Judge Blocks Parts Of Arizona Immigration Law

AMANDA MYERS, Associated Press Writers

PHOENIX (AP) 53;

A judge has blocked the most controversial sections of Arizona's new immigration law from taking effect Thursday, handing a major legal victory to opponents of the crackdown.

The law will still take effect Thursday, but without many of the provisions that angered opponents — including sections that required officers to check a person's immigration status while enforcing other laws. The judge also put on hold a part of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.

U.S. District Judge Susan Bolton put those controversial sections on hold until the courts resolve the issues.

Opponents say the law will lead to racial profiling and is trumped by federal immigration law.

Stepping outside the merits of cracking down on illegal immigration and states rights for the moment, I had an interesting conversation about this law with a fellow libertarian. In his opinion this law's purpose was to skirt around the presumption of innocence rule. With this law you are presumed guilty until proven innocent. Interesting take on it. I find it hard to disagree.

That's the problem with a lot of laws they institute any more. They get you to agree with some wolf by clothing it in sheep's skin.

FF, this law is simple. If you're illegal in this nation, local cops have a right and obligation to investigate further, given the obscene economic burden Illegal’s have caused AZ & other border states. We either have immigrations laws or we don't. To those who oppose this simple law - one that every other 1st world nation enforces - they are now the enemy within.

Agreed but you are missing my point. At a traffic stop say of a Hispanic, asking him to prove his citizenship is by its very nature a presumption of guilt. You are assuming guilt based on his ethnicity. And while we may all agree that crack down on illegals is what we want, you know how the ruling elites are. They will twist this into something we don't want. They are taking something we desire and turning it into a way around a Constitutional principle.

Every time I am pulled over they ask for driver's license and proof of insurance. I don't think, golly gee, they must assume I don't have them because they are asking for them. Nope, I know that they are just checking to make sure I have them, they are not assuming anything.

The Arizona state's attorney said it would be impossible to use racially profiling in Arizona to ferret out illegals because Arizona has a significant legal Hispanic representation in its population. Illegals' race would not set them apart or send any red flags to LEO in a state like Arizona - ie. LEO couldn't use racial profiling in Arizona even if they wanted to.
