Here’s one the mainstream media isn’t going to tell you: County sheriffs in Wyoming are demanding that federal agents actually abide by the Constitution, or face arrest. Even better, a U.S. Federal District Court agreed. The court decision was the result of a suit against both the BATF and the IRS by Mattis and other members of the Wyoming Sheriff’s Association. The suit in the Wyoming federal court district sought restoration of the protections enshrined in the United States Constitution and the Wyoming Constitution. Guess what? The District Court ruled in favor of the sheriffs. In fact, they stated, Wyoming is a sovereign state and the duly elected sheriff of a county is the highest law enforcement official within a county and has law enforcement powers exceeding that of any other state or federal official.” Go back and re- read this quote. The court confirms and asserts that “the duly elected sheriff of a county is the highest law enforcement official within a county and has law enforcement powers EXCEEDING that of any other state OR federal official.” And you thought the 10th Amendment was dead and buried — not in Wyoming, not yet. Sheriff Dave Mattis Bighorn County Sheriff Dave Mattis spoke at a press conference following a recent U.S. District Court decision (Case No. 2:96-cv-099-J (2006)) and announced that all federal officials are forbidden to enter his county without his prior approval …… “If a sheriff doesn’t want the Feds in his county he has the constitutional right and power to keep them out, or ask them to leave, or retain them in custody.” Bighorn County Sheriff Dave Mattis comments: “If a sheriff doesn’t want the Feds in his county he has the constitutional right and power to keep them out, or ask them to leave, or retain them in custody.” “I am reacting in response to the actions of federal employees who have attempted to deprive citizens of my county of their privacy, their liberty, and their property without regard to constitutional safeguards. I hope that more sheriffs all across America will join us in protecting their citizens from the illegal activities of the IRS, EPA, BATF, FBI, or any other federal agency that is operating outside the confines of constitutional law. Employees of the IRS and the EPA are no longer welcome in Bighorn County unless they intend to operate in conformance to constitutional law.” The implications are huge: But it gets even better. Since the judge stated that the sheriff “has law enforcement powers EXCEEDING that of any other state OR federal official,” the Wyoming sheriffs are flexing their muscles. They are demanding access to all BATF files. Why? So as to verify that the agency is not violating provisions of Wyoming law that prohibits the registration of firearms or the keeping of a registry of firearm owners. It appears to me that one office where the Libertarian Party should focus it’s limited resources is County Sheriff. The change that could be made is nothing to laugh at. I hope it does, but some Sheriff's Departments have Feral Agencies already embedded within. If it does take hold it will be first in the West and the South. Wrong. Federal Agents have the same right to be in any State that we all have. When they violate the law or, violate the individual rights of citizens then, County law enforcers may take action. Each of us should give our respective sheriffs a copy of Richard Mack's book along with a short stack of Sheriff Mack DVDs.

The court itself has issued statements that there was no such decision. In any case, this case was filed (and thrown out) in 1996, so it definitely isn't "recent".

Wyoming sheriffs are far and away the most powerful sheriffs in the States. Nearly all the other states have a county attorney or board of supervisors as their top authority and the local sheriff is actually subordinate to them. Even if a county attorney wanted to follow the path of the Wyo sheriffs, it is much harder, perhaps impossible. As sworn officers of the courts, they endanger their law certification if they attempt to resist state or federal intrusions. If you want your sheriff to be able to do what the Wyo sheriffs can do, you need to alter your state constitution. Then you'd have to keep a very careful watch on your sheriff because he would become so powerful.
look at shoonra's post 14 & my edited post #1. This case was from 1996, & the court issued no such ruling. What did occur was that the Wyoming sheriff issued a POLICY afterwards, which was indeed good, for what it's worth.

It turns out that the very source linked at the top reveals this story to be a fake. He lost the election in 2006. It turns out that he started this nonsense because, in 1996, the IRS tried to subpoena from the county clerk some papers relating to a real estate transaction (and the federal district court backed the IRS). This story was carried forward by The Spotlight, which was published by the now defunct Liberty Lobby. As for the pretended quotation about the sheriff being "the highest law enforcement official" with "powers exceeding any ... federal official" -- I checked it on Lexis and no court, state or federal, anywhere in the US said such a thing in the entire history of the Republic.
Is it not a fact that courts often seal cases so they do not show up in clerks records or databases so they cannot be used as precedents for other cases, especially when a patriot wins? The answer to that would be yes. Bottom line we are not dealing with article 3 constitutional courts we are dealing with administrative law courts who use case law and maritime law and sometimes even make it up as they go and do not use lawful statute as they are supposed to. People have actually been told in these courts not to bring up the constitution again under threat of sanction. Many of the articles on the internet having to do with the powers of the sheriff seem to have been scrubbed. I wonder why.
