The Amnesty Memo   [Robert VerBruggen]

According to an internal U.S. Citizenship and Immigration Services memo going the rounds of Capitol Hill and obtained by National Review, the agency is considering ways in which it could enact “meaningful immigration reform absent legislative action” — that is, without the consent of the American people through a vote in Congress.

“This memorandum offers administrative relief options to . . . reduce the threat of removal for certain individuals present in the United States without authorization,” it reads.

Also: “In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the issuance of Notices to Appear (NTA), and adopting significant process improvements.”

In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security head Janet Napolitano. “Since the senators first wrote to the president more than a month ago, we have not been reassured that the plans are just rumors, and we have every reason to believe that the memo is legitimate,” a Grassley spokesman tells NR.
(NR contacted DHS, but a spokesman did not have a comment on the record.)

Many of the memo’s proposals are technical and fine-grained; for example, it suggests clarifying the immigration laws for “unaccompanied minors, and for victims of human trafficking, domestic violence, and other criminal activities.” It also proposes extending the “grace period” H-1B visa holders have between the expiration of their visa and the date they’re expected to leave the country.

With other ideas, however, USCIS is aiming big. Perhaps the most egregious suggestion is to “Increase the Use of Deferred Action.” “Deferred action,” as the memo defines it, “is an exercise of prosecutorial discretion not to pursue removal from the U.S. of a particular individual for a specific period of time.” For example, after Hurricane Katrina, the government decided not to remove illegal immigrants who’d been affected by the disaster.

The memo claims that there are no limits to USCIS’s ability to use deferred action, but warns that using this power indiscriminately would be “controversial, not to mention expensive.” The memo suggests using deferred action to exempt “particular groups” from removal — such as the illegal-immigrant high-school graduates who would fall under the DREAM Act (a measure that has been shot down repeatedly in Congress). The memo claims that the DREAM Act would cover “an estimated 50,000” individuals, though as many as 65,000 illegal immigrants graduate high school every year in the U.S.

In the immediate wake of the court decision blocking the Arizona immigration law yesterday, the memo is sure to create controversy — and the sense that the administration is bent on preserving and extending the nation
s de facto amnesty.

Our borders have been erased by side deals like SPP that have been inked requiring the federal govt to ignore the Constitution and other "laws" that still exist in the people's minds but are a mere figment of their imaginations.

Washington, D.C., in collusion with JEW York "Gang-Bankers" (that means ALL OF CON-gress and the Federal Reserve Banks) have created a mirror image government that has usurped the legitimate Constitutional Republic.

No one here needs me to tell them that the legitimate government is dead, but how do we make others realize just how dead it is ?

I was talking to a friend about that just the other day. Some of the water agencies and their water service provider compadres, for example, are being so intrusive to customers' privacy in their homes and issue Draconian punitive threats if answers are not forthcoming blah, blah yet no legal group allied with consumer watchdogs seem to be challenging these constitutional violations for some reason. I think in Calfornia we even have written in our constitution home privacy rights and admin codes against gov't agencies coercing/collecting private info from residents that compromise privacy. But this is happening regularly and no one realizes and/ or has anyone to champion for them against blatant examples of gov't trampling on their constitutional rights.

In California I suspect a homeowner engaging in any self-defense clicking clicking would get his butt nailed in court by a DA on manslaughter or 2nd degree murder charges, particularly if the homeowner were Caucasian and the invader was a non-Caucasian being forced to steal and mug and kidnap to provide a better life for his family...

A full understanding of jury nullification remains our friend. People "like us" should be encouraged to fulfil jury duty. There isn't a chance in hell I could be persuaded to vote for guilt if I had the slightest doubt. I'm can be as stubborn as a mule.

That's correct, I live in central Ohio. Home of the heavily armed descendants of Germans and Irish immigrants. CCW and open carry are king, and you can readily defend your home. Hell, about 9 months ago (?) there was a quarter horse congress in town, and a woman attending was staying in a hotel, somebody from out of state broke into her room while she was there and demanded cash, she pulled out her own gun (that she carried in with her, she has a CCW, at age 70, lol), killed the intruders, and no charges were filed. :)

Jt - man oh man - you and I have some weird kind of ESP stuff going on - a week ago an evil disgusting "bad guy" was facing trial and the media were yakking about the charges and factors to consider re: the strength of the DA's case and suddenly I experienced a clear vision of how balance could be restored to our legal system by small simple actions by citizens at the very basic ground zero level...

So the next time I get jury duty summons, I must try to get SELECTED ( not the other way round) 'cause one of the reasons "bad guys" don't get Justice is due to the fact that it's mainly lame brain (leftie) morons who serve on juries, because for them jury duty's daily stipend is damn good pay, whereas educated smart people, who are gainfully employed, do everything they can to avoid jury duty. As it stands, the deck is always stacked against the DA right from the start.

Postscript: what I'm suggesting above obviously does not apply to the home invasion scenario - my jury duty suggestion applies to the majority of court cases that DA's try involving the seriously demented guilty fudgers whose lawyers work the system and twist law to their client's advantage so the "bad guys" do not suffer harsh consequences for their evil actions.

For those who need a reminder of why WE need to be selected to serve on a jury, if called:

One of the U.S. justice system's best-kept secrets is being leaked to the general public: Jurors do not have to follow the law.

While trial judges continue to read out traditional instructions that emphasize the juror's oath to follow and apply the law, a growing number of prospective jurors come to the courthouse knowing that if they don't like the law, they can ignore it. Spurred by acquittals in recent high-profile cases, legislators, attorneys, judges, and law professors are debating the controversial issue of jury nullification.

Nullification occurs when a jury refuses to convict a defendant even though the evidence seems to allow no other conclusion but guilty. The constitutional prohibition against double jeopardy makes the jury's acquittal irreversible.

The jury's power of nullification can be traced to medieval times. It was codified into English law after jurors in 1670 ignored a trial judge's instructions and voted to acquit William Penn of unlawful assembly. Nullification in American courts dates back to the colonial period and the acquittal of dissident John Peter Zenger on charges of libel. Later, northern juries nullified fugitive slave laws while southern juries nullified laws governing treatment of slaves. The U.S. Supreme Court recognized that judges have no recourse if jurors acquit.

There is a person I work with who is a total moron. He's in his early 30s, can barely read, can't do second grade math or follow instructions. I would guess his I.Q. is between 80 and 85.

A few months ago he got called for jury duty and had to be interviewed. We all laughed and said he would never get picked. Well, he did. We were flabbergasted.

Right there is an example. I still can't believe it.

He told me today that he was the real inventor of the X-Box but his buddy stole his blueprints and sold them to Bill Gates. Yeah, he's that stupid to think someone would believe that.
