In Texas on the I-35 North, a warrantless internal checkpoint nowhere near the U.S. border. An immigration officer asks if I am a U.S. citizen and then asks "where ya headed?" It's bad enough that I answered him at all, which is not required. (See checkpointusa.org) But as this example shows, once you submit to tyrannies, they get even bolder. It's none of this jackboot's damn business 'where I am headed', or where I came from.
In Delaware the state police set up a check point and when they asked one man where he was going, he said, "I don't believe that's any of your business".
He was arrested for "wandering aimlessly without purpose".
As I've said many times before, it's a form of summary punishment known as, "You can beat the charge but you can't beat the ride".
years ago i was stopped by the chp and they asked where i was going and i responded by asking "Why?"
"Step out of the vehicle", was their response (on the freeway).
In court, i asked the witness (cop) why they told me to get out. since his partner was the one who told me to get out, he pussied out of answering. so then i asked him, "do you believe that police have a right to demand where someone is going or where theyve been? that it is compulsory for the person to answer?"
he said YES!!
wow.
I have the record of this. i need to find it and post it sometime. this is what the chp cops believe. incredible.
that case i referred to was a speeding ticket. it was the one case i lost since i learned how to fight tickets. the reason i lost was because i got sloppy and did not follow my own advice and demand DISCOVERY.
in this case the 'discovery' request consisted of , when the radar gun is tested by an indepent agency every 3 or so years. the cop had testified that it had been tested by the state university at san diego. (this is different from being calibrated).
when i asked tzhe cop if he has the records of that, he did not have it. so it was heresay.
on appeal, the judge ruled that IF I HAD DEMANDED THAT PROOF OF INDEPENDENT TESTING IN DISCOVERY, and the cop hadnt had it, then he would have dismissed the case.
but, i had skipped the discovery letter in that case.
my bad.
it only consists of one simple letter to the prosecuting DA.
since DAs dont ever show up to traffic trials anyway, its nothing more than a one sheet of papper (plus a 44 c stamp) technicality that can help you win,
