Michigan: Police Search Cell Phones During Traffic Stops
ACLU seeks information on Michigan program that allows cops to download information from smart phones belonging to stopped motorists.

CelleBriteThe Michigan State Police have a high-tech mobile forensics device that can be used to extract information from cell phones belonging to motorists stopped for minor traffic violations. The American Civil Liberties Union (ACLU) of Michigan last Wednesday demanded that state officials stop stonewalling freedom of information requests for information on the program.

ACLU learned that the police had acquired the cell phone scanning devices and in August 2008 filed an official request for records on the program, including logs of how the devices were used. The state police responded by saying they would provide the information only in return for a payment of $544,680. The ACLU found the charge outrageous.

"Law enforcement officers are known, on occasion, to encourage citizens to cooperate if they have nothing to hide," ACLU staff attorney Mark P. Fancher wrote. "No less should be expected of law enforcement, and the Michigan State Police should be willing to assuage concerns that these powerful extraction devices are being used illegally by honoring our requests for cooperation and disclosure."

A US Department of Justice test of the CelleBrite UFED used by Michigan police found the device could grab all of the photos and video off of an iPhone within one-and-a-half minutes. The device works with 3000 different phone models and can even defeat password protections.

"Complete extraction of existing, hidden, and deleted phone data, including call history, text messages, contacts, images, and geotags," a CelleBrite brochure explains regarding the device's capabilities. "The Physical Analyzer allows visualization of both existing and deleted locations on Google Earth. In addition, location information from GPS devices and image geotags can be mapped on Google Maps."

The ACLU is concerned that these powerful capabilities are being quietly used to bypass Fourth Amendment protections against unreasonable searches.

"With certain exceptions that do not apply here, a search cannot occur without a warrant in which a judicial officer determines that there is probable cause to believe that the search will yield evidence of criminal activity," Fancher wrote. "A device that allows immediate, surreptitious intrusion into private data creates enormous risks that troopers will ignore these requirements to the detriment of the constitutional rights of persons whose cell phones are searched."

The national ACLU is currently suing the Department of Homeland Security for its policy of warrantless electronic searches of laptops and cell phones belonging to people entering the country who are not suspected of committing any crime.

Make a Faraday Cage Wallet

Those pesky RFID chips. RFID tags identifying who and where you are can be found in passports, ATM cards, credit cards and some state-issued ID cards. The same technology will possibly even be used in paper money in the near future.

With the right equipment, these chips can be read from afar by data snoops or your friendly government official. A Faraday cage is sufficient for blocking such eavesdropping.

Here's how to hide yourself from both the baddies and The Man.

What You'll Need Duct tape Aluminum foil Scotch tape Ruler Packing tape (optional)

How To Proceed Step 1: Make the main pocket Make the paper money pocket. Layer strips of duct tape to make two sheets, sticky side up, each roughly 7.5 inches by 6.3 inches.

Step 2: Add the metal shielding Cut two pieces of aluminum foil, each roughly 6.8 inches by 5.5 inches. The foil should be slightly smaller than your sheet of duct tape. Place each sheet of aluminum foil on each sheet of duct tape. Stick Scotch tape on each sheet of aluminum foil to secure it.

Step 3: Make a sandwich Stick the two sheets of duct tape together, with the foil on the inside. This makes sort of a tape-and-foil sandwich.

Step 4: Construct the billfold Fold the sheet in half, lengthwise, and tape the edges together.

Step 5: Make a credit card pocket Cut two pieces of duct tape, each around 4 inches by 2.3 inches. Cut a piece of aluminum foil slightly smaller, and make another duct tape and aluminum foil sandwich. Use smaller pieces of duct tape to tape the credit card pocket on an inside flap.

Step 6: Make an ID card pocket Cut a piece of packing tape roughly 4 inches by 2.3 inches. Fold the sticky sides together to make a clear plastic window. Use smaller pieces of duct tape to secure the window to an inside flap.

Step 7: Test your wallet Put your cell phone inside and close the mouth of the wallet. If it doesn't ring when you call it, your wallet works! Posted by greathierophant@yahoo.com at 11:12 AM

Good idea, but regarding the article, I do hope everyone realizes the mofo's need a search warrant to do your phone. We all knew the time would come to insist that the oinkers get one BEFORE a search, and that time has come. When traveling, bring a radio, a few soda's and some snacks. You'll need them as the pigs take their time TRYING to get a warrant.

I ditched Sprint and got Mrs.L a jitterbug.com cell that has 50 minutes/month (she might use 10 on a talkative month) at a cost of $14.99 + the taxes/fees/etc.

The total monthly nut is $18.41 which is not outrageous.

And the phone is great.

Thanks for those points. I have put them into my program. It's been years since I've been stopped, but the way things are going these days, it pays to be prepared.

Not quite following you, PSUSA.

The vid id good, *especially* the part where the kid locked the car door and refused consent to a search. What I offered is if they do in fact get a warrant, you have a right to know the basic "what and where" part. If they refuse to answer that, whatever comes up is inadmissible (or was, once upon a time)

Re: #3, They're obviously not going to call their supervisor, so what should be the expectation there?

1) He has to be specific as to what it is he suspects is illegal and to where he suspects it to be. Is it a gun? Drugs? A body in the trunk? I doubt this requirement has changed since my day.

2) I'd bet they do call if you insist, and if they refuse, ask why not? Ask for his supervisor's name and the reason they can't come. Ask if they have come upon request in the past, and if so, why is this different?

What this kid did real well was stay calm and in control. He alone spoke, and was brief and specific. He showed respect while the cop became so frustrated, he finally made the decision to go find a softer target.

Had the cop asked for the kid's car keys, the reply there would be why? If the cop said I'm going to search your car, tell him no, and refer him back to the need for a warrant.
