Justices rebuff Chicago, which defended ban as reasonable exercise of local power WASHINGTON — The Supreme Court ruled Monday that the Constitution's "right to keep and bear arms" applies nationwide as a restraint on the ability of the federal, state and local governments to substantially limit its reach. By a 5-4 vote split along familiar ideological lines, the nation's highest court extended its landmark 2008 ruling that individual Americans have a constitutional right to own guns to all the cities and states for the first time. In doing so, the justices signaled that less severe restrictions could survive legal challenges. The ruling involved a 28-year-old handgun ban in the Chicago area. The ruling was a victory for four Chicago-area residents, two gun rights groups and the politically powerful National Rifle Association. It was a defeat for Chicago, which defended its ban as a reasonable exercise of local power to protect public safety. The law and a similar handgun ban in suburban Oak Park, Ill., were the nation's most restrictive gun control measures. Monday's decision did not explicitly strike down the Chicago area laws, ordering a federal appeals court to reconsider its ruling. It left little doubt, however, that they would fall eventually. Justice Samuel Alito, writing for the court, said the Second Amendment right "applies equally to the federal government and the states."

It's a victory for white folks in Illinois. Most blacks that ignored the ban were already persons prohibited and will be unaffected by this or any other law, with the possible exception of Project Exile. This is where those caught committing crimes and in possession of firearms are sent to federal prisons on the opposite side of the country, "where dey mamas kint eezalee cum an' visit em". This law really did make a diff in Richmond, VA, and local street corner dealers started leaving their iron at home when faced with a mandatory 5 year sentence to be served "on the moon". The NRA took great pride in passing this law, failing to recognize that the feds would soon use it against honest folks who commit minor technical violations. The 20,000 plus gun laws now on the books would suffice if they weren't the first charges dropped in plea bargains. Prosecutors use the excuse that they often don't have a strong enough case to take to trial so they make deals. But the gun charges are almost always a slam dunk and they could go to trial on those alone if they weren't career climbing political assholes. "One must view any legislation in its worst possible light because history teaches us that this is the likely outcome."__Famous quote from I dunno hoo So, the State of Illinois will soon replace their onerous gun ban with an onerous sentence for "possession without a carry permit", and permits will only be given to the same people who get them now; cops, judges, politicians, banksters, diamond and jewelry merchants, and leaders of anti gun groups. (Nelson "Pete" Shields received a hard to get Delaware carry permit decades ago because of threats he received as the founder and executive director of National Council to Control Handguns, the predecessor to Handgun Control.)
Any chance these kaped kangaroos sent this back to feral appeals 'court' so as to stall it; so it comes back to a 'more anti-2A USSC' down the line here...?
