Since the framers of the Constitution unaccountably overlooked this question, the courts are hashing it out now. Keep your fingers crossed.
These issues are accounted for in the 4th, 5th, 6th, and 8th Amendments. It amounts to illegal search and seizure of our persons and effects and being put on a no-fly list so is cruel and unusual punishment resulting from a sentencing without trial. Neither was Bush empowered to create the Department of Homeland Absurdity unilaterally or to forego those Amendments in our Bill of Rights.
