COLUMBUS, Ohio — Ohio's highest court has ruled that a person may be convicted of speeding purely if it looked to a police officer that the motorist was going too fast.

The Ohio Supreme Court ruled Wednesday that an officer's visual estimation of speed is enough to support a conviction if the officer is trained, certified by a training academy, and experienced in watching for speeders. The court's 5-1 decision says independent verification of a driver's speed is not necessary.

The court upheld a lower court's ruling against a driver who challenged a speeding conviction that had been based on testimony from police officer in Copley, 25 miles south of Cleveland. The officer said it appeared to him that the man was driving too fast.

Well, equal rejection of the law would allow you to just shoot the JBT and file whatever paperwork is required at a future date as guilt is a foregone conclusion.

Which as we can all guess, will the be pedigree of every flatfoot who writes a ticket, whether he actually has the training or not.

What's the fine for "looks like you're going fast" anyway?

The court really munged this one up. They sometimes get it right, but not in this case.

The court really munged this one up. They sometimes get it right, but not in this case.

All courts operate a summary judgment system (commercial law) that silently recognizes your agreement to accept guilt regardless of anything else ... that's why they have you sign an "application" to conduct a privileged activity. As a result of signing the application and license you have unwittingly plead guilty to all future charges whether it seems that way or not.

If just 30% of the people who received tickets pleaded not guilty, and took the time to use every appeal available, the court system would grind to a halt and they'd be more cops in court than on the street.

EDIT: Speed not reasonable and prudent

The above law was in effect in NYC when I was on the job, so it's been around for who know how long. I'm thinking the Ohio decision was based on a ticket given under this statute.

Good man.

It's great fun to fark with the system isn't it? I mean what the hell, they fark with us all the time, might as well make their day as painful as possible.

When I was a student at OSU, back in the early 1990's, I went through the exercise of not allowing the school to use my SSN as a student ID. Stood in that office for a good ~3 hours. Started with just one peon, who had to escalate the request, then ended up with at least four of them paging through manuals looking for ways to force me to use my SSN as a student ID number. I won, they had to create a brand new number out of thin air, and they learned something in the process. I assume they did anyway. Nevertheless, I made their day really frustrating and felt that I had done A Good Thing (tm) by doing so.

If I ever get a speeding ticket again, I'm gonna take your route. Don't get tickets as a rule, I use an Escort Passport 9500i that sees cops as they're crawling out of bed in the morning so I'm always forewarned. :)

I assure you, they can find a way you're breaking the law on the road even if it takes them all day to look up the statute. Here in Buckeyeland it pays to have a great radar detector AND a CB radio with you at all times when driving. Otherwise, you're toast if you go 1 mph over the limit.

They've great one over here - they can only pull you over (checkpoints aside) if they believe you are driving "erratically". lol Swerving a little bit while adjusting environmental controls.. driving erratically. lol

Here in Buckeyeland it pays to have a great radar detector AND a CB radio with you at all times when driving.

Otherwise, you're toast if you go 1 mph over the limit.
