Alan Dershowitz: Zimmerman Arrest Affidavit "Irresponsible And Unethical"

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”

Poster Comment:

I hope the massive racial manipulation of the public by the whore MSM is becoming clearer. By charging Zimmerman with 2nd degree murder, the special prosecutor has created a scenario where a dismissal of the charges at trial is a distinct possibility. Should that happen, and should the timing of such a decision be close to the November (s)elections, this nation will split like nothing we've seen since our Civil War.

I doubt it.

Two huge events coming in a few months. They have now become so intertwined that one is the powder keg, the other is the fuse.

Race whores will try their best to make sure they are made to dance together.

Obama/election, meet the Zimmerman race war.

Ten to one, no judge in Florida will throw it out.

Remember the Feds are there, looking over their shoulders, using all their power to intimidate.

As much as I despise Alan, I think he has this one right. The charge is a massive over reach by an "aggressive" political appointee.

I agree that a judge won't toss it, but an even worse scenario is if a jury tosses it. We'll have a Rodney King redux.

To my mind, Federal presence with a heavy hand looking over the State justice people, will force this abortion to go to trial.

We cannot forget that the President of the United States interjected himself DIRECTLY into this affair, and only he can now diffuse it. He wont.

Yep, his clarion call of we're all Trayvon now was one of the most irresponsible moments of his (cough, cough) presidency. It was pure street agitation, something we know instinctively, but lost completely on the still confused.

His utterance was that of a "neighborHOOD organizer" at street level.

It would have a step up to "midnight basketball director" level.

Speaking of hidden from public view, what ever happened to the Sideshow at circuses? People like the Obama's would have been a huge hit at them. It was the only thing I liked about circuses. Clowns suck, elephants smell, and all Ring Masters remind me of serial killers, but the Sideshow, that was for me!!!! This would likely happen in a pre-trial motion, I think. Depends on FL statutes.

She may be charging 2nd just to show she's serious. Either way, it helps her force a plea bargain on a frightened Zimmerman.

If Zimmerman calls her bluff and the judge throws it out, she can say she tried (and blame the judge) and still charge him with manslaughter and either try the case or plea-bargain it further.

Exactly. The over charging is typical of an unethical (Dershowitz's choice of words) prosecutor. Welcome to our judicial system, eh?

Har T har har har.

The Russian Communists had a perfect solution to our problem.

The Reds took over Moscow and told the Duma (congress) that they had twenty four hours to leave town or be shot on sight. They ran like scared rabbits.

Recently the government prepared a plan on how to put a ring of men in arms around DC in case of "national emergency", and let no one in or out.

Now think about this, no American citizen would want to go in, so just maybe they are more interested in keeping someone (congress/government) IN????????????????

The D.A. may go for lesser included charges so the jury could pick 2nd, manslaughter, etc. Depends on FL law and the judge.

People always forget that every state has its own laws.

And if FL fails to railroad him, Holder will try it as a hate crime or something in a federal case.

I'm not at all sure if a DA can change the charge of a "special prosecutor." I imagine it's possible, but if I were in Zimmerman's shoes I'd roll the dice on this. And yes, for sure Holder the racist will hammer him with a bogus civil rights charge, but the dude if half Hispanic, so how does that work? This system is so entirely effed that nothing short of ripping it down will change things. As things grow more acute we can forget about trying to "change things from the inside." We haven't enough time.

The only way he is going to found guilty is if the defense can prove beyond a reasonable doubt that it was Trayvon calling out for help and not Zimmerman. If they can't do that, any jury that does convict him of second degree murder are morons.

Two Bushes a Clinton and a Obama have him beat for that title. Jimmy was very book smart, but dumb when it came to social and political diplomacy. He thought the best of people, which led to very dumb decisions, when he should have trusted no one. He now realizes this and has written a book about Israel's unfair treatment of the Palestinians to let them know he isn't going to the grave without speaking out against them. It may be too little too late, but for writing that book I respect him.

God is always good!

I don't think so.

Do you REALLY think darkie thinks Zimmerman is white? The ONLY people buying the anti-white spin in this case are SOME dopey whites. The media is looking stupider by the day to EVERYBODY else, including darks.

Zimmerman is not "the man." Sure, darkie may make some noise about "the man" in this case, just to see if the charge sticks, but Zim is NOT "da man." Everybody knows this.

Therefore, their hearts are not and will not be in it.

That's why mom says it was an accident.

It's not some big noble gesture on her part.

The guys who shouted "Treyvon" while beating a white guy?

To them it's just a word, an excuse WHITEY accepts for them to do what they want to do anyway.

Bush The Wimpier did the same thing with the four cops charged with crimes after Rodney King's rhythm stick party.

George Herbert Walker Bush was also attempting to garner minority votes at election time a year later, but as with his Gulf War and 4000 bombing sorties against Iraq (with his timing off by two years) he derived no benefit from having served those cops up to the nig.... I mean, African American community.

Having listened to the unedited 911 tapes, hearing Trayvon beg for his life, I would have to disagree with Dershowitz...Their is definitely something there worthy of a murder charge.

God knows it is very likely that if Zimmerman had done this to one of our kids we probably would not of waited 45 days for the DA to get off her ass and charge him but rather handled the matter ourselves.

Their is alot of engineered division over this though... I mean I don't understand what folks don't get. Race is not an issue here... Zimmerman killed a 17 year old who was begging for his life...... probably on his knees but the tape was only audio so we can't know that detail... still... it is enough to know with certainty that Zimmerman (with his violent criminal past) killed a kid begging for his life. What folks don't understand about that is mind blowing to me.

I agree with OI ... I don't think we know who was begging for their life. I read where one witness said it was the guy on the bottom wearing red clothing ... and that would have been Zimmerman.

I also feel like the media and the STATE OF FLORIDA are colluding to create chaos.

I despise Dershowitz, but the man isn't dopey. For him to come out so strongly against the State validates what I thought initially; the charge is an overreach and an unethical attempt to get Zimm to plea out to a lesser charge. If he doesn't, and he skates, we'll have another media driven riot.

The evidence hasn't been divulged as of yet.

Zimmerman called 911. A 911 operator isn't necessarily a "cop" - and it's possible that something happened we don't know about after the conversation with 911 provoking a fight to break out.

There are too many pieces of the puzzle missing to know whether or not the shooting was justified. We already know that the media edited the tape recording to make Zimmerman appear racist.

We also know that Zimmerman volunteered his time to mentor young children of diverse ethnic backgrounds. On top of that Zimmerman is a hispanic.

As often as we're lied to by the media and the government we should show a little more restraint when considering whether someone is or isn't a murdering racist, or before we accuse someone of any criminal act.

In America, one is presumed innocent until PROVEN guilty beyond a reasonable doubt when charged with murder.

Yes indeed, trial by media blows hard and it's something 4um members know all too well. The only thing I'm positive about regarding this case is that we've been lied to at least three times by the whore MSM, and that their other presentations are rife with propaganda (the photo's of both Martin and Zimmerman). If the lies and the propaganda are fact, how does one accept as true anything else they serve up?

As often as we're lied to by the media and the government we should show a little more restraint when considering whether someone is or isn't a murdering racist, or before we accuse someone of any criminal act.

As we can also see with the media repetition of the term "White Hispanic" and the "Hispanic" part was only added later in the reporting when the media was called on it. Up to that point it had all been "white, white, white" and poor innocent black African American youth with a clean record (which we later found out was not true as he had been suspended for assault). The obvious intent was a psychological one to implant the idea that "dat da po' homeboy be done killed by a WHITE HISPANIC RAY-CISS."

This story is, and has been, under heavy spin control for psychological effect. The intent would seem clear and that is to inflame passions along racial lines.

sorry, but that theory is flat-out stupid. someone who initiates a conflict ARMED, & ignores police orders to retreat, then murders their victim with their gun, does not "beg for their life"..

Armed is not the same as drawn. A gun in a holster is a blunt object. I do not know what exactly transpired because I was not there and we do not yet have a reliable data set. From the evidence we currently have it is just as possible that "po" Trayvon went ballistic on this guy who was following him and the gun was drawn only after "po™" Trayvon assaulted the WHITE HISPANIC ray-ciss Zimmerman. And according to at least one eye witness account it was Zimmerman calling for help not "Po™" Trayvon. The set of associations being intentionally implanted seems clear - the enforced assumptions that Zimmerman is white, Trayvon black, it is in the South, and that therefore it simply has to have been an attack by a WHITE HISPANIC RAY-CISS.
