A newlywed Swiss woman from Basel who killed her husband in a tragic gun accident in March has been convicted of involuntary manslaughter but will not serve a prison sentence.

32-year old “Nadia N“ was handed a nine-month suspended sentence by Basel Criminal Court on Wednesday, Blick newspaper reported.

The woman cried as she told the court the accident happened while playing with her husband Victor’s gun at their home in the Gundeli area, south of Basel city centre, on Sunday March 20th. She explained she did not know it was loaded.

Although they first met in 1996, the home care assistant and her musician husband did not marry until the beginning of March 2011.

The tragedy occurred in their house two weeks later while their 13-year old son was staying with a friend.

Her husband was always handling his gun, the woman told the court. Even on the day before the deadly shot was fired, he polished his weapon while sitting in front of the TV and smoking a joint.

Nadia N. told her husband she wanted to fetch the family register from the safe. Victor’s gun, a Glock 17-caliber 9x19mm automatic, was also locked up there.

“As I opened the safe, he called saying he wanted the gun,“ she said. “I wanted to pretend I wasn’t afraid.“

Play-acting, she told the court she held the gun to her 35-year old husband’s temple. “Hands up“, she joked.

Her husband, not believing the gun to be loaded, urged her to pull the trigger. When she eventually did, the gun went off and her husband slumped to the floor. She called an ambulance but he was dead before it arrived.

She was held in police custody for two nights but investigators soon came to conclusion that her husband may have loaded the gun with a real bullet rather than a blank while under the influence of marijuana.

The judge found Nadia N. guilty of involuntary manslaughter, but reasoned that "the consequences of what happened are so heavy that an exemption of punishment is justified.“


Besides what's reported it seems pretty stupid to mix blanks and shells in a single gun.

Who in their right mind would load a Glock with blanks in the first place? It sure as hell wouldn't do any good against an armed intruder.

Besides, even if it was a blank, it still would have blasted a hole if the barrel was placed right up against the temple.

Sounds to me that either he forgot he had left a round in the chamber, or the wife put one in herself. Maybe he didn't "urge her to pull the trigger" as she claims, and she decided that she was going to do him in. Who knows.

But then again, even our "heroes" sometimes forget that their guns are loaded...

You'd think he'd at least have the sense to end the presentation after he shot himself and walk off with a least a grain a dignity. Oh no, he wants to hold an AK-47 for the class afterwards, till the kids tell him "NO, put it down".

I think the guy had to quit the DEA, he was the butt of so many jokes he couldn't work there anymore. Then again maybe he was sampling too much of the evidence, maybe THAT'S what happened that day... LOL

Actually it was an AR15 or M16 he asked for after the shooting. And he sued the DEA for releasing the tape and exposing him to ridicule. In his suit he claimed that he was "one of the best if not THE BEST undercover agent in the DEA".

Do you believe that? Even after leg shooting himself his arrogance was undiminished.

In DE when hunter education courses are taught in schools there are strict rules about the firearms and ammo used in the classes. Specifically, "never the twain shall meet on school property".

Now, I suppose the school system where Agent Lee Paige put those kids' lives in jeopardy wouldn't have dreamed of setting safety standards for agents of FEDGOV, Inc.

But, did they know that the agent conducting the show and tell would be an arrogant, stupid 85-IQ jackass who probably points at words when he reads and who never completely read or comprehended the simplest fundamentals of firearms safety?

And what do you wanna bet that the AR15 he asked for (as he was going into shock) was also loaded? Can anyone explain why the weapon he used in the demo was loaded at all? If he felt the need to always be armed for his protection then that weapon should have remained holstered and another unloaded but identical weapon used in the demonstration.

There are simple rules that amount to idiot proofing for reasons that require no explanation or justification. Of course had the school made such suggestions prior to his negligent (not accidental) discharge, he'd have no doubt been indignant at the implication that there was any risk at all as he, Mr. "I Bee da ownlee Mo Fo heah qualified to handle dis heah bad ass fawty!", showed his stupidity while putting others in serious danger.

All it takes is one mistake and we learn why the rules are so absolute and necessary. Sadly, he didn't learn the hard way before his You Tube debut, and he didn't believe that the rules applied to him because he was just so darn special!

And the diff between his last class and my outdoor education class is, I'd be held responsible if my negligence resulted in the death of a trusting innocent, but federal agents can literally get away with murder as FBI HRT sniper Lon Horiuchi proved after killing Vicki Weaver at Ruby Ridge. (the rules of engagement were changed on the spot but Vicki was neither armed nor the target of Horiuchi's bullet-her death was pursuant to the sniper's "lawful performance of his duties" despite the improvised "out of policy" rule change. And lets not forget the mass murder at WACO by Delta Force operatives and FBI who laid in wait and machine gunned all who were able to escape the collapsing inferno)

On behalf of The Attorney General and The Director of The DEA we'd like to express our sincere condolences on the loss of your son, Johnny Junior. As you know the agent who was present during the tragedy feels terrible as well, and the weapon is being inspected by experts to isolate and identify the mechanical malfunction that was likely responsible for your son's death.

And, let me assure you that no matter the outcome this public relations disaster will go on Agent Lee Paige's permanent record and will be considered when he is eligible for future promotions and/or merit pay raises. This action is actually quite harsh because your son's death was "pursuant to Agent Paige's lawful performance of his duties" which is regrettably also why the court denied your motion to sue the agent or The DEA".
