Judge Blocks Parts Of Arizona Immigration Law

PHOENIX (AP) 53;

A judge has blocked the most controversial sections of Arizona's new immigration law from taking effect Thursday, handing a major legal victory to opponents of the crackdown.

The law will still take effect Thursday, but without many of the provisions that angered opponents — including sections that required officers to check a person's immigration status while enforcing other laws. The judge also put on hold a part of the law that required immigrants to carry their papers at all times, and made it illegal for undocumented workers to solicit employment in public places.

U.S. District Judge Susan Bolton put those controversial sections on hold until the courts resolve the issues.

Opponents say the law will lead to racial profiling and is trumped by federal immigration law.

Stepping outside the merits of cracking down on illegal immigration and states rights for the moment, I had an interesting conversation about this law with a fellow libertarian. In his opinion this law's purpose was to skirt around the presumption of innocence rule. With this law you are presumed guilty until proven innocent. Interesting take on it. I find it hard to disagree.

That's the problem with a lot of laws they institute any more. They get you to agree with some wolf by clothing it in sheep's skin.

Asking someone if they have proof they are a US citizen, or are here legally, when it appears they are not, is not presuming they are guilty. It is merely enforcing the law, which is something that has not been done concerning illegal aliens for a long time in this country. If some libertarians had there way we would have no borders at all. That's why I am not a libertarian. Some of them are just plain nuts.

Really? And just how can you tell they are a citizen or not just by appearance? And you are by the very question assuming they are guilty and asking them to prove otherwise.

No, they are not assuming it, they are thinking there is a reasonable chance. If they assumed it, they wouldn't ask the question, they would just arrest them. Not hard to see the difference there at all.

Good post. The word "race" (which Hispanics aren't anyway) actually only appears once in the Constitution: the 15th Amedmdment regarding the voting rights of US citizens -- not presumed rights for illegals, who are by definition criminals, to be excused due to "race" or ethnicity from inquiry about citizenship status by Law Enforcers.

The Federal Government is only authorized to prohibit migration, not facilitate it for illegals, and to protect the States from invasion, not aid and abet invaders.
