In-state tuition for illegal immigrants is preserved with California Supreme Court ruling [Updated]

The California Supreme Court decided unanimously Monday that illegal immigrants may continue to be eligible for in-state tuition rates at the state's colleges and universities rather than pay the higher rates charged to those who live out of state.

In a ruling written by Justice Ming W. Chin, one of the panel's more conservative members, the state high court said a California law that guarantees the lower tuition for students who attend California high schools for at least three years and graduate does not conflict with a federal prohibition on giving illegal immigrants educational benefits based on residency.

California is one of several states that permit illegal immigrants to take advantage of lower college tuition for students who attend high school and graduate in state. About 25,000 illegal immigrants are estimated to receive in-state tuition rates in California.

A group fighting illegal immigration challenged the California law on behalf of U.S. citizens who pay the higher tuition as out-of-state students. The group won in lower court, and the state appealed.

maybe we should ask ourselves why there is money and effort put into such a lawsuit. but there is no effort to educate people that the problem is the government allows employers to hire illegals without penalties.

JT - it is easy to identify illegals. There is simply no effort or desire by authorities to actually stop illegals from coming here.

If we allow people into our country to live among us, then eventually they are going to be treated like us by us. Because our sensibilities demand it. We can't exist in a divided state where some among us are not full citizens and some are.

Republicans just picked up a lot of power in Washington. it is well known that the agenda of most republicans is to turn illegal immigrants into guest workers and then create a situation where every employer will be able to use guest workers if they choose. And we should not forget, the history, in 1986 it was Republican leadership in the US Senate who insisted that the immigration reform bill not force employers to avoid hiring illegals and punish them for doing so.

Overwhelmingly, the large percentage of our population wants to stop illegals. But because we as a people are so incredibly stupid and poorly informed we vote for the party that let them in and wants to let more of them in.

At the same time I can't honestly say the democrat party is a better choice. They are willfully dysfunctional on this issue.

Ronald Reagan was the 1 politician in my life that tried to provide good leadership on this issue. He said the solution was to forgive all the people who were here illegally, but had jobs and give all of them a choice of either US citizenship or go back home. But at the same time force the employers to hire only legals. Many ignorant americans say we tried that and it failed. We never tried. To this very day employers hire illegals every day and it is perfectly OK with the law to do so. It may be illegal, but it is very rare that an employer gets a penalty and the penalties are light.

Many Americans prefer to live in a dream-world and think that our government has tried to keep illegals out. No, the authorities have always been in favor of the illegal immigration. We the people have never had the decency to vote them out over it. This is how it is that 80% of our population wants to stop them and the government won't do it.

for people who have witnessed the changes to California as you have it is just as you say. California was an incredible place decades ago and very American.
