LANCASTER - A 59-year-old Acton man who was convicted last month of a dozen misdemeanor counts for building a sprawling compound he dubbed "Phonehenge West" today was ordered taken into custody. Superior Court Judge Daviann Mitchell ordered Alan Kimble Fahey to be remanded in lieu of $75,000 bail pending his sentencing, which was postponed to July 22.

The judge determined that Fahey had failed to comply with the conditions for his release on his own recognizance, which included removing people from unpermitted structures and turning off the power, Jane Robison of the District Attorney's Office said.

Fahey was convicted last month of 12 misdemeanor charges, including 10 counts of maintaining unpermitted structures and one count each of failing to stop construction after getting a written stop-work order and unlawfully installing electrical wiring.

Jurors deadlocked on three other counts.

Prosecutors argued that Fahey was ignoring Los Angeles County codes at his 20,000-square-foot compound, feeling he was above the law.

But Fahey's attorney, Jerry Lennon, argued that Fahey had created a unique compound and the county should show some flexibility.

"He's not hurting anyone, and I don't think there's a mechanical or structural problem he can't resolve," Lennon told the Los Angeles Times.

Deputy District Attorney Patrick David Campbell argued, however, that Fahey's property was inherently unsafe. (1 image)

If this had been built in 1889 it would have been declared a "historic site" by now and the state would have spent millions of $$$ to preserve it and make it safe for eleventy-billion tourists to be herded through and tacky souvenir shops would dot the property. As for Alan Kimble Fahey: he would have been declared (posthumously, of course) a "talented genius for his time" and school- children would be given lessons detailing his eccentricity that stand as an example of the classical, stereotypical "rugged individual" that made this nation great.

Eccentrics and visionaries used to be regarded as...

...well, eccentrics and visionaries.

And as long as nobody was hurt they were pretty much left alone. They were not harassed, and the passage of time told whether it was the visionary or the eccentric part that was proved true.

And that's all there was to it.

A few people on board have begun to pick up a slight hiss in the background, to observe a faint haze of mist in the air or on their glasses, to note that the river current seems to be running slightly faster. But no one yet seems to have realized that it is almost too late to head for shore." -- Historian and author Chalmers Johnson"

I agree.

Case in point: Simon Rodia's Watts Towers, Los Angeles.

Not sure if Mr. Fahey measures up to a Rodia-like standard (of socially acceptable/historically significant "eccentricity," such as Rodia), but I certainly wouldn't jail the poor guy for exploring his vision.

What is wrong with this country?

joke/comment from christwire.org -

Jesus is walking around with Moses playing a round of golf and they come upon a water trap. Jesus turns to moses and says, “Didn’t you do something with water?” and Moses says yeah, and proceeds to do the trick where he parts the waters.

Jesus is impressed, and Moses in turn asks, “Didn’t you also do something with water?” Jesus proceeds to step out onto the water, but he sinks almost immediately to his knees. He gets out, gets a running start, and tries again, this time sinking to his waist. He comes out confused and embarrassed and Moses asks, “What was it you were trying to do?”

“I used to be able to walk on water,” Jesus replies.

“The last time you tried it,” Moses asks, looking him over, “Did you have those holes in your feet?”

If the man has correctly calculated the hypotenuse angles, the required R4 insulation for the type of walls and he had installed all wiring correctly to date, the county could just as well serve as his advocate instead of trying to crush him.

But NOooo, they have to defend the crooked building inspection revenue system where wormy inspectors can be greased for as little as a single pic of Old Hickory.

I suspect that had he applied for all permits and submitted the prints prior to commencing work he wouldn't be the target of vindictive prosecution now. When govt agents are quoted making statements like "the place is inherently unsafe" in an article that doesn't list a single example we know it's a pile of DAWGGY deux deux, and that's something I know something about.

In DE electrical inspections for instance are performed by two competing private companies. If one company is too rigid in their adherence to the code then contractors will naturally call the other, so neither ever make any builders or contractors pull work out or start over.

And, once we get to know an inspector and he sees that the past work was generally good, it's a simple matter to bury any violations secure in the belief that he'll sign off on the work as an "act of good faith".

I don't know how things got to this point, but if you're going to build where there are zoning/permitting regulations in place, it's not a bad idea to try and follow same.

For goodness sake, don't piss'em off.

Around here, the people of the building and land use departments are the most corrupt, greedy, lazy, incurious, drooling retards you'll ever encounter. If you step outside the box of a typical, ticky-tack McMansion, these guys start shaking their heads 'NO' and won't stop. They would have never let him build what he wanted.

For goodness sake, don't piss'em off.

Right, but that's all but impossible without greasing palms now. You'd be surprised how many palms there are now in this county. Miss one, go to jail.

Obviously, the guy knows how to build; so where was the problem?

He was outside their little, simple-minded, greed-driven box.

Been there, done that. Dawg, you know the drill.

The key to solving the problem, if you are of a desire to do so, is get elected to the zoning board or zoning board of appeals and help others of like mind to do the same.

Then just rubber stamp APPROVED on anything that comes your way. :)

I don't understand it, either. He picked a fight that he couldn't win and to me that is indicative of a personality disorder, which may soon be further aggravated by PHS-Prison Honeymoon Syndrome.

Here in DE the Capano Construction Dynasty built a hotel adjacent to an I-95 off ramp, and they built an extra floor without the necessary permits. In fact because of the flood plain, sewer issues, parking and traffic analysis approval may have been problematical even with serious political lubricant, if you get my meaning.

But, because 15 years ago Tom Capano (a former prosecutor and jealous psycho stalker who couldn't take rejection) murdered the governor's lovely "appointment secretary, frequent White House dinner date (our Senator Tom Carper was governor then) and good Democrat" Anne Marie Fahey, The too large Hospitality Suite Hotel will likely never open.

If the murder and ocean dumping of that poor woman isn't gothic enough, you may want to peruse this with the understanding that the murder ("If I can't have her then she'll never puff on the valve stem of a younger, better looking man") and the additional 40,000 square feet of hotel built without permits ("We always get our way since we're so heavily invested in the council") are representative of that whole damned family's arrogance. Ever since the old man passed away and the sons were let loose upon the county it's been New World Italian chaos. ("In 2001, a television movie based on Ann Rule's book was made called And Never Let Her Go with Mark Harmon cast as Capano and Kathryn Morris as Anne Marie Fahey."_wiki)

One former county councilman (also Italian) tried to shake "Big Louie" down for 100 Grand instead of accepting the traditional agreed upon bribe that the others gladly took to make the zoning problem go away. The councilman (Ron Aiello) wanted to "open a pizza shop after (he) left office" and he wanted his last bribe from Louis Capano to be "vastly disproportionate to the value of his vote."

So, Capano promptly hired a team from RENT A GOON and they beat the white off of Aiello's stupid ass. Capano then reported the attempted shakedown to the FBI and cast himself as "victim" (not because of the attempted shakedown but because his usual bribe was rejected and he was hurt) and the councilman went to federal prison. (for getting greedy and failing to accept the usual offer, and he was raped)

It's unbelievable how bribes, zoning variances and wealthy developers are the status quo in New Castle County, DE. But, because of the murder of one very special woman the Democrats are making certain that the Capanos never again get the "access and cooperation" to which they were accustomed.

The county council actually considered filling the hotel's top floor with expanding styrofoam to render it permanent dead space just to guarantee that "the family" doesn't get their way with a new council! (fully involved styrofoam=poison gas, and imagine a firefighter chopping a vent and falling through the roof into a lake of plastic Hell fire)

I see the same vindictive spirit in play in this Acton, CA case. A man who apparently believed that he could divorce himself from the zoning and inspection laws, snubbing sensitive bureaucrats in the process must be sent to prison and raped by his new HIV-positive wife.

HELL HATH NO FURY LIKE A GOVT AGENCY SCORNED!

"...don't piss'em off."

Indeed.

Mister, when you rip into them you leave them skinless!

Wish I'd said that!

And YES, the inspectors 'round these parts will cheerfully accept gifts that show our appreciation for their sensitivity, especially if we're not building a rickety lean to that's destined to collapse and kill folks on the first day of occupancy. (Think; The Hyatt Regency hotel walkway collapse) But they've never come right out and asked me. It was a subtle and silent dance not unlike mating rituals for snakes.

For instance it sometimes involved an inspector's worried looks as he read the results of a 24 hr mercury-vacuum manometer test on new gas piping. (before mercury became a dirty word) If we bought the inspectors (a liquid) lunch any slow leaks overnight (read in inches of mercury column in the gauge) were suddenly within acceptable parameters resulting from temperature differentials, and all was well.

That's funny in a sad kind of way if you know what I mean.

Funny you should mention that case where Capano killed his mistress. I watched that last night on Investigation Discovery. Seems he had a good many mistresses and why he thought it was necessary to kill one just because she didn't want to knock boots with him any more I don't know.

Liberty is not a means to a higher political end. It is itself the highest political end.    Lord Acton

My problem with those people has always been going above and beyond the codes and "that's the way we've always done it," not cutting corners. Some examples from 1981 when I built my house:

"You don't need eight inch walls in this basement. Six is plenty." We have alluvial shifting soils here. Six inch walls commonly fail after about ten years. Code minimum is now eight.

"You've got way too many outlets. Whatta you think you're building, a mansion?" After 30 years of living here, I've got about a 25% deficiency in the number of outlets.

"You don't need more than R-13 sidewalls. The extra cost will never pay for itself." Wanna bet? My heat bill last February was $25. Most other people in the 'hood ran about $200.

"We don't get hurricanes around here, boy. Hurricane ties are just stupid." Ever hear of tornadoes? A house about a half a block from me lost its roof in one.

"You don't need a main panel that big or a 200 amp service." The electric company wouldn't bury the service wires with less than a 200A service. My shop (added later) roof occupies the space where the overhead wires would've been. With the addition of two sub panels, my "too big" main panel is now full.

"You should use aluminum wire, copper's too expensive." Yeah, it was. The copper I used was at the unheard of price of $13 for a roll of 12-2 during the big "copper crisis" at the time.

And on and on, an on...

Godfrey Smith: Mike, I wouldn't worry. Prosperity is just around the corner.
Mike Flaherty: Yeah, it's been there a long time. I wish I knew which corner.

I've always operated on the idea that "If you don't have the time to do it right the first time, when are you going to find the time to do it over?"

That's gotten me into some horrible quagmires (I'm in one now building some custom windows), but the results have always been worth it (if not entirely profitable).
