Pueblo Politics: Court overturns Arizona's proof of citizenship requirement for voter registration

The Ninth Circuit Court of Appeals has overturned Arizona’s requirement that people show proof of citizenship to register to vote.

The split decision by a three-judge panel determined that the requirement to show proof of citizenship — passed by voters in 2004 — is not consistent with the National Voter Registration Act.

Associate Justice Sandra Day O’Connor, temporarily sitting by designation, and Circuit Judge Sandra Ikuta, with chief judge Alex Kozinski dissenting, said Prop. 200 creates an additional hurdle, while the national act is intended to reduce “state-imposed obstacles” to registration.

The majority noted that Congress was well aware of the problem of voter fraud when it passed the voter act, and built in sufficient protections, including applying perjury penalties to applicants who lie about their eligibilty.

The court determined Arizona’s polling place photo identification requirement, however, is a minimal burden and does not violate the Equal Protection Clause in the 14th Amendment.

Attorney General Terry Goddard’s office is still reviewing the decision and was unavailable for comment.

Secretary of State Ken Bennett said he does not anticipate that the ruling will make any difference in voting next week, since it wasn’t in place when registration closed Oct. 4.

Bennett said the state plans to appeal the ruling, adding he disagrees the documentation sets up a barrier for registration. “I think it’s an outrage and a slap in the face of Arizonans who are concerned about the integrity of elections,” he said. (1 image)

At this point in U.S. history, any State still believing they have State's Rights or that their State Constitution is still a valid document should be looking at THIS ruling.

States have NO rights. Neither do citizens.

Non-citizens however, have more rights than citizens.

With the extent of document fraud that we've witnessed, this ruling is dangerous. Let's look at the scenario:

- An illegal alien obtains a drivers license through fraud, obtains a fraudulent SSN and registers in his respective county.

- Said illegal alien then takes his fraudulently obtained drivers license to the local voting booth, presents it, his county registration is checked via database and he is allowed to cast a vote.

- Said illegal alien has just NULLIFIED MY LEGAL VOTE.

This illegal vote is sufficient to turn a close election.

Does anyone with an ounce of intelligence believe that fraudulent votes like this will be investigated and an election overturned? NO!!!!!

The first woman ever appointed to the supreme Court, Sandra Day O'Connor, is more of an embarrassment now that she is retired and serving as an ad hoc judge than even when she was Justice O'Connor. True, as Justice she participated in the shameful ruling in a Michigan Law School case, where she estimated that "affirmative action" might be needed until, say, 2025. Appointed by a Republican president, O'Connor joined the majority in a host of other arguably-incorrect constitutional interpretations.

But now....

She has helped overturn part of Arizona's Prop. 200, a State initiative passed in 2004 by a 56% vote including 47% of Hispanic voters. I was there, in Phoenix, on election day. Kathy McKee had brought the initiative process to fruition and the electorate showed their strong support. But O'Connor knows better than the people, or so O'Connor thinks.

this law should be upheld, since non citizens should have no right to vote. your gc comment is unclear though. the mexican consulate does not give out green cards (permanent resident card). that is issued by homeland security ICE. ( no longer called INS). the consulate issues a matricular, but i dont know what that's good for other than opening a bank of america account. in CA a matricular is not adequate to get a drivers license.

one time, at the immigration office, there was a guy at the window working on getting his wife approved. he sounded russian, was an older white guy. the person told him he did not file such n such required paper on time, so his wife can not stay in america. he started shouting that the immigration clerk told him his paperwork was in order, previously. it was sad. i thought they were going to taze him as he got more agitated. i told my wife, damn, see what you get for trusting some govt hack with your business. a lot of ppl hire expensive immigration lawyers to do it. they make it onerous for people who want to come legally. i did the work myself but paid very close attention to deadlines, forms, fees, requirements, etc. one screw up & youre done!

I wouldn't categorize it as "a statute". More like a Constitutional order to go directly to the USSC when a State is a party or be dismissed. If that's been brought up and ignored, all the more reason to ignore the Ninth Circuit Court of Appeals on this matter.

The Constitution is very clear that only the USSC has jurisdiction when a State is a party. The 9th Circus is a fitting description of their antics. Maybe we should send some lion tamers to tell them that they're out of order and liable to be held in contempt as a bunch of outlaws.

No matter what side of the political aisle you sit on, the federal government is not your friend. Its not a friend to the Constitution, and its certainly no friend to your liberty. For years and years and years, people have yelled vote the bums out! Call Congress now! March on DC! But, in the long run, little to none of this actually works.

If you oppose this national health care plan, they'll give you that one. If you oppose one war, you'll get another one. If you oppose today's bailout, they'll find a different one tomorrow. Decade in and decade out, the government keeps growing, and your liberty keeps shrinking. And it doesn't matter if the person in charge is named Obama, or Bush, or Reagan, or Clinton.

The bottom line? Looking to the federal government whether it's through elections, or protests, or lawsuits, or rallies is a failed strategy. So how about trying something new?

Nullification!

When I present my ID at the polls my registration is checked. This means I'm in the book as a registered voter, and I then sign a signature card which is compared to my signature already on file. (I don't have to use photo ID but I can use the card mailed before each election because of the signature card on file at my polling place)

Could it be that the drivers license is simply to verify that the person voting is the same registered voter already on the rolls in AZ?

In other words, if AZ's laws are the same as ours the process of verifying voter eligibility before election day is a separate procedure and unless those suspected "ill eagles" have previously registered they can't just pop over to the polling place and vote. They don't have open primaries or any other such liberal voting rules so I assume that AZ requires registration prior to election day at which time the voter fraud is facilitated by Hispanics who have already slipped under the wire and now work for the elections bureau.

I'm not certain of course but this may be a misunderstanding. No judge would rule that a state cannot verify voter eligibility because that would most certainly not survive appeal.

In theory: If the person with photo ID is already in the book as a registered voter then verifying citizenship at the polls would be a redundant and unnecessary hindrance. Naturalized citizens are entitled to equal protection under the law and should not have to produce extra paperwork because of their skin.

In practice: In my state black election workers knowingly allow black convicted felons to register-I witnessed it myself- so we can assume that corrupt Hispanic elections officials will do the same for all who cross El Rio Turdo and wish to register. When it comes to reducing whitey to 2nd class citizenship all minorities are "unified in the struggle." Once they outnumber European Caucasians they can concentrate on killing each other for control of the govt and resources and releasing all of the rapists and murderers who in "self defense and out of frustration," i.e. black rage & barrio defense "only attacked oppressive whites who stole Mexican land and who held the black man down all these umpteen hundred years."

EDIT: Remember the state troopers who were stationed at Florida polling places and the black folks who complained about it?

That's because who knows how many ex cons have been registered by their fellow neegrows and they're afraid that police officers who sent them up or know them as convicted felons may recognize them as they attempt to vote.
