The report says when the officer tried to calm the child, she resisted and was cuffed.

Doesn't say what she resisted. Arrest?

They took the child to the police station where she was charged with simple assault and damage to property. Because of her age, she will not have to go to court.

So no trial? Then why bother charging her, unless she's simply presumed guilty tribunal style.

Do they have special handcuffs to go on a child that small? Would regular adult cuffs even work? I'd imagine there's a fair chance of injury putting those heavy adult cuffs on a 6 year old, especially one who's throwing a fit.

Yes, if someone is arrested (how would a kid know what a “charge” is) they cannot resist arrest. And yes, most handcuffs can be made to restrain even a child. About not going to court, I haven’t an effing clue. All I can say is that we aren’t in America anymore Toto.

Sure but they cannot arrest simply for resisting arrest, as there has to be a legit reason to arrest in the first place. Seems her crime was resisting attempts to be calmed.

One would think but an illegal arrest cannot be resisted either, ergo the resisting charge becomes the primary charge. Simply psychotic, no? Again, considering this kid was 6-years old, she had absolutely no conception of a crime, a charge or resisting. This vid should make the finals for the 2012 "Darwin Awards."
