He was known as "Speedy,” a jokester who liked to do back flips when he danced and hoped to make his mother rich by playing basketball.

From the time Antwun Parker was 3, he carried a backpack with his basketball shoes in it so he could practice on the spur of the moment, his mother, Cleta Jennings, said Friday. He was wearing the backpack when he was shot to death last week in a pharmacy hold-up attempt.

Parker fell in with the wrong crowd, his mother said, just weeks before he and an armed teen burst into Reliable Discount Pharmacy.

Pharmacist Jerome Jay Ersland, 57, has been charged with first-degree murder, accused of firing five rounds into the boy’s body as he lay on the pharmacy floor, having already been shot once in the head.

On Friday, prosecutors charged Jevontia Ingram, 14, Emanuel Mitchell, 31 and Anthony Devale Morrison, 43, with first-degree murder.

Jennings and family members talked about Parker as they gathered at the home of Jennings’ sister, Sharon Jennings, in northeast Oklahoma City.

Parker, the youngest of five children, was a ninth-grader at Seeworth Academy where he was trying to get his grades up so he could go to Douglass High School and play basketball, his mother said. He was a good player, she said. He usually had a worn basketball in his hands.

His aunt, Sheila Osborn of Florida, said she thinks people took advantage of a good kid.

"You can look at the video and you can tell he (Parker) didn’t know what he was doing,” Osborn said, referring to surveillance video that shows him putting on and then adjusting a ski mask before he was shot.

Cleta Jennings said she feels sad for Ersland and his family.

"I’m mad at that man,” she said. "I don’t hate him.”

(Oklahoma City, OK) -- Despite new medical examiner findings, first-degree- murder charges against pharmacist Jerome Ersland will stand and the case will go to trial. KWTV reports the ruling was handed down this morning. Defense attorney Irvin Box had argued for the charges to be dismissed. Ersland is accused of excessive force when he gunned down Antwun Parker during an armed robbery attempt in south Oklahoma City.

If he really "didn't know what he was dur'n," maybe he should have gotten involved in something a bit less hazardous to his health than robbing stores. It is always possible that whoever owns the store might believe that they have a right to actually SELL their stuff since they had to pay for it, instead of just hand it over to some punks who think someone owes them a living.

Well, as far as I am concerned he knew what he was doing well enough to know that he shouldn't be doing it. If he didn't know that he wouldn't have known that he needed a ski mask.

I'm not sure I'd vote to convict Ersland if I were on the jury.

But then, most prosecutors work hard to eliminate any juror with an independent mind or conscience, the same way police departments routinely do in discriminating against intelligent and moral persons (including Christians though a cop can be a Christian as long as he's a stupid Christian and doesn't apply any moral reasoning to his gestapo work).

I'm just about 100% certain I wouldn't. Someone comes into your store with a gun, obviously intending to rob you and maybe not wanting to leave any live witnesses--that's pretty much a no brainer.

There was a time when this would have been ruled "death as a result of his own misadventure", but in the second half of the 20th century we saw the law tightened, and citizens should now use only the minimum necessary force to protect themselves and others.

My state went from anti homeowner-anti armed citizen to a law that now says "whatever action a reasonable person would take" which includes reasonable persons under extreme duress.

For instance, one example was when a woman who was alarmed by a mentally retarded man screamed and her husband responded outside their trailer with a shotgun. The unarmed retarded man failed to stop when ordered to do so and was killed with a single shotgun blast, and the (antigun) AG did not file charges because the use of force was within the intent of the law (passed to prevent him and his deputies from persecuting law abiding folks who defend themselves with firearms)

I dare say that had the husband continued to blast away at the dead body of an unarmed retarded man that the law would not have protected him.

The moral of the story is "Use all the ammo you need (and fire twice in rapid succession-ammo's cheap! and remember, you were "trained to fire twice* into the center of mass where your rounds would be most effective") but not one round more if the assailant goes down!

And, as the deceased father of combat handgunning Jeff Cooper counseled, "Be shook until the press leaves then break out the champagne!"

It's important that we're never caught telegraphing our frustration with these goddam nig....I mean, under-privileged souls driven by desperation to crime. So, gratuitous rounds to make sure they're dead is out, fellas.

*You may even shoot three times-The Mozambique drill-but if you're being taped it had better be so fast and well executed that it appears to be the result of intensive training where "there was no time to think". Needless to say if under attack you fire as fast and as often as you need to (or like) until the threat is neutralized.

Also, it appears that the other robbers are being charged with felony murder, that is, if in the course of a felony someone is killed then the crims involved (or in this case the pharmacist) may be charged with FM, even if they never fired a shot or had guns in their possession.

This could also apply to you or me if we try to outrun the cops and one of them is killed in a traffic accident during the chase.....

Good advice. As I understand it, you can be charged with murder even if you didn't kill anyone or even have any means to kill them if you are involved in activity in which you know, or should know, that there is a substantial likelihood that someone could be killed (like a lookout for bank robbers, or driver, etc.). I don't believe the pharmacist should have been charged but under the theory of the law that I described I can see how "Antwun's cohorts" could be charged with murder.

OK Pharmacist Seeks Murder Charge Dismissal

The attorney for a local pharmacist, who made national headlines when he shot and killed a would-be robber, will ask a judge to dismiss the case.

Jerome Ersland's attorney says a new expert has reviewed the autopsy of the victim, 16-year-old Antwun Parker. State pathologist Dr. Chai Choi told his attorney that the first shot Ersland fired at Parker was fatal. The original report stated that the first shot was non-fatal. If that is true, the defense says Ersland shouldn't stand trial.

A local law expert says if the first shot was fatal, you can't murder a dead person.

"You're only allowed to use as much force as necessary to deter an attacker, so if the bullet did kill the person upon entry, then the charges probably should be dismissed," said Dr. Howard Kurtz from the Department of Criminal Justice at Oklahoma City University.

Ersland says two men tried to rob the Reliable Pharmacy in southwest Oklahoma City last May. The other teen, who had a gun, fled the scene.
