I read about cases of travesty of justice concerning prosecutors tampering with the jury. What bothers me is why there is nobody to police the prosecution team. Isn't the Grand Jury supposed to handle things like this?

Well then the only alternative is to sue the prosecutors in their individual capacities! Find out where they live and serve them up the lawsuit. They hate this shit. They think they are totally immune from being prosecuted. They are not immune anymore than judges are not immune. Judges can go to jail and so can prosecutors. www.jail4judges.org/

thanks for posting this! Heicklen has done a lot of good work & .the states anger shows he is effective. A year ago, another liberty activist was arrested for filming Heicklen's arrest. The videographer, a ron paul supporter, then sued DHS & won.

I used to hand out jury nullification info in San Diego 20 years ago - they threatened to arrest us and ultimately they did. Those are private courts on private property.

The Constitution has no bearing on commercial courts.

I have often wondered why it is presumed that everyone knows the law and therefore ignorance of the law(s) is no excuse for breaking it/them, but at the same time, if you are ever chosen for jury duty you suddenly become an imbecile who needs some lawyer in the cult of the black robe to explain the law to you. Strange that.

The proper statement is: Ignorance of the law is no excuse upon proper notice.

In Lambert v. California the Supreme Court of California declared unconstitutional a Los Angeles statute that required all convicted felons to register with the police department within five days of arrival in the city. The Supreme Court held that the lack of either notice or a showing of probability of knowledge of the statute violated due process.

Then, last year, federal prosecutors had Mr. Heicklen indicted, charging that his activity violated the law against jury tampering.

If the defendant gets a jury trial, isn't the prosecution obligated to put a warm body on the witness stand and proclaim that they're a sitting member of a jury who was illegally influenced in order to fulfill the charge of 'jury tampering'??

Yes. They charged some with trespassing after threatening jury tampering ... and those charged paid minor fines. (I wasn't one that was arrested.)

In court on Friday, Judge Wood cited a written request by Mr. Heicklen that Muslims be “excluded from the jury” because he was Jewish and “Islam preaches death to Jews.” Because he was charged with a misdemeanor, she said, he was not entitled to a jury trial; and in any case, she said, jurors may not be excluded because of religion. Mr. Heicklen has extended his protest to suing the government and various hospitals to which he was taken after being issued citations and falling to the ground. “Plaintiff Heicklen,” he said in one suit, “has become an angry man.”

COURT DISMISSES CRIMINAL CHARGES AGAINST HEICKLEN Julian Heicklen, a Libertarian Party candidate for County Commissioner, was arrested on March 12, 1999, for distributing campaign literature in front of the Wal-Mart on the Benner Pike in Centre County, PA. He was carried away in handcuffs for arraignment, where he was charged with criminal trespass and released on his own recognizance. The following day, Heicklen returned to the front of the Wal-Mart store and again distributed campaign literature. He was arrested and charged with criminal trespass and disorderly conduct. He was incarcerated in Centre County prison in lieu of $75,000 straight bail. At his preliminary hearing on March 17, 1999, he was bound over for trial and released on $20,000 straight bail.

Heicklen's attorney, Joseph Devecka, filed a writ of Habeas Corpus to dismiss the charges. On June 15, 1999, Judge Thomas King Kistler of the Centre County Court of Common Pleas granted the writ of Habeas Corpus and dismissed the criminal trespass charges. In his Opinion, Judge Kistler stated that: "Wal- Mart has not uniformly and generally prevented the area in front of the store from becoming a public forum."

Yeah, that does make some sense. Because no one, not even the smartest judge in the country, could even know what all the "zillions" of "laws" are, much less how to avoid breaking several of them every time you venture more than ten feet outside your own property.

Anyone who does not know about jury nullification should investigate for themselves. It is a citizen's right to know of these things, and the final check against gooberment tyranny.
