Who says you can't beat city hall?

After years of proclaiming false legal advice to motorists ensared by its red-light camera program, the city of Corona, CA has changed the text on its webpage regarding their claim that registered owners of ticketed vehicles 'must identify' the driver to police if it is not them.

Prior to being exposed by leading alternative news website WhatReallyHappened.com on August 21 2012, the city of Corona maintained the fraudulent webpage text for years on end, since at least 2009, claiming that motorists were legally obligated to snitch on the driver of their car:

"On March 30, 2009, the City of Corona installed red light enforcement cameras at various intersections throughout the city. The cameras photograph motorists that fail to stop for a red light and also records the violations in streaming video. If you have been photographed failing to stop for a red light you will receive a notice in the mail. The notice will be addressed to the registered owner of the vehicle or the actual driver if he/she can be identified by the reviewing officer. If you were not driving the vehicle at the time of the violation, you must provide the name and address of the person driving." The video and photographs can be viewed from any computer..." [emphasis added.]

The citys' POLICE DEPARTMENT RED LIGHT CAMERA ENFORCEMENT webpage was recently changed, and they completely omitted the line which read "If you were not driving the vehicle at the time of the violation, you must provide the name and address of the person driving.":

"On March 30, 2009, the City of Corona installed red light enforcement cameras at various intersections throughout the city. The cameras photograph motorists that fail to stop for a red light and also records the violations in streaming video. If you have been photographed failing to stop for a red light you will receive a notice in the mail. The notice will be addressed to the registered owner of the vehicle or the actual driver if he/she can be identified by the reviewing officer.The video and photographs can be viewed from any computer..."

After being posted on WhatReallyHappened, visitor logs revealed that the August 21, 2012 article, titled "City of Corona, CA claims that traffic defendants must be compelled to testify- City of Corona CA continues giving fraudulent legal advice to ensare motorists" was viewed by The County of Riverside numerous times, as well as the County of Orange, U.S. Department of Homeland Security, Navy Network Information Center (NNIC), Federal Aviation Administration, The City of Riverside, Raytheon Corporation, Boeing Corporation, UC Berkley, and numerous universities, law firms, and individuals.

The deception was originally pointed out by HighwayRobbery.net on their Corona documents page, which included a 2009 screen shot of the city's website and stated in part "The City's Coercive Website The City's website says that you "must" identify the person who was driving your car. Corona website as of Sept. 23, 2009. Emphasis added. Remember: You don't have to!"

On August 16th an e-mail inquiry had been sent to the Corona city mayor, city manager and police department regarding the deceptive text, asking "Given the fact that we have a 5th Amendment, which states, in part, "No person shall be compelled in any criminal case to be a witness against himself", on what legal basis is this claim posted to your website? Is this purported to be legal advice to defendants seeking information on their citation? Does your city attorney or local prosecutor have any comment on this section of your website? In addition, due to some recent CA appeals court decisions and lawsuits regarding these cameras, an explanation would be insightul."

On September 4th, the Corona City Council narrowly voted 3-2 to finalize their decision to axe the city's contract with Redflex Traffic Systems, Inc. The system will officially cease operation on Guy Fawkes day, November 5. Despite being dismantled in less than 2 weeks, Corona's website makes no mention of this on their webpage to visitors who have been ticketed. John Shanahan, who received a red-light camera ticket from Corona in July, originally had a court date in August but has gotten three extensions (two over the phone and one in person). His initial arraignment date will therefore take place long after the system has been scrapped, making it highly unlikely that the prosecution witness will appear, or that the city will comply with lawful demands of intricate discovery requests and cross examination of witnesses.

LibertyFight.com recommends and strongly encourages that if anyone sees their city revenue agents, police, or government agencies giving false advice to ensare motorists, do all you can to document the fraud and hold them legally accountable for their actions. After all, the law does not just apply to us.
