Suburbs' red-light camera revenues on the blink

Fewer tickets, less money prompt some to take new look at enforcement

Former Bellwood administrator Roy McCampbell once compared red-light cameras to a lottery or casino — a "guaranteed amount of money."

But as the cameras reduce the number of drivers who roll through red lights, the number of $100 fines is also dropping.

In Bellwood, which in late 2006 became the first suburb to install the cameras, photographed violations brought in $1.1 million at their peak in 2008, instead of the projected $1.5 million to $2 million. Revenues dropped almost by half last year, and officials say net revenues this year are near $250,000.

"I don't think it ever got close," said chief of staff Peter Tsiolis. "If you are anticipating $1.5 million and get $250,000, yes, there is disappointment."

The village's experience is being played out in other suburbs that once promoted them as a safety device that could also generate millions of dollars. But the revenue they've produced often has been less than anticipated, sometimes much less.

The good news, officials say, is that red-light violations are down in many places, making streets safer. And since the ticket revenue was a budget bonus for most communities and because a drop-off was expected over time, Tsiolis and others say villages haven't had to cut services because of ticket-revenue shortfalls.

Nevertheless, the loss of income has some officials rethinking use of the cameras. Some driver and anti-tax groups have questioned the effectiveness of the enforcement tools in reducing crashes while raising money. A backlash prompted Schaumburg, Lombard and Bolingbrook to eliminate the cameras. Buffalo Grove officials recently decided not to install them.

Nabbed by a red-light camera in Northlake last year, Jill Dickerson, 45, of Elmhurst, admits she doesn't like them. Chastened by her experience, Dickerson is now leery of yellow lights.

"It's either slam on your brakes in the middle of the intersection or keep going," Dickerson said. "I think there have to be some judgments made that can only be made by a cop who is sitting there."

Some drivers and pedestrians, however, welcome the crackdown on red-light runners, and towns continue to deploy the cameras. River Forest added them last year, and Des Plaines and Highland Park wired their first cameras this year.

Nationally, use of the cameras is expanding. Almost 500 communities use red-light cameras, including more than 70 in Illinois, the Insurance Institute for Highway Safety reported.

My daughter in Rancho Cucamonga, CA received a traffic violation last year for a rolling stop; she received it in the mail about two weeks later and didn't even remember the incident; in her case the fine was 250 bucks.

She fought it in court. The case was dismissed.

Below is some great info on beating red light camera tickets for californians. The website, helpigotaticket.com, is a 100% free site where i learned most of what I know about beating tickets. I have beaten 8 of them so far using the free info at the site. One of those wins was in Superior court of appeals, where i had my conviction by a superior court judge (also in Rancho) thrown out by three of her bosses: a panel of 3 appelate judges in SB County. without a lawyer. i wrote the legal brief. it is a great site.

Red Light Camera Tickets Red light enforcement using cameras not only smacks of Big Brother, it also raises many legal and even Constitutional issues. The good news is that these tickets can be beaten.

The even more interesting news is that some of these "tickets" aren't even really tickets. If your "ticket" does not have the court address and/or tells you not to contact the court,you need to check out the information on fake/snitch "tickets" at highwayrobbery.net.

Since the government is not going to play fair on these tickets, why should you? Here is the tactical nuke to blow the case completely out of the court:

Your honor, I believe that if the people want to convict me of violating a signal, it is incumbent upon them to first establish that the signal was installed and operated according to the law. Indeed, this is their duty per Vehicle Code section 21455.5(c)(2)(C). Therefore, I request that (per People v Earnest (33 Cal.App.4th Supp. 18)) they produce originals or certified copies of all of the documentation required to install and operate a traffic control signal per Chapter 4 of the California 2003 Supplement of the Manual of Universal Traffic Control Devices (MUTCD).

This will require the officer to carry at least two binders full of certified documentation to court for each traffic signal, and the judge to spend about an hour reviewing the documentation before the trial can proceed.

Just in case the officer does bring the certified documents, you have the right to review and question the officer on each of them. This can easily take another few hours of the courts' time. As long as you keep your questions on point the judge has to allow them, or be overturned for denial of due process. (If even one half of 1% of the people who got these tickets would do this, the system would grind to a halt. They would not be able to afford to write these tickets. If you really want to fight back, this is the way to do it - take the profit out of the tickets for revenue scam.)

As a pre-emptive measure you can request all of the information under discovery. The form for this is on the Discovery page. The constructive notice in the form tells the DA that if he fails to comply, it will be deemed failure to prosecute. This means he can ship you two binders of documents or let you move to have the case dismissed. Hmmm...

Renee's brother (my son) pointed that same website out to her. Although she memorized the data presented, she didn't have a chance to present anything in her own defense.

Because she showed up at court, on time (although she waited for more than two hours) and dressed professionally, when the case was brought up to the docket, it was immediately excused.

Luck? Beats me. But, she pushed back on the system wherein most folks just pay the HUGE fine because it is otherwise annoying.
