The state of Montana, which came up with the idea that the guns made, sold and kept inside its borders simply are exempt from federal regulations and made that its law, now is considering a new weapon that could be used to cancel much of the authority of federal agents over its residents.

A new legislative proposal would declare that the state's local county sheriffs are the pre-eminent law enforcement authority in their jurisdictions, and federal agents such as those working for the Internal Revenue Service, Federal Bureau of Investigation, Drug Enforcement Administration, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and others, would be required to get permission from them before they could take any action.

The proposal, Senate Bill 114, is called "An act regulating arrests, searches, and seizures by federal employees; providing that federal employees must obtain the county sheriff's permission to arrest, search, and seize; providing exceptions; providing for prosecution of federal employees violating this act; rejecting federal laws purporting to give federal employees the authority of a county sheriff in this state; and providing an immediate effective date."

Inside that mouthful of provisions is a requirement that federal agents work through and get permission from sheriffs before taking any action to arrest anyone, seize any object or search anywhere. And it includes a promise of consequences if that is not followed:

I am at a disadvantage in this post. I thought that under the Constitution the federal gov't was confined in it's jurisdiction to the district of Columbia. I guess the Constitution has been so badly mauled by TPTB that this no longer applies. I'm Canadian, so badly out-of-date and uninformed, so please bear with me.

I want either less corruption or more opportunity to participate in it. Ashleigh Brilliant

The U.S. Feral Government has operations in all 50 States. It long ago overstepped the boundaries of the Constitution wherever the courts have been able to create an ambiguity (which is always resolved in favor of the Feral Government) or attempt to infer powers not clearly enumerated.

Thus the movement to push back Federal encroachment is just now taking off whereas it would have been better to do 50 years ago. However, better late than never.

That it is counterproductive in the main. All secession would do at this point is to give the fascist elements a license to engage in a war of suppression as they would call it revolt/rebellion.

Better I think is the path Montana is following - asserting their rights as a State, supremacy of authority within their State, and demanding that the Feral government return to the boundaries defined by the Constitution.

The last thing we need is a second Civil War.

Following this path provides them with no legitimate pretext for a military incursion and suppression of rights. It puts the Feds in a very uncomfortable position because their claim to legitimacy is the Constitution. By the States using the Constitution as a tool to force the Feds back within its confines hoists them by their own petard. It forces them to stop trying to re-make the cake. They can't have it both ways. Either they are legitimate under the document they cite as authority or they must give up the pretense of following it. At the moment they surrender that pretense their only option is force and without guarantee that the force will act as ordered.

The commerce clause does not confer the kind of universal authority on the Feds which they would like to assert. A strict reading is that it only applies to matters that are operating across State boundaries. It does not confer upon them the right to usurp the authority of local law enforcement. I think that is one of the reasons for all of the programs to big city law enforcement - to get their hooks in surreptitiously via money control i.e., "play ball or we'll take away your lollipop". Local law enforcement, like local education has fallen prey to this tactic. That is one of the reasons I have argued that the States should make it illegal for any state agency to solicit or to accept any Federal Grant without the specific approval of the State Legislature and signed by the Governor for that State.

We seem to be very close to that moment when they will abandon all pretense of legitimacy in order to further their agenda, martial law, dictatorship, NWO. Our troops are being held hostage in useless wars and will not have a choice when it comes to defending our country against domestic enemies or following orders.

I doubt that the finer points of the Constitution will hold these criminals back when they decide to act.

Nor the coarser ones. One of the functions of these Wars has been to assert control and authority over the National Guard in each State which heretofore was the province of the State Governor.

You can see them edging toward a complete takeover and lock down. However, they have not managed to subdue that spirit of independence in a sizable portion of the population. Yes, the Sheeple will do as they are told but the Sheep Dogs will not. And they are much more worried about the Sheep Dogs because they WILL bite.

It takes no more than about ten percent of the population to say NO and mean it for their putsch to fail, and at this point they are probably looking at more like twenty to twenty-five percent who will not play along, and some of the Sheep will follow that lead. The NWO is verrry dangerous, but in some ways they are a paper tiger as much of their control rests on people going along. At the exact moment when widespread resistance settles in they lose that control. Yes, they could then try to engage in wholesale slaughter, and some of the military and Blackwater would back that play, but the problem is that the moment they play that card their lives would need much heavier security 24/7 and they, the NWO leadership, are like Stalin - physical cowards. A MAN will die defending freedom. How many are willing to die for tyranny?
