Oak Park Woman Faces 93-Days in Jail For Planting Vegetable Garden

OAK PARK, Mich. (WJBK) - "The price of organic food is kind of through the roof," said Julie Bass.

So, why not grow your own? However, Bass' garden is a little unique because it's in her front yard.

"We thought it'd be really cool to do it so the neighbors could see. The kids love it. The kids from the neighborhood all come and help," she said.

Bass' cool garden has landed her in hot water with the City of Oak Park. Code enforcement gave her a warning, then a ticket and now she's been charged with a misdemeanor.

"I think it's sad that the City of Oak Park that's already strapped for cash is paying a lot of money to have a prosecutor bothering us," Bass told FOX 2's Alexis Wiley.

"That's not what we want to see in a front yard," said Oak Park City Planner Kevin Rulkowski.

Why? The city is pointing to a code that says a front yard has to have suitable, live, plant material. The big question is what's "suitable?"

We asked Bass whether she thinks she has suitable, live, plant material in her front yard.

"It's definitely live. It's definitely plant. It's definitely material. We think it's suitable," she said.

So, we asked Rulkowski why it's not suitable.

"If you look at the definition of what suitable is in Webster's dictionary, it will say common. So, if you look around and you look in any other community, what's common to a front yard is a nice, grass yard with beautiful trees and bushes and flowers," he said.

But when you look at front yards that are unsightly and overgrown, is Bass' vegetable garden really worth the city's time and money?

We asked Rulkowski what he would say to those who feel this is ridiculous.

"I would argue that you won't find that opinion from most people in Oak Park," he responded.

"I have a bunch of little children and we take walks to come by and see everything growing. I think it's a very wonderful thing for our neighborhood," said neighbor Devorah Gold.

"They don't have (anything) else to do (if) they're going to take her to court for a garden," said neighbor Ora Goodwin.

We did find one neighbor who wasn't a fan and thinks it needs to go.

"I know there's a backyard. Do it in the backyard," he said.

"They say, 'Why should you grow things in the front?' Well, why shouldn't I? They're fine. They're pretty. They're well maintained," said Bass.

It looks like this critical debate is headed for a jury trial and neither side is backing down.

"I could sell out and save my own self and just not have them bother me anymore, but then there's no telling what they're going to harass the next person about," Bass told us.

There's another pretrial scheduled for July 26. The next step could be a jury trial.

In Europe this is beyond common.

I have on in my neighborhood. Looks strange but you get used to it. whether I like it or not is irrelevant. I would never think to make an issue of it by calling the "authorities". All though I did finally call on the barking dog and you know what I was told? They don't deal with those any more because of budget cuts.

Here in Eugene Oregon many in the Whitetaker neightborhood plant gardens, have chickens and even plant veggies in the right of way strip between the road and sidewalk with the idea that if someone wants and needs vegitables, they are there if they want them.

In WW II what she did was called a 'Victory Garden.' There is not going to be 'victory' in that community until the fascist oppression of citizens stops being the law of the land there.

this reminds me of an episode of This Old House. They were doing one in a historic district in New England. Because this was a historic house they researched the original color of the house and picked a color from that era. The historic commission had to approve the colors and they almost didn't because people expect white on old New England buildings. So much for historical integrity. It was all about perceptions.

It's like saying you can't eat cold pizza for breakfast because it isn't breakfast food.

When my family moved to Clinton Connecticut from North Branford, CT we build a nice New England style home with bow windows, a breezeway and large garage.

It was built in 1962 and was white with green shutters.

When I visited it last it had black shutters because the house warden in Clinton ruled that because it was a classic New English design, black was more appropriat for the shutters.

You are correct. We took pains to do the colors right when the house was first built. The shutters even have hinges unlike most mock p shutters of that erqa. And the thermopane windows had crafted wood frame mock ups installed to make the windows look like they were windows of the colonial era.

THe oak floors on the first floor are wider then 1960s average, and the stone floor in the foyer was done by a guy in his 70s who knew the old way of doing flagstone in classic houses.

It also has a hearth made the old way. It was a very expensive home for 1962, it cost 80,000 dollars. Add a few zeros and you would approach the figure of what it's worth today.

It also has a "Built in 1962 by the McCarthys" like many classic fine homes in New England do on the front of it.

There is an old homestead down the road from that home also on Cow Hill Road, Clinton, CT called "the Steven's Homestead." It was built in 1630. It has a widow's walk on the top that they used to watch out for British ships nearing Clinton Harbor during the Revolutionary War.

It creaks inside like a sinking ship on hot days as the massive hand hewn planks and beams in it expand and contract. It is no wood bubble of a home like we build now a days.

A Californian couple bought it in 1971 and the guy started installing aluminum siding on it. He was quickly narced off and the House Warden served him with a stop work order.

In fact the guy was treated like an ax murderer over this. He was required to buy special cut boards to match any wood replaced in it, and residents of Clinton who have been there for generations snubbed these people very coldly.

Last time I was back I learned they had moved three years after we did, and the House Warden inspected during the escrow period of the sale and the violations that had to be fixed destroyed any profit they made in geting rid of the place.

Despite the fact that city authorities have temporarily dropped a case against Oak Park resident Julie Bass for growing a vegetable garden in her front yard after the story received nationwide attention, Bass has now been hit with a new criminal charge for owning unlicensed dogs, clear evidence says Bass that she’s the victim of a vendetta.

After Oak Park City failed in its bid to charge Bass with violating a local ordinance for using her front garden to grow organic vegetables, no doubt put off by gargantuan media attention on the case, they are now pursuing Bass for a similarly ludicrous misdemeanor that carries an identical penalty, 93 days in jail, for owning unlicensed dogs.

However, Bass’ dogs are fully licensed, the city is merely reinstating an earlier charge that Bass has already complied with.

This tells us two things – one that the city is blatantly pursuing a malicious vendetta against Bass for making a mockery of their petty ordinances, and two that enforcement officials must have been spying on her before the unlicensed dog charge was invented.

Having dropped the garden case because of the “heat of the spotlight,” Bass’ attorney Solomon Radner calls the newly reinstated dog charge “a very dirty move,” adding that he wouldn’t be surprised if both charges were pursued once media attention has waned.

“Charges are dropped for the time being,” Radner said. “Based on the games the city has been playing, I would not put it past them to drop the charges just to get the media off their back.”

Writing about the new development in the case on her blog, Bass explains how the dog charges are “just plain malicious” and evidence of the fact that local authorities have been spying on her house.

“The idea of the code guy snooping in our backyard or, worse, peering into the windows of our house is creepy- to say the least,” writes Bass.

“But back to why it is malicious: the only way for the code official to determine whether or not our dogs were licensed was to go through the city records and check. Why would he have been looking this up? Please remember that the dogs were clearly on our property and in our control at all times, so this is not a case of the city finding a dog and checking to see if they have it on record. The ONLY reason i can think of why they would have been checking on our dogs is to have more ammunition against us.”

Bass says the new charge is merely an effort to “dig up other dirt on us” as a punishment for the embarrassment the garden fiasco caused city officials, emphasizing the fact that the dogs are in fact licensed already.

“Because almost a month to the day after we paid for the dog licenses, the prosecutor decides to reinstate the ‘no dog license’ charges that we had already taken care of….and it happens to be on the same day that they quietly and sneakily dismissed the garden charge for now at least,” she writes.

Bass also emphasizes how the original charges pertaining to her vegetable garden have not been dropped completely.

“We weren’t actually cleared of any wrongdoing. the charges have not been settled in a way that gives us any assurance at all of them not coming back the second the media spotlight is off of oak park,” she writes.

Bass’ case has become a nationwide bellwether for the resistance to big government and highlights how Americans are being gelded into subservience by a tyranny of bureaucracy and micromanagement. Sustained media spotlight needs to be maintained on the issue in order to prevent authorities from running roughshod over Bass once the heat is off.
