LANCASTER - A 59-year-old Acton man who was convicted last month of a dozen misdemeanor counts for building a sprawling compound he dubbed "Phonehenge West" today was ordered taken into custody. Superior Court Judge Daviann Mitchell ordered Alan Kimble Fahey to be remanded in lieu of $75,000 bail pending his sentencing, which was postponed to July 22.

The judge determined that Fahey had failed to comply with the conditions for his release on his own recognizance, which included removing people from unpermitted structures and turning off the power, Jane Robison of the District Attorney's Office said.

Fahey was convicted last month of 12 misdemeanor charges, including 10 counts of maintaining unpermitted structures and one count each of failing to stop construction after getting a written stop-work order and unlawfully installing electrical wiring.

Jurors deadlocked on three other counts.

Prosecutors argued that Fahey was ignoring Los Angeles County codes at his 20,000-square-foot compound, feeling he was above the law.

But Fahey's attorney, Jerry Lennon, argued that Fahey had created a unique compound and the county should show some flexibility.

"He's not hurting anyone, and I don't think there's a mechanical or structural problem he can't resolve," Lennon told the Los Angeles Times.

Deputy District Attorney Patrick David Campbell argued, however, that Fahey's property was inherently unsafe. (1 image)

If the man has correctly calculated the hypotenuse angles, the required R4 insulation for the type of walls and he had installed all wiring correctly to date, the county could just as well serve as his advocate instead of trying to crush him.

But NOooo, they have to defend the crooked building inspection revenue system where wormy inspectors can be greased for as little as a single pic of Old Hickory.

I suspect that had he applied for all permits and submitted the prints prior to commencing work he wouldn't be the target of vindictive prosecution now. When govt agents are quoted making statements like "the place is inherently unsafe" in an article that doesn't list a single example we know it's a pile of DAWGGY deux deux, and that's something I know something about.

In DE electrical inspections for instance are performed by two competing private companies. If one company is too rigid in their adherence to the code then contractors will naturally call the other, so neither ever make any builders or contractors pull work out or start over.

And, once we get to know an inspector and he sees that the past work was generally good, it's a simple matter to bury any violations secure in the belief that he'll sign off on the work as an "act of good faith".

For goodness sake, don't piss'em off.

I don't understand it, either. He picked a fight that he couldn't win and to me that is indicative of a personality disorder, which may soon be further aggravated by PHS-Prison Honeymoon Syndrome.

Here in DE the Capano Construction Dynasty built a hotel adjacent to an I-95 off ramp, and they built an extra floor without the necessary permits. In fact because of the flood plain, sewer issues, parking and traffic analysis approval may have been problematical even with serious political lubricant, if you get my meaning.

But, because 15 years ago Tom Capano (a former prosecutor and jealous psycho stalker who couldn't take rejection) murdered the governor's lovely "appointment secretary, frequent White House dinner date (our Senator Tom Carper was governor then) and good Democrat" Anne Marie Fahey, The too large Hospitality Suite Hotel will likely never open.

If the murder and ocean dumping of that poor woman isn't gothic enough, you may want to peruse this with the understanding that the murder ("If I can't have her then she'll never puff on the valve stem of a younger, better looking man") and the additional 40,000 square feet of hotel built without permits ("We always get our way since we're so heavily invested in the council") are representative of that whole damned family's arrogance. Ever since the old man passed away and the sons were let loose upon the county it's been New World Italian chaos. ("In 2001, a television movie based on Ann Rule's book was made called And Never Let Her Go with Mark Harmon cast as Capano and Kathryn Morris as Anne Marie Fahey."_wiki)

One former county councilman (also Italian) tried to shake "Big Louie" down for 100 Grand instead of accepting the traditional agreed upon bribe that the others gladly took to make the zoning problem go away. The councilman (Ron Aiello) wanted to "open a pizza shop after (he) left office" and he wanted his last bribe from Louis Capano to be "vastly disproportionate to the value of his vote."

So, Capano promptly hired a team from RENT A GOON and they beat the white off of Aiello's stupid ass. Capano then reported the attempted shakedown to the FBI and cast himself as "victim" (not because of the attempted shakedown but because his usual bribe was rejected and he was hurt) and the councilman went to federal prison. (for getting greedy and failing to accept the usual offer, and he was raped)

It's unbelievable how bribes, zoning variances and wealthy developers are the status quo in New Castle County, DE. But, because of the murder of one very special woman the Democrats are making certain that the Capanos never again get the "access and cooperation" to which they were accustomed.

The county council actually considered filling the hotel's top floor with expanding styrofoam to render it permanent dead space just to guarantee that "the family" doesn't get their way with a new council! (fully involved styrofoam=poison gas, and imagine a firefighter chopping a vent and falling through the roof into a lake of plastic Hell fire)

I see the same vindictive spirit in play in this Acton, CA case. A man who apparently believed that he could divorce himself from the zoning and inspection laws, snubbing sensitive bureaucrats in the process must be sent to prison and raped by his new HIV-positive wife.

HELL HATH NO FURY LIKE A GOVT AGENCY SCORNED!

That's funny in a sad kind of way if you know what I mean.

Funny you should mention that case where Capano killed his mistress. I watched that last night on Investigation Discovery. Seems he had a good many mistresses and why he thought it was necessary to kill one just because she didn't want to knock boots with him any more I don't know.
