were known to their attackers. "In those instances, the illegal immigrants typically gained access to the victims after having worked as a day laborer at or near the victims' homes," she says. "Victims ranged in age from 1 year old to 13 years old, with the average age being 6."

In her examination of the sex-related homicides, Schurman-Kauflin noted:

"The murders were the worst of the sex crimes and were especially vicious. The most common method was for an offender to break into a residence and ambush his victims. Not only were victims raped, but some (6%) were mutilated. The crime scenes were very bloody, expressing intense, angry perpetrator personalities. Specifically, most victims were blitzed, rendered incapable of fighting back, and then raped and murdered. The most common method of killing was bludgeoning, followed by stabbing. Caucasians were more likely to become victims of sexual homicide committed by illegal immigrants. Hispanics were second, and African Americans were third."

Schurman-Kauflin states that the illegal alien population includes 240,000 sex offenders – a "conservative estimate," she says. She goes on to say, "This translates to 93 sex offenders and 12 serial sexual offenders coming across U.S. borders illegally per day." She points out the 1,500 offenders in her study had a total of 5,999 victims, an average of four victims for each sex offender and says, "This places the estimate for victimization numbers around 960,000 for the 88 months examined in this study."

Annualizing the results, that is 130,909 sex crimes committed annually by illegal aliens – crimes that never would have happened if they weren't here. This is part of the collateral damage of tolerating illegal immigration.

The affects of sexual crimes are far greater than just the crime itself. As noted in Victim costs of violent crime and resulting injuries:

"For example, an estimated 10 percent of rape victims suffer from severely disabling psychological injury, and 40 percent suffer from emotional distress severe enough to require mental health treatment beyond initial counseling."

Schurman-Kauflin concludes that illegal alien criminals "gradually commit worse crimes and are continually released back into society or deported. Those who were deported simply returned illegally again," she says.

The Schurman-Kauflin study noted that "Nearly 63% of the offenders had been deported on another offense prior to the sex crime." Note the word "deported," something that often comes up when we are talking about the crimes committed by illegal aliens. That means they were once removed from the country but came back in again to commit the crime! In this case, lack of any serious border security allowed the additional crime to happen – an additional 82,473 sex crimes – per year!

Is having 130,909 sex crimes committed against women and children per year acceptable collateral damage to tolerate illegal immigration and save ten cents on a head of lettuce?

When 63% sexual crimes are a result of basically having little to no border security, are 82,473 victims per year acceptable collateral damage for the savings of not having proper border security? If so, can you tell that to the victims and their families?

I understand we all differ to some degree on most issues. Your wife is an American citizen, I assume, so a DL would be more than adequate. It has come to this in border states; we either hold them for Americans, or succumb to an open border culture who thinks whites will tremble and open their wallets when the words racial profiling are tossed about. I HAVE NO MORE MONEY TO GIVE. I'm not buying their BS scare tactic, and anyone concerned about keeping the integrity of our borders probable would agree that some inconvenience beats bleeding to death. I don't have a better solution than simply asking people their status, secondary to a lawful investigation.
