FAIRBANKS - The FBI served a material witness warrant Tuesday afternoon on Michael O. Anderson, the Elliott Highway resident who was arrested with Fairbanks militia leader Schaeffer Cox and three others this spring and was the only one of the five freed in October when state criminal charges were dropped.

Anderson was brought in — not arrested — by federal agents and is being held at Fairbanks Correctional Center.

A material witness warrant is a tool prosecutors use to compel a person to testify in a criminal case when the person is not cooperating under a subpoena.

Assistant U.S. Attorney Steve Skrocki confirmed a judge signed a warrant for Anderson and said Anderson will have an initial court appearance with his attorney Lawrence Reger on Wednesday in Fairbanks. The hearing time has not yet been set and it is not yet certain whether it will be open to the public, Skrocki said.

Bail will be discussed at this hearing, he said.

Joshua Bennett, a friend of Anderson who has been letting Anderson and his wife live at his home, saw the action Tuesday afternoon. At about 12:30 p.m., a group of between 20 and 30 FBI agents arrived at Bennett's Badger Road area home, he said. The agents, who wore bullet-proof vests and carried machine guns, said they were there for Anderson. They said they had a warrant, although they would not show it, Bennett said.

Bennett said he was surprised by the event because he thought Anderson was complying with a subpoena in the ongoing federal case against Cox.

Skrocki disagreed with Bennett’s characterization of Anderson’s behavior.

When Anderson was first arrested with the other four defendants in March, he and the others were accused of making a plan to kill Alaska State Troopers and court officials. Prosecutors cast Anderson as the logistics man of the group and said he was doing surveillance on troopers. That case was dismissed in October after a state judge ruled that secrete recordings made by an FBI informant without a search warrant violated the Alaska Constitution and are not admissible in state court.

Unlike the others, Anderson was never indicted in federal court, where the others face weapons charges in a separate alleged plot to kill federal authorities. He was released from Fairbanks Correctional Center last October.

This condition and the anger it causes is UNIVERSAL. The Brits are actually going into courts in large numbers and attempting to arrest the Judges ... they will succeed eventually and things will get real ugly.

Sad story. 8 children changes your response dramatically. Children should not be hurt like that. I have no children, and the center of my universe died Sept 20. Nothing to lose. I hope, when my time comes, I can stand against them a little longer.
