Court gives death sentence to aide who persecuted Shiites

BAGHDAD - Tariq Aziz, the dapper diplomat and highest-ranking Christian in Saddam Hussein's regime, was sentenced Tuesday to death by hanging for persecuting members of the Shiite religious parties that now dominate the country.

The decision to execute the 74-year-old Aziz, who has suffered a series of strokes in prison, shows the depth of hatred among the country's current Shiite leadership for top figures in a Baathist regime that sent hundreds of thousands of opponents to death or exile.

Among Shiites in the eastern Baghdad slum called Sadr City, a gallows death for one of Saddam's ardent aides was considered a fitting end.

"This is a fair judicial court ruling against those whose hands are still bloodied," said Kamil Jassim, a 32-year-old teacher.

Many Sunnis, the minority Muslim sect that dominated Iraq under Saddam, questioned whether the death sentence was merely revenge masquerading as justice.

"The aim of this court, formed by this government, is to kill and liquidate all of the former regime's senior figures if they committed crimes or not. It is an unfair trial and unfair verdict," said Jameel Sahib Ali, a 50-year-old merchant in Saddam's hometown of Tikrit.

Aziz was wearing a blue suit and his trademark oversize glasses as he sat alone in court. He frequently grasped the handrail that surrounds the defendant's box and bowed his head as the judge read out the verdict.

Tuesday's proceedings, broadcast on state TV, came nearly 20 years after Aziz's meeting in Geneva with U.S. Secretary of State James Baker failed to prevent the 1991 Gulf War. Aziz also met with Pope John Paul II at the Vatican weeks before the March 2003 U.S.-led invasion in a bid to head off that conflict.

The Vatican spokesman, the Rev. Federico Lombardi, said the Vatican would lobby Iraq to halt the execution. He said commuting the sentence would encourage reconciliation and the rebuilding of peace and justice in Iraq.

No date has been set for the hanging, and Aziz's lawyer has 30 days to appeal the sentence handed down by a court responsible for prosecuting crimes committed by the former regime. The verdict came two months after Aziz was transferred from U.S. to Iraqi custody.

This fellow is guilty of being a high-ranking official of the Iraqi government under Hussein. And Hussein was very much supported and promoted by the US. He's accused to helping to cause events where about 50 people were killed. and there's no actual evidence that he did anything to help cause those events. Simply as a member of the government he's going to be hung for it.

It brings up the question as to how many of our high-ranking government officials would be hanged until death if the same standards were applied to our side. This is a political killing of Turiq Aziz. This is an obscenity.

If you try to understand the charges against this guy, apparently there were some merchants in Iraq arrested and executed in Iraq over the merchants selling goods at prices over and above what the government set in price controls. Well the price controls came from the economic sanctions. Many things were kept from Iraq by the US Navy and by US policy that convinced other nations not to sell to Iraq. As a result 1 million to 1.5 million Iraqis died of whom 95% were children 5 years old or younger. The Iraqi government executed merchants who took advantage in that situation. who is more guilty, the Iraqi government or the US government regarding the 1 million or more deaths from the economic sanctions.

Another great source of crimes by the IRaqi government were when Iraq struck back at those in Iraq who had rebelled against the government. Recall that elder Bush asked them to rebel against the government and implied that the US would help them. They rebelled. The US did not help. Saddam Hussein crushed them and killed some people.

I guess some people are more equal than others. We have the military power and have used it on them. This secures the fundamental rules that we are more equal and they are less equal.

This sentence is a the result of an old blood feud. Iran, through its Shia surrogates in Iraq tried to bump Tariq Aziz off in 1980 when Dawa Party agents threw a grenade at him in public. Aziz, born Mikhail Yuhanna, tried to quit his government post, but his resignation was not accepted by Saddam Hussein.

His diplomatic career does seem to have run at some remove from Saddam Hussein's machinery of repression, but as a Baath Party leader Aziz shares the blame for the political repression of the Shia by the Sunni dominated organization that gave him office. Nevertheless, there are grave questions about the justice of Aziz' prosecution and conviction.

Iraq is the original blood drenched battleground of Islamic schism. The religious antagonism and political enmity run deeper than Americans can imagine. We patched up our most violent national quarrel in a few decades. For these Muslims, ingrained hatreds come before family, before country, before life itself. What idiots we are to have believed that we could create New England town hall democracy in a place like this.

He [Aziz] was set to appear before the Iraqi High Tribunal set up by the Iraq Interim Government, but not until April 2008 was he brought up on any charges.[8] This changed when, on April 29, 2008, Aziz went on trial over the deaths of a group of 42 merchants who were executed by the Iraqi regime in 1992, after the merchants had been charged by the Iraqi regime with manipulating food prices when Iraq was under international sanctions.[21] The charges brought against Aziz were reported by The Independent to be "surprising" as the deaths of the 42 merchants had always previously been attributed to Saddam Hussein.[22] Never-the-less, on 11 March 2009 the Iraqi High Tribunal ruled that Aziz was guilty of crimes against humanity, and he was sentenced to 15 years in prison.[23] According to the BBC News, "there was no evidence that a Western court would regard as compelling that he had anything like final responsibility for the carrying out of the executions."[24] That same year, he was acquitted in a separate trial which concerned the suppression of an uprising in Baghdad during the 1990s.[23]

On August 2, 2009, Aziz was convicted by the Iraqi High Tribunal of helping to plan the forced displacement of Kurds from northeastern Iraq and sentenced to seven years in jail.[25]

On October 26, 2010, the Iraqi Supreme Court handed down a death sentence against Aziz for the offense of "persecution of Islamic parties,"[26] amongst them the serving Prime Minister Nouri al-Maliki's Islamic Dawa Party, following a crackdown on a Shia uprising after the 1991 Gulf War.[17] The Associated Press reports that "the judge gave no details of Aziz's specific role."[27] His lawyer stated that his role in the former Iraqi government was that of a traveling diplomat with no say in Iraqi domestic policy.[28] His lawyer further stated that the death sentence itself was politically motivated and that timing of the death sentence may have been aimed at diverting international attention away from documents released by WikiLeaks, which detailed crimes in which Maliki government officials have been implicated.[29] His lawyers have 30 days to lodge an appeal, following which the court would have another 30 days to look into the appeal; if the appeal is turned down the sentence would be carried out after another 30 days.[29] On October 26, 2010, the same day of his sentencing, the Vatican urged the Iraqi government not to carry out his execution.[27]
