INDIANAPOLIS (AP) — The Indiana Court of Appeals has denied a defendant's motion to suppress evidence police seized under a search warrant that contained the wrong address because the officer who served it went to the right location anyway.

The judges reasoned in a ruling Monday that there was no chance of the warrant being served at the wrong address because Knox City Police Officer Chad Keen knew where he was supposed to go.

The ruling says that had Officer Keen not been the executing officer, the court may have reached a different result.

Donnie Salyer filed the appeal after a Starke circuit judge denied his motion to suppress evidence at a court hearing in 2009. The ruling clears the way for his trial on marijuana charges. Subscribe to *Jack-Booted Thugs*

Why did the IN court structure allow that appeals to begin with? They should have laffed at it... and disbarred the defense attorney.

I'm not quite sure what the fuss is about. The policeman knew he is authorized to search the dwelling of Mr. X, and it's Mr. X's dwelling that he goes to - perhaps without even looking for the house number - and it's Mr. X's dwelling that is searched. BFD.

There was a police case many years ago that involved criminals who deliberately put the wrong house number on their front door -- the sort of neighborhood where this could be done -- and, after the police arrested them with a search warrant, then referred to the official county zoning maps to show that the search warrant, although it gave the same number these crooks put on their front door, was not using the "official" and correct house number, and tried to get all the evidence from the search thrown out.
