Seems the Equal Protection Clause of the 14th Amendment should apply as police can record without consent, but the people can't? Of course that argument would only be needed for those who are already clueless....
If you are in a public place, you have no right to privacy. That's why it is called public, and not private. People can record whatever they want to legally. This is just a scare tactic the government and media is using to get people to stop recording officers gone wild. The case will be thrown out, and it won't make the news. They only report what they want you to know.
