The fight over Arizonas immigration law continues and many think it will have huge implications across the United States. Today, the opening statements began in the Supreme Court hearing over the law, known as SB 1070.
On todays Americas Newsroom, Judge Andrew Napolitano talked about both sides of the argument over the controversial law.
He explained that if the federal government wont enforce the border laws to keep illegals out, Arizona promises to do it for them.
When it comes to the federal governments argument, he said they believe immigration and border control is a federal issue not a state issue. The federal government believes that if they let states do it on their own that our country will have 50 separate immigration policies rather than one.
Napolitano thinks the bizarre twist here is that only eight of the justices will hear this in court because Justice Elena Kagan took herself off the case because of her past work with the Department of Justice in resisting the Arizona statute when she was in the Obama administration. If theres a tie in the ruling, Napolitano says the decision made by a prior court is upheld, and that decision was that the Arizona law was unconstitutional.
