The blog begs for controlled constraint.

Nor should my “making friends” to be misconstrued as building an army of freedom fighters… That would be insane. Large governments, with large, powerful and well equipped military forces are designed to fight “armies”. Tactically speaking, small units using a hit and run style can chip away the greatest of standing armies. But that is not my point here. Building a healthy relationship out there is difficult enough, but doing so here, on the inside of the razor wire is even more difficult. The reasons vary in nature and mostly deal with prison politics, and not because of what you first thought. I will remind you that over 85% of the prison population is in on drug-related crimes. And whose business is it what grown adults do with their own bodies? How many of you and your friends would be “locked up” if beer and liquor were still illegal? What if we included those who use tobacco products? Would you be ashamed to call them friends then? Have you ever even thought of it that way before? Where am I going with all of this? With everything? With these words, with these ideas, with my friends, my family, the movement, this country, the world…

If I were in his position, I would be advocating civil unrest. He understands that from a federal prison cell, his own Internet blog could be snapped in a heartbeat.

If I were in his position, I would be advocating civil unrest. He understands that from a federal prison cell, his own Internet blog could be snapped in a heartbeat.

He is, while inside, very vulnerable.

Maybe he should consider a radical series of prison letters. If they're political enough, like Gramsci's, he could become notorious enough to be mostly untouchable.

Rebel without a Clue

Sorry for the delay in posting about Reno Gonzalez’ sentencing but I got a little distracted this last month. Fortunately, an ace reporter named Margot Sanger-Katz was at the scene, and she made sure that you all got the big news by the following day.

While it’s too late for Reno to make smart choices in his life, for those of you who want to follow in his footsteps, a word of advice: If you’re trying to prove to a judge at sentencing that you are a peaceful man who poses no threat of violence to society, it’s best if you leave your temper at the courthouse door. Just a thought.

Reno is 31 years old, he’s balding quickly, and he wears his hair in a very long ponytail with the last few inches bleached blond. He was dressed in an orange prison jumpsuit, white sneakers labeled “1283; on the back, and leg shackles.

Contrary to the various recent court filings and MySpace updates posted by his family and friends, Reno had decided to retain his legal counsel for the sentencing.

The government’s case

The short version? The government said a few brief words to piss Reno off and then stepped back and watched him let loose on the judge.

The pre-sentencing report recommended a guideline prison range of 41 to 51 months. The prosecutor moved to have that range increased to 71 to 87 months, but the motion was denied by the judge.

The government offered no witnesses or exhibits, although the .50 caliber rifle was present in a corner of the courtroom. Instead, the prosecutor painted a simple story of man familiar with failure — Reno was expelled from high school at the age of 15, never kept a job more than six months and always blamed his employers for his professional shortcomings. To top it all off, Reno was asked to leave the navy for “fitness reasons.”

Reno had brought two weapons with him to the Browns, and then purchased the .50-caliber rifle in New Hampshire while he was living at their home. When Reno left, he took the rifle with him, so Jason Gerhard went out and purchased another .50-caliber rifle to replace it, since Ed’s plan required such a weapon be used. While in New Hampshire, Reno also purchased incendiary rounds and armor piercing rounds.

The prosecutor painted Reno’s time in Plainfield bluntly.

He failed at the Browns just as he had failed at everything else. Reno did nothing to withdraw from the conspiracy; Ed kicked him out of the house.

The prosecutor brought up an interesting new issue that Reno had admitted to when he took the stand during the trial. Ed Brown had shown Reno a prototype of the spring gun he wanted Reno to build. Reno said he wouldn’t build them because he was morally opposed to the use of mines. Reno, however, knowing that Ed was in the process of building such explosive devices, did not walk away from the standoff at that time, and did nothing to thwart Ed’s plan to set such deadly traps. Even though Reno was not indicted on the explosives charge, his own testimony could possibly result in additional charges.

The defense’s case

Reno’s attorney argued unsuccessfully that the maximum allowable prison sentence should be capped at five years.

He also claimed that Reno’s actions and choices were explained by his “distrust of the government, his opposition to income taxes, and his philosophy,” stating that events at Ruby Ridge were a factor in Reno’s decisions.

The judge was not amused.

So you’re saying that if someone sees Ruby Ridge, they can bring weapons to prevent Marshals from executing a valid arrest warrant? — Judge Singal

As the time for Reno’s allocution approached, his nerves started to show. His jumpsuit pant legs were too long and had to be rolled up, and kept interfering with his leg irons. His hands were shaking and he repeatedly squeezed own thumbs. Some of this anxiety appeared to pass to his attorney who clicked his Bic pen over and over while he walked around and explained his theory of the case to the judge.

The defense attorney claimed the “government got it wrong” when they said that Reno had gone to the Browns to act as security, which was a little odd considering that the judge heard several times throughout the trial in Reno’s own words that he traveled to Plainfield to provide security to the Browns.

The attorney closed with a plea for the judge to “sentence [Reno] for the man he is … the man he was before April to June of 200783; and recommended a sentence of time already served in prison.

The Allocution

Prior to sentencing, every defendant in federal court is given an opportunity to explain his acts. It is considered a personal statement, not testimony, since the defendant is not sworn in and the statements made are not subject to cross-examination.

All three of the co-defendants so far have used their allocution time as an opportunity to preach their Koolaid-induced delusions to the court and to an imaginary audience. Realistically, Danny Riley will do the same when his sentencing takes place tomorrow. When you’re a narcissist, that brief final time in the bright spotlight is just too tempting to pass up.

Reno started by reading an excerpt from a letter written to him by a close friend named Maria:

I know you’re the kind of person who can’t keep his mouth shut, but I wish you would just shut up.

Reno, of course, didn’t heed her wise advice.

He started by questioning whether or not the Judge had taken an oath of office, a futile effort considering that allocution is not a question-and-answer period with a judge.

He then proceeded on a rambling two-hour diatribe which was a mix of rage and theatrics. Instead of explaining his acts to the judge in hopes of persuading him to give him a lesser sentence, Reno went into full-blown performance mode, a tactic which made him look both desperate and pathetic. He kept turning around to address (and in a couple of instances, threaten) the audience instead of focusing on why he was there.

The judge, prosecutor, and defense attorney for the most part simply let him rant for the better part of two hours. The following are some of my observations from his lengthy and convoluted speech:

* Reno started by reading some of his own MySpace blog postings from the time he left the Brown house. When he read a passage that contained the phrase “Fu*k that”, he literally yelled it at the courtroom. This was the beginning of a long morning of expletives and words said in anger and hatred. * Reno pointed to a MySpace entry and complained that the prosecutors hadn’t introduced it into evidence. He seemed to think that it’s the prosecutors’ job to introduce exhibits for the defense to use. * He engaged in a lot of angry fingerpointing “this man” and “that man” in the courtroom, referring to the two prosecutors and a marshal. * He read the Bill of Rights aloud with details of how he was victimized by the evil government concerning each and every amendment. Considering that several of the amendments had nothing to do with Reno’s case, the exercise came across as desperate. For example, Reno complained that if he was such a dangerous man, the Marshals shouldn’t have allowed him to roam the country prior to his arrest, thus violating his right to travel. * He said that Ed and Elaine tried to get answers to their tax questions by suing the federal government in civil court, but that that “the government canceled that case and went after them.” Reno failed to mention that the criminal investigation was well underway when the Browns filed their civil suit (the IRS already raided the Brown house and business.) Reno also misrepresented what the civil suit entailed. Ed and Elaine didn’t sue the US government for answers to their questions; they sued four government employees for cold, hard cash. Reno also failed to mention that the government did indeed show Ed and Elaine the law prior to the start of their criminal trial. * Reno made the statement “I am not stupid,” ”I am not an idiot,” and “I am not a failure” numerous times throughout his monologue. He also claimed to be quite the computer expert and hacker. Must be that all that MySpace experience… * Reno complained that he had 31 witnesses lined up for his trial but that the government only paid to fly in five of them. He failed to mention that of the five they flew in, four - including his father, his brother, and Elaine Brown herself – took the 5th and refused to speak on his behalf. He also didn’t mention why the other 26 didn’t show on their own to defend Reno’s honor. Funny how people who were willing and able to drive to New Hampshire to party at the Brown house in 2007 couldn’t make the same trip in 2008 to help Reno. * Reno complained that everyone in the audience was against him, but didn’t seem to understand that it was irrelevant what anyone other than the judge thought of his speech. He said he was worried that the audience would believe that he would “fu*king get what he deserves.” * Finally, he did something that might have actually helped his case had he stuck to doing only that. He read letters of support from his friends and family. The letters from his childhood friends and neighbors were touching and talked about Reno as a young boy. The letters from fellow Brown supporters were quite the opposite; instead of focusing on Reno’s life and accomplishments, each letter focused almost entirely on the life of the person writing the letter. * He referred to the pre-sentencing report as the “government-upward-screwing-him-as-much-as-we-can report.” Apparently, no one told Reno that sarcasm and petulance don’t work at sentencing. * His summary:

I’d like to go home. If you want me to say I’ve learned my lesson, I did. I learned that you don’t fu*k with the government. — Cirino Gonzalez

* In a nervous fit of theatrics, Reno ripped up the Constitution and Bill of Rights. * He claimed that he has always treated the Marshals with respect, and stated that he does have training that can hurt people. * He warned the judge that he had better sentence Reno to time served or Reno would “bring more and more charges.”

The government offered no rebuttal. Frankly, Reno did a better job of making himself look angry, dangerous, and unrepentant than anything the government could have added.

The Judgment

The judge quickly went through the calculations he used to determine Reno’s final sentence. He recounted roughly a dozen times where Reno perjured himself on the stand during the trial and said that he found Reno to be a “serious danger to community,” an image Reno did his damnedest to prove during his three hours in court.

The Judge sentenced Reno to 96 months in prison with three years of supervised released. While the judge was reading the verdict, Reno was agitated. He tapped his toes, stretched his leg irons, and fidgeted throughout the brief verdict.

Post Judgment

After Reno was removed from the courtroom, his defense lawyer was visibly upset. It must be frustrating to watch your client repeatedly shoot himself in the foot on your watch. The only Brown supporter in the room was New Hampshire resident Joseph Haas, and when Haas started hovering around the defense attorney trying to discuss his theories about the case, the attorney finally broke:

Joe, you ruin people’s lives.

It was a chilling moment.

Were it not for Brown supporters like Reno and the freestaters, the Browns’ standoff would have ended months earlier. Were it not for Reno supporters like his family, girlfriend, and freestaters, Reno’s self-inflicted martyrdom wouldn’t have taken place. Reno showed up that day with a two hour speech prepared for the benefit of his supposedly loyal audience, none of whom even bothered to show up.

Brown shouldn't have had some renegade, gunner playing on their property is all. But the Brown's had a good case before the guns and lockdown.

I really think, if they hadn't acquiesced to the publicity further inciting punks [Reno] convincing them of a stand-off ... there could have been some sort of format about negotiation and restitution about their own property.

Should we overlook WACO and RUBY RIDGE ? The Brown's didn't start the fight did they ? The FEDS sent people to entrap Weaver, and outright attacked women and children at WACO ... before 9-11 gave them cause to eliminate consideration of the posse comitatus act.

Say what you will about the Browns and Rino in this specific matter but the truth is that a war is being waged by the FEDS against the very people that they're supposed to protect and ultimately there will be imprisonment and bloodshed.

"The "only" reason I harp on this point is that some of my best friends in this life and others with good intentions have gone to prison still pressing the Constitution to their breast as the beast laughed and slammed the cell door shut.
