FORT CAMPBELL, Ky. (AP) — One of four U.S. soldiers accused of raping a 14-year-old Iraqi girl last spring and killing her and her family pleaded guilty Wednesday, and agreed to testify against the others.

Spc. James P. Barker agreed to the plea deal to avoid the death penalty, said his civilian attorney, David Sheldon.

The military judge presiding over the case, Lt. Col. Richard Anderson, asked Barker why he participated in the attack in Mahmoudiya, a village about 20 miles south of Baghdad. It was among the worst in a series of alleged attacks on civilians and other abuses by military personnel in Iraq.

"I hated Iraqis, your honor," Barker answered. "They can smile at you, then shoot you in your face without even thinking about it."

Anderson accepted the plea agreement, which calls for Barker to serve at least life in prison. The judge will decide in a hearing Thursday whether Barker should be allowed to seek parole.

Sgt. Paul E. Cortez, 24, and Pfc. Jesse V. Spielman, 22, members of the 101st Airborne Division with Barker, also are charged in the case. Cortez deferred entering a plea during his arraignment Wednesday morning. Spielman will be arraigned in December. The fourth soldier, Pfc. Bryan L. Howard, 19, also deferred entering a plea at his arraignment in October.

A fifth person, former Army private Steve Green, 21, pleaded not guilty last week to civilian charges including murder and sexual assault.

Green was discharged from the Army for a "personality disorder" before the allegations became known, and prosecutors have yet to say if they will pursue the death penalty against him.

The group is accused of raping the girl and burning her body to conceal their crimes, then killing the girl's father, mother and 6-year-old sister.

After entering his plea Wednesday, Barker gave the court a vivid account of the events.

Barker said he and the others were drinking and playing cards while they manned a traffic checkpoint. Green brought up the idea of raping the girl and killing her family, he said.

"He brought it up to me and asked me what I thought about it. At a couple of points, I told him he was crazy," Barker said.

Barker said he and Green then approached the others with the idea, but there never was a verbal agreement to do it.

"Things just got set in motion, we just started changing (clothes), myself, Cortez and Green," Barker said. "By the time we started changing clothes, it was more or less a non-verbal agreement that we were going to go along with what we were discussing."

Barker said he, Green and Cortez raped the girl, and Green killed the girl, her parents and her sister.

Barker did not name Spielman and Howard as participants in the rape and slayings, though he said they were at the house when the assault occurred and had come knowing what the others intended to do.

Under military law, soldiers who are present when a crime is committed can be charged with that crime even if they did not play an active role.

Cortez, who could face the death penalty if convicted, and Howard watched from the audience as Barker described the assault. They were accompanied by their defense attorneys and declined to comment.

Military the world over is taught one thing....HATE....hate your enemy and we will tell you who your enemy is. Those that are olde enough and wise enough to recall the words of General Patton, will remember these words, "kill the other poor SOB before he kills you".

Last week, I talked with a combat vet of both these hellholes, and his judgment was that these guys were "weak, weak in the head." We see that their own comrades in arms judge them.

And the system will have to judge them also. No army on an adversary's turf can long persist when its members act like hyenas and prey on the civilian population in this fashion.

That the men and women who sent them there are as guilty is not an excuse nor is it exculpatory. Not in the least.

Yes the planning of the Pentagram and our so-called leaders is evil and immoral. It is the plans of sick and distorted men and women, but that is not the issue here. The issue is the actions of these accused young men for whom there is no excuse. As randge rightly pointed out they were NOT defending their lives. Fear of being killed is not an excuse for raping and murdering a 14 year old girl.

I don't know what the standards were when you walked the walk but I did not wear the uniform to be presented with an excuse to rape and murder a 14 year old girl.

You are allowing your affections for the deluded young men in uniform to shift your view from the realities of what has occurred here.

And while your friend may well have defended his life in combat that is not related to the question of how would Americans react to invasion and occupation by a foreign power.

They would fight back in any way they could, and would do so in honor justified in their actions to repel an invader just as the Iraqis are doing in attacking the invaders sent by a corrupt American Government.

Prior to the salacious assault upon Iraq it was building toward first world status with one of the best medical and educational systems in the Middle East. It is now a war torn third world wreck of warring tribal groups and invading troops who are there based on lies.

There is nothing moral or just in the U.S. presence in Iraq.

There is nothing which excuses the behavior of these young animals in uniform. The uniform is no excuse, being in fear for their lives from Iraqi Resistance fighters is no excuse. What they did by any calculus of decency merits hanging from the nearest tree.

I opposed this war from the time it entered the public awareness and named then its supposed rationale a lie. Millions entered the streets in protest and the controlled media did everything they could to not cover it or minimize the numbers who stood up.

Under protest, and yes they are animals. Only animals would rape and murder a 14 year old girl, and then murder her family, including her 6 year old sister, to cover up the crime. There are no number of sophistries you can engage in which change those FACTS.

Hanging really is too good for them.

And trying to justify it on the grounds that war is immoral and almost always wrong is not a valid justification. It is merely an acknowledgment that war is little more than the dramatizations of mass insanity.

Yes, most soldiers and Marines merely want to survive the experience but the numbers of suicides and those who have become human wrecks through drug use, legal and illegal, is testament to the lengths they will go to deaden the pain of having taken part.

The victims were not asking for trouble or even remotely engaged in threatening behavior.

The perps were just daydreaming about raping a little 14 year old girl while on duty. Then they got off duty, changed their clothes, and made their way to the girl's residence.

They got there, raped the little girl (with her family there), then killed her, her parents, and her 6 year old sister, then set the place on fire to cover their crimes.

That is not an honorable or forgivable set of actions, no matter WHO the hell they are. They were in fact supposed to be "liberating" those people from oppression, one of the stated reasons of them being there in the first place.

Sure, we can look back through history and find other examples of such evil deeds, but it doesn't make it right nor does it excuse their barbaric acts.

So no, I DO NOT vote for the bastards who send us off to self defeating military "actions" where we have no right to be nor even any good reason for being there at all.
